16-year-old charged in beating outside Madison West High School

A 16-year-old boy was tentatively charged with substantial battery after he punched another boy in the head outside Madison West High School Monday, police said.

Police said the mother of the victim called them just before 3:30 p.m. to report the attack, which the victim did not fully remember because the punch might have caused him to black out. Madison police spokesperson Stephanie Fryer said the victim and a friend had been walking to a bus stop at the corner of Regent and Ash streets “when three other teens approached wanting to fight.”

“The victim and his friend turned around to leave the area and the victim was punched in the head,” she said.

Regent and Ash streets make up one corner of the block that includes West High, and police reported the attack happened “while at school.” Fryer said the victim and his attacker are West High students.

But Madison School District spokesperson Tim LeMonds said Tuesday morning that no such incident happened on “any of our campuses.”

Ex-Madison schools spokesman retaliated against employees, report says

The complaint was made public in May following a public records request by NBC15 reporter Elizabeth Wadas, whom LeMonds allegedly said was “quickly becoming the sleaziest journalist in Madison” and whom he called “a pig of a journalist.” LeMonds tried to fight the release of the complaint, which was responsive to Wadas’ records request, in court, arguing it did not meet the balancing test for what the public needed to know compared with the damage it would cause.

A judge ruled against him, however, and the documents related to the initial investigation were released in late May.

He remained working in his role until mid-June, when he was placed on paid leave. The letter placing him on leave, dated June 12, was also provided as part of Tuesday’s released records.

The staff also told district investigators that LeMonds frequently expressed his disdain toward certain reporters, all of them women.

On Oct. 6, 2022, he allegedly told members of the district’s communications department that there was “no way” he would respond to three interview requests from an unnamed reporter, described as a woman of color, because he “didn’t like her.” In that same meeting, he asked staff to share any negative experiences they had with former Wisconsin State Journal reporter Elizabeth Beyer, whom he called “a horrible human being.”

He also reportedly called WMTV (Ch. 15) reporter Elizabeth Wadas “a pig of a journalist,” who was “quickly becoming the sleaziest journalist in Madison.”

LeMonds in June pointed to the district’s initial investigation findings as proof absolving him of the claims. Two months earlier he’d sued his employer to prevent the release of the records including those claims. That bid was denied in late May.

The Madison Metropolitan School District’s head of communications, Tim LeMonds, is on leave amidst an ongoing investigation. NBC15 Investigates confirmed LeMonds’ employment status with the district’s human resources team Thursday afternoon.

Earlier this month, MMSD broke its silence after a complaint alleging harassment and bullying against its head of communications was made public after NBC15 Investigates went to court to make the complaint public.

After a Dane County judge ruled MMSD had to release the complaint to the public, the district sent a public statement. It was sent byf Communications Manager Ian Folger who confirms the statement was drafted by MMSD’s legal team. The statement addressed a complaint against LeMonds that alleges instances of “emotional abuse, bullying, unequal pay, and harassment on the basis of gender, and race or ethnicity” against current and former district employees.

The complaint details how LeMonds allegedly interacted with and spoke about female journalists, including NBC15′s Elizabeth Wadas. According to the complaint, LeMonds allegedly described Wadas in a Zoom meeting as “Quickly becoming the sleaziest journalist in Madison…What a pig of a journalist” in response to a story Wadas was working on that wascritical of a high school football coach. The school did an initial investigation into the complaint months ago and found most of the claims were found “without merit.” And no action was taken against LeMonds at that time.

It’s not just LeMonds’ staff that has struggled to work with him. LeMonds physically blocked a WMTV-TV (Ch. 15) news reporter from posing a question to Superintendent Carlton Jenkins at a public event — even grabbing and pushing down her hand and microphone, as video of the incident shows. He allegedly called the same female reporter a “pig,” among other insults, according to LeMonds’ staff. He used an expletive to describe how much he hated a female reporter for the State Journal last summer, his staff alleges.

LeMonds even ignored requests from Kelly Lecker, our executive editor, to meet with her after she was hired more than a year ago. What kind of a public relations manager refuses to sit down with and get to know the incoming leader of the major news outlet in his city? A bad one. A really bad one.

LeMonds only made the staff complaint against him a bigger and lengthier story by suing the district — the same one that employs him — to try to keep the allegations secret. A Dane County judge rejected his awkward and brash move, siding with the district in favor of the public’s right to know.

LeMonds recently told the State Journal he hasn’t been following the news coverage of the staff complaints against him. Really? His job should require him to be on top of any and all news about Madison’s schools, especially the bad stuff. That’s only more evidence he’s not doing his job.

Taxpayer funded Madison School District‘s “communications” department review

The Madison Metropolitan School District is “committed to doing the hard work and restoring the integrity” of its communications team following the release of an employee complaint against spokesperson Tim LeMonds last Friday.

In an unsigned statement posted to its website Thursday and sent via email to reporters by Communications Manager Ian Folger, the district said it “will conduct a full review of the department operations, structure and human interaction in the coming months,” with no more specific timeline.

“At the same time, the District will have significant leadership changes this summer, and through those transitions we will work to reorganize and restore relationships that are essential to our success,” according to the statement. “We will work to build a positive workplace culture for employees.”

Those leadership changes include Superintendent Carlton Jenkins retiring and longtime administrator Lisa Kvistad taking over as interim superintendent during a search for the next permanent leader. Chief Financial Officer Ross MacPherson and General Legal Counsel Sherry Terrell-Webb are among other top leaders leaving this summer.

In fact, in a story last week in Isthmus by Deborah Kades, she reports that when WMTV reporter Elizabeth Wadas approached Jenkins at a public meeting last winter LeMonds prevented her from reaching him. He told her that the meeting was for the public. Wadas informed him that being a reporter did not make her an alien, but apparently to no avail.

LeMonds also leads a communications department for a district that, beyond just LeMonds, seems intent on not communicating. In 2019 a Madison East educator and trip chaperon was found to have placed hidden cameras in the hotel bathrooms of students. The district conducted an investigation to determine if staff followed policy regarding the reporting and follow up on these incidents. The investigation concluded they had, but the district refused to release the report. Parents and students were, understandably, upset. Even school board members were not allowed to read it. Then, inexplicably and in response to another open records request on yet another camera incident, the district released the full report to Isthmus in August of 2021. LeMonds refused to answer Isthmus reporter Dylan Brogan’s questions about it at the time. 

And over a long period, the MMSD holds the dubious distinction of being the least transparent public agency in the state. In March, the Wisconsin Freedom of Information Council “awarded” the district with its No Friend of Openness (Nopee) award. The council wrote: “It’s rare for a public institution that depends on taxpayer support to be as awful as this one when it comes to public records and accountability. The district, through spokesperson Tim LeMonds, has become notorious for outrageous delays and excuses, prompting multiple lawsuits alleging violations of the records law. Tom Kamenick of the Wisconsin Transparency Project has said he has “received more complaints about MMSD than any other government agency.” It is time for the district’s casual contempt for the public’s right to know to come to a screeching halt.”

Tim LeMonds had good reason to fight the release of a complaint against him. Now he should tell his side of the story.

In a statement released Thursday by district officer of internal communication Ian Folger, the district says “the information shared publicly last week was difficult for all individuals mentioned in the documents, as well as for those who interact with them. It is abundantly clear that there are relational problems within the District’s communications department that need to be addressed.”

Folger said LeMonds remains a full-time district employee and that his role with the district has not changed. He said he could not comment on whether LeMonds is under further investigation by the district, but LeMonds said in a Thursday interview that as far as he knew, he is not.

LeMonds — who in the interview said he was speaking only on behalf of himself — said he has not been subject to any disciplinary action in the wake of the documents’ release and “categorically” denied that he called Stephanie Fryer, the spokesperson for the Madison Police Department, an “idiot,” as was alleged in the court documents.

Taxpayer funded Open Records Resistance at the Madison School District

The complaint against Madison Metropolitan School District spokesperson Tim LeMonds that he fought to keep private alleges he bullied and harassed numerous employees under his management as well as members of the local media.

Filed in October 2022 by three employees, one of whom has since left the district, the complaint includes a timeline of examples of poor behavior beginning in March 2021 through early October 2022. It also includes experiences shared by former employees who are not officially part of the complaint.

The district released the complaint in response to an open records request on Friday. On Thursday, a Dane County Circuit Court judge ruled against LeMonds’ lawsuit seeking to stop that release based on concerns about the potential reputational damage it could cause. LeMonds began working in MMSD in 2019.

The Madison Metropolitan School District can release an employee complaint filed against its spokesperson as part of a response to an open records request, a Dane County judge ruled Thursday.

Circuit Court Judge Rhonda Lanford ruled against MMSD’s executive director for communications, Tim LeMonds, who filed a lawsuit against MMSD on March 24 asking the court to stop the release of a few documents that are responsive to an open records request.

“I do not think that the plaintiff, Mr. LeMonds, has come close to showing that the public interest of protecting his reputation outweighs the public’s right to know,” Lanford said. “Especially in a case involving the public schools and how not just investigations are conducted, but how well how they are conducted and the results of that.”

Commentary on the taxpayer funded Madison school district’s non open records practices

Although you might never know it by last week’s meeting of the Madison School Board, school districts are very much included in the law that requires government — which belongs to and is paid for by the public after all — needs to be transparent in all that it does. There is no room for secrets unless specifically exempted under the law.

To me, the meeting to discuss the embarrassing failure of the Madison Metropolitan School District’s response to open records requests was an embarrassment itself. Administrators tried to explain why the district has become a laggard in fulfilling openness requests, often simply denying access or stonewalling for months to release records that “shall be honored as soon as practicable and without delay.”

They revealed that the job that long ago was designated as the records custodian, the person responsible for releasing requested public records, no longer exists. Instead, the district’s legal department has been taxed with the job and apparently is overwhelmed by other tasks.

That’s patently unacceptable, and I’m surprised School Board members didn’t demand an accounting. No governmental body can just ignore the law because it refuses to assign adequate staff to comply with it.

But one of the lawsuits was actually filed by the district’s own spokesman, Tim LeMonds. After the district determined it had to release a complaint against LeMonds by his staff, the tight-lipped LeMonds — whose job is supposed to be communicating with the public — sued his employer to stop disclosure.

You can’t make this stuff up — or justify it.

The public records request came from NBC15 reporter Elizabeth Wadas, who requested all emails from Dec. 19, 2021, through Dec. 19, 2022, that contained her name or references to an NBC15 reporter. The district released hundreds of records related to the request, but per open records law notified LeMonds that the complaint would be part of the release and allowed him time to challenge that.

He did so, with his attorney arguing that the October 2022 complaint and related documents are “technically” responsive to the request, but were “not, themselves, the subject of the request.” The filing further argued that releasing the documents “would almost certainly cause irreparable harm to him, his reputation, the public’s perception of him, his standing in the community, and within MMSD itself.”

The briefing also states that an investigation of the complaint by the district’s legal and human resources department found that the accusations were “without merit.”

A meeting in which the Madison School Board was to discuss its open records policy was effectively held behind closed doors Monday after a problem with its livestream kept the public from being able to see it.

The meeting was scheduled for 5 p.m. Monday and was legally noticed as a virtual meeting, with only school board members attending in person. But when officials couldn’t get the public’s livestream for the meeting to start, they decided to proceed with the meeting anyway and post a recording of it later.

Taxpayer Supported Madison School District PR Employee Sues to Stop Open Records Disclosure

The Madison Metropolitan School District is being sued by one of its own. MMSD Head of Communications Tim LeMonds does not want two documents from an NBC15 Investigates’ open records request released – and he is taking his bosses to court to stop it.

On Friday, LeMonds filed a preliminary injunction motion against MMSD, urging a Dane County judge to conduct an expedited review of the documents in question, two emails he does not want the public to see.

LeMonds’ lawyers argue that what is in those emails would likely be bad for his repution. Their release would lead to “unwarranted, unfair and irreversible public ridicule and gossip, negative public perception, and jeopardize his ability to credibly perform his duties (with MMSD).”

LeMonds declined to comment on the matter when reached by the Wisconsin State Journal.

Releasing the complaint that staff filed would harm LeMonds and the school district because he is the district’s spokesperson, LeMonds’ complaint says, arguing that the potential harm outweighs the public benefit of the document’s release.

“Releasing the subject documents would almost certainly subject Mr. LeMonds to unwarranted, unfair and irreversible public ridicule and gossip, negative public perception, and jeopardize his ability to credibly perform his duties as (the district’s) chief public spokesperson — especially since all of the accusations in the complaint were found to be without merit by (the district),” the court complaint states.

After receiving a wave of conservative backlash, a student-organized drag show at Madison East High School has been postponed because of safety concerns.

In addition to an “abundance” of supportive messages regarding the event, the Madison School District also has received “several messages that have raised a number of safety concerns for this student-led event,” according to district spokesperson Tim LeMonds.

“Without question, the safety of all our students, staff and families must be our top priority,” LeMonds said. “Therefore, due to these recent safety concerns, we have decided to postpone this event to a later date.”

“We know how disappointing this news will be for many of our students. However, we feel this decision was necessary to provide time to refine our safety plan around this very important celebration,” he said.

“We need impactful change in our handbook before May 15 or the mass exodus of staff will continue,” she said. “It’ll become impossible to staff our schools with qualified teachers and the staff that our students deserve.”

MMSD spokesperson Tim LeMonds wrote in a statement Tuesday that the district “has hired more teacher staff this year than ever before, and now employs its largest teacher workforce in many years.”

“We value the voices of all MMSD staff. Our teachers who participated in public comment at last night’s Board meeting spoke from the heart, and their words were powerful,” LeMonds wrote. “The district’s recruitment strategy continues to make progress in addressing the nationwide teacher shortage impacting our school district.”

He said the 100 vacancies “only represent approximately 3.8% of our roughly 2,600 teaching positions and 1.7% of our overall staff.”

LeMonds also alluded to the ongoing financial challenges school districts face, calling the challenges ahead “serious” after a state budget that did not raise revenue limits for school districts each of the past two years.

Madison Schools Safety Survey

A survey that will help guide safety and student wellness work in the Madison Metropolitan School District is open for staff, parents and students until 11:59 p.m. Monday.

The Madison School Board’s Safety and Student Wellness Ad Hoc Committee met Thursday for the 16th time to discuss progress on the subject. The group was formed in the spring in response to a series of safety concerns last school year.

So far, the three-question survey has received about 6,500 responses, committee co-chair and Memorial High School senior Lavenia Vulpal said. District spokesperson Tim LeMonds called it a “very, very good response” level.

“Please encourage people you know to get online and fill it out,” Vulpal told committee members. “We are still looking for ways to reach students, staff and parents.”

Did she pick up that point of view in her training? Is it supported by the MMSD administration? is it engrained in the culture of her school? Wherever it originated from it’s a huge problem and my worries about MMSD, eased by the idea that districts we compete with don’t have stand-alone honors classes, were redoubled by that point of view. 

Two other points are worth noting. First, 45% of honors class students are non-white. The fundamental reason for eliminating the classes is that they’re not diverse enough, but when almost half the students aren’t white that strikes me as pretty diverse. 

Second, that figure is a couple of years old and it doesn’t include more detailed breakdowns. The State Journal requested more recent data, but District spokesperson Tim LeMonds said the paper would have to file an open records request to get the data. This continues a pattern of lack of transparency that I’ve noted in this space more than a couple of times in the past. Why not just hand over the public’s information to the public, especially given the fact that you will eventually have to comply with the FOIA request anyway?

pandemic-delayed change to Madison middle school start times is now hurting some families’ bank accounts.

With those later start times, which began being implemented in fall 2019, the district planned to shift all middle schools from Madison Metro to yellow buses. But with an ongoing driver shortage for Badger Bus, the switch was put on hold before the final year of implementation.

That left only east siders to work with Metro this school year.

“That’s been delayed understandably because of driver shortages, that’s understandable and that is the situation we’re in,” Sennett Middle School parent Marilee Cronin said. “But the fact of the matter is that the west side families no longer need to rely on Metro.”

West side students didn’t need to worry about bus passes. Yet the rollout of bus passes to ensure east side families didn’t have to spend money was inconsistent, according to parents, with schools clearly not on the same page about the district offering free bus passes.

District spokesperson Tim LeMonds said the district offered free passes for all students who met the criteria for bus transportation: living more than 1.5 miles from their school.




‘No action’ on fired taxpayer supported Madison Sennett principal’s appeal yet

The Madison School Board’s closed session meeting to discuss the appeal of fired principal Jeffrey Copeland Tuesday lasted just over 15 minutes without a decision.

“I can’t explain that,” board member Nicki Vander Meulen said, leaving around 5:16 p.m. and declining further comment. Other board members who left shortly after also declined to comment and said they could not share what happened.

District spokesperson Tim LeMonds wrote in a statement sent half an hour later that “no action was taken” during the meeting.

“The Board will be scheduling final action in the upcoming days,” LeMonds wrote. “This change was made to address a technical issue with the public notice in fairness to all parties involved.”

A group of about 10 Sennett staff stood outside the door at the beginning of the meeting, but most left about 10 minutes in as the board met behind the closed door, with one remaining to deliver the news to the others at the end of the meeting.

Because the meeting was held in closed session, as allowed under state law when a public body considers someone’s employment, board members are mostly barred from sharing information on what happened during the meeting.

Two board members — board president Ali Muldrow and vice president Maia Pearson — remained in the room with a small group of district leaders after the meeting, including general legal counsel Sherry Terrell-Webb and senior executive director of staff Richard McGregory. As a reporter stood outside the open door, another staff member closed it as the group continued to meet.

The School Board was set to have the final say on whether Copeland would be reinstated after he was fired Sept. 26 for comments he accidentally left on a teaching applicant’s voicemail on Sept. 6 that the district has deemed bigoted.

The candidate, with whom Copeland had spoken on the phone, speaks English as a second language and holds a doctorate from a university in the Dominican Republic.

Thinking the phone call was over and unaware his comments were being recorded, Copeland remarked to Assistant Principal Matt Inda that he could barely understand the applicant on the phone, and then made comments about “just giving people damn jobs.”

In an email to the Wisconsin State Journal this week, Copeland said he was expressing concern about teacher qualifications amid widespread school staffing shortages and not specifically referencing the candidate.

MMSD had its strongest ratings in the growth and on-track to graduation priority areas, though both were down slightly from last year’s scores. In growth, the district received a 73.6 out of 100, while it scored 77 out of 100 for on-track to graduation.

In the other two priority areas, MMSD scored a 57 on achievement and 58 on target group outcomes. Both, again, were a slight drop from the previous report card.

MMSD spokesperson Tim LeMonds wrote in an email that the district did not plan to make a statement on the report cards.

Overall scores for schools and districts can fall into five rating categories: significantly exceeds expectations (83-100), exceeds expectations (70-82.9), meets expectations (58-69.9), meets few expectations (48-57.9) and fails to meet expectations (0-47.9).

Earlier this year, Republicans passed a bill to require DPI to return its report card scoring formula to the one used in 2018-19 and force the department to use the public rules process to adjust the formula rather than make any changes itself. It would have restricted DPI from giving greater weight to measures of growth in student achievement than measures of actual achievement in determining a district’s or school’s overall score on the report cards.

Gov. Tony Evers vetoed the bill.

On a call with reporters Tuesday, DPI accountability office staff explained that the changes to the formula that went into effect last year helped soften sometimes large fluctuations in small student groups that “weren’t true school or district changes.”

Office of Educational Accountability assistant director Sam Bohrod said the work began prior to the pandemic and they believe it’s a “more useful tool” for districts and schools to identify where they are in helping their lowest performing students.

Rory Linane:

They reiterated their plan for recovery, including more funding for special education, mental health and general school costs.

“We know that obviously the stressors of the past few years have exacerbated a lot of problems but we also know that mental health for children in Wisconsin, and far beyond Wisconsin, has really been at a significant problem level for far too long,” said Abigail Swetz, communications director for DPI.

DPI provided report card scores for 1,920 public schools and 163 private schools — a minority fraction of the state’s private schools. Private schools are given report cards only if they receive tax-funded vouchers and have a large enough student population.

“This is a very undesirable job. A lot of people try to make it seem like it’s not that difficult until you have to wrap a garbage bag around your hand and fish some kid’s defecation out of a toilet or out of a urinal,” he said.

He described other unpleasant tasks, like scraping tampons off bathroom ceilings, mopping up food after a rowdy lunch hour or unclogging a toilet after a student has shoved an entire roll of toilet paper down the drain.

“Our health is constantly at risk,” he said, adding that was especially true during the height of the pandemic. “You have no idea how afraid we all were.”

District spokesperson Tim LeMonds said that the support staff who received the $5 bump — educational assistants, school security assistants, clerical staff and food service workers — were the district’s lowest-paid groups.

Madison West high school fight: 25 students and a strong-arm robbery in which police recovered marijuana, fake IDs, fake currency and a spent shell casing.

Officers searching the vehicle the suspects arrived in found the marijuana and other items, the blog said. Lisko said that while no charges have been filed, a detective has been assigned to the matter.

Principal Dan Kigeya said in an email home to parents Thursday afternoon that “staff responded to the incident quickly, and due to the large number of students involved, requested support from the City of Madison Police Department.”

He also said some students reported that a weapon might have been involved in the incident, but a search of the area with a police dog didn’t turn up one. Lisko confirmed no weapons were found.

District spokesperson Tim LeMonds said later Thursday that seven students had been involved in the fight. He had not responded to a request to clarify whether the district was aware of other details in the incident and whether all of the people involved are district students.

The Madison School Board voted 6-1 in June to adopt the district’s $561.3 million preliminary budget for next school year, which included the 3% base wage increase.

Negotiations began in May with MTI requesting the 4.7% increase — the annual inflationary amount and the maximum allowed in bargaining under state law. The district offered a 2% increase — not including additional wage increases tied to experience and educational attainment, known as steps and lanes.

In the budget adopted by the district in June, that base wage increase offered by the district had grown to 3% for all staff through bargaining, along with a 2% increase specifically tied to experience and educational attainment for teachers.

Scott Girard:

The salary schedule change must occur through the Employee Handbook revision process, which is technically a unilateral decision by the School Board. The district and MTI have a committee to “meet and confer” on potential Handbook changes, but it is not considered a bargaining session, and therefore allowed under Act 10.

“Since Act 10, MMSD has voluntarily participated in meet-and-confer collaboration with MTI,” Oppenheimer wrote. “Only in the last few years has MMSD begun to circumvent the meet-and-confer process for resolving issues outside the scope of legal bargaining.”

LeMonds said in a phone interview Wednesday afternoon that the district believed it needs to finalize the base wage increase to avoid “bargaining” on the Employee Handbook change as the two wage changes become conflated.

“​​We can’t do those simultaneously because it gets pulled into the negotiation,” LeMonds said. “The negotiated piece, which is base wage, has to be finalized before we can move on to that.”

District general legal counsel Sherry Terrell-Webb told board members that Wednesday’s vote “officially closes out negotiations on base wage,” and suggested that the administration could now prepare a recommendation for the board on the salary schedules.

“I know some believe that we should have continued negotiating with MTI,” Terrell-Webb said. “However, because the board has indicated that 3% was its best and final offer, to continue to negotiate knowing that we would not be able to make a change to this offer could be considered negotiating in bad faith.”

The board also approved the “steps and lanes” increases at Wednesday’s meeting, which reward staff for longevity and educational attainment. That amounts to a 2% increase for the average employee, the district says, but MTI has pointed out that it means zero increase for some.

In recent years, the district has either agreed to the maximum increase early or waited until closer to the final budget approval to get board approval for the change.

In 2019, the district included an increase up to 1.5% in its preliminary budget in June but continued negotiating with MTI. In a September vote ahead of the final budget approval in October, the board increased it to the maximum 2.44%.

In 2020 and 2021, the final base wage increase offer vote took place in October and September, respectively. In three prior years — 2016, 2017 and 2018 — base wage approval came earlier, but it was at the maximum allowed percentage under law.

While there is a large influx of federal COVID-19 relief funding, officials have expressed hesitancy at using that one-time money for ongoing operational costs like salaries.

“You’re going to hear no argument from us that our teachers and our staff deserve better,” LeMonds said at one of MTI’s rallies in May. “The fiscal reality is, we are looking at a very regressive state budget and it has put us in a position where — I know our superintendent has mentioned this on several occasions — we’re needing to choose between what is right and what is right.”

Many other districts in the state, however, have already agreed to the 4.7% number, including the other four districts that along with MMSD make up the “big five” largest districts.

MTI has also asked for a $5 an hour increase in the salary schedule for special education assistants and school security assistants, who are hourly employees. That salary schedule is part of the Employee Handbook, which has changes approved by the School Board.

It cannot, however, be directly negotiated between MTI and MMSD under Act 10, which limited the collective bargaining rights of public sector unions.

Officials indicated during a discussion earlier this month, however, that they were looking to find some increase, with the full $5 an hour increase estimated to cost about $3.3 million.

Notes on a recent School brawl at Madison East High School

In the video taken Monday at East and later removed from Facebook, a student verbally confronts another student in a classroom before physically attacking the student, and eventually tackling the student onto a table, which subsequently buckles. Another person is seen in the video attempting to separate the two students, but it’s unclear whether the person who intervened is a student or staff member.

The Wisconsin State Journal viewed the video but did not obtain permission to post it. District spokesperson Tim LeMonds confirmed the altercation and said a teacher was present and on the phone calling for support per district protocol as the incident unfolded.

The formation of a student safety and wellness ad hoc committee meant to address ongoing concerns in buildings across the district was first discussed after a melee outside of East in November drew significant police response and sent students exposed to pepper spray to the hospital.




Eliminating Latin at Madison West high school amidst enrollment declines and taxpayer supported district budget growth

MMSD spokesman Tim LeMonds wrote in an email that the 6.1 FTE cut is a combination of two years of enrollment losses. Last year, enrollment decreased such that West lost three positions, LeMonds wrote, but the school was “allowed to retain those positions due to COVID.”

Madison school district hits ‘pause’ on plan to end standalone honors classes

The Madison school district is delaying its plan to eliminate standalone honors classes at its high schools.

The district hasn’t publicly announced the policy shift or if it’s considering scrapping the plan entirely. At its Dec. 6 meeting, school board members were told by Director of Advanced Learning Sharon Alexander that the district was on track to end standalone honors classes for 9th graders starting in the 2022 fall semester and 10th graders in 2023. Isthmus learned the plan was being delayed from a high school teacher in January. It took district spokesperson Tim LeMonds three weeks to confirm what administrators had already told teachers. 

“Standalone and earned honors will still be available for 9th and 10th graders next year,” wrote LeMonds in a Feb. 8 email to Isthmus. “We have put a pause on the removal of standalone honors to allow for more time to review this strategy, obtain student and community input, and board involvement.” 

District administrators informed the Madison school board at an April 5, 2021, board meeting they were planning to phase out traditional honors classes for 9th and 10th graders. These courses are for core subject areas like biology, English, and history. There are no exams or other requirements to get into these classes and any student is allowed to enroll. Instead of standalone honors courses, the district was going to focus exclusively on the “Earned Honors” program. Begun in 2017, this program allows students to receive honors designation in non-honors classes if they complete “predetermined criteria.” 

Administrators at the April 5 meeting enthusiastically endorsed eliminating standalone honors classes. 

“This is an anti-racist strategy. Earned honors supports our commitment to truly becoming an anti-racist institution. It allows us to set a bar of excellence for all of our students, for 100 percent of our students,” said Kaylee Jackson, executive director for curriculum. “[Standalone honors classes] are an exclusionary practice in which only some students within our high schools are receiving this rigorous instruction and capable of receiving honors credit.”

According to the latest data from the district, 41 percent of students in standalone honors classes are students of color. White students represent 43 percent of the total student population in the district, but make up 59 percent of standalone honors classes. 

Most school board members expressed support at the meeting for eliminating standalone honors, although no vote was taken to either move forward or reject the idea. Board member Ananda Mirilli said she was “100 percent behind” the plan, a sentiment echoed by board member Savion Castro.

Under a plan proposed by administrators last year, beginning with the 2022-23 school year, ninth-graders would only be able to earn honors credit through the district’s “earned honors” program, which places all students in the same classes but allows those who want to earn honors credit to do so if they meet a set of criteria showing mastery of the content. The same would apply to 10th-graders beginning in the 2023-24 school year.

The shift away from stand-alone honors classes was pitched by administrators as a way to boost racial equity, as students of color historically have been less likely to take honors-only classes, although they are open to all students. Those racial disparities have been closing in recent years.

Notes on Madison area K – 12 taxpayer supported school attendance



Scott Girard:

MMSD spokesman Tim LeMonds told the Cap Times in an email Tuesday the district’s attendance rate Monday was 80.6%. That’s below the average of more than 90% throughout the 2020-21 school year, according to attendance data received through an open records request.

Other area school districts, which all returned from winter break as scheduled in the first week of January, reported slightly higher attendance rates during the first week of 2022.

In the Verona Area School District, attendance ranged from 85.37% to 89.58%, according to data provided by superintendent Tremayne Clardy.

Waunakee Community School District’s attendance rate was between 87.86% and 89.81% throughout last week, district communications and engagement specialist Anne Blackburn wrote in an email.

Similarly, the Oregon School District saw attendance rates from 82.2% to 87.5% last week, according to an email from district communications director Erika Mundinger.

The Middleton-Cross Plains Area School District saw attendance rates stay between 88.5% and 90.2% the week of Jan. 3, director of information and public relations Shannon Valladolid wrote in an email.

The new priority area, target group outcomes, replaced closing achievement gaps. The new priority area, DPI said, sheds additional light on students in schools with low test scores. The measure was designed to help focus support on the learners who need it most, while also improving outcomes for all students, according to DPI.

“I think in the long run this is going to be a positive for students in Wisconsin because I think it is going to guide school improvement efforts more constructively than the old measure,” Schell, who sat on the advisory committee that DPI convened to develop this year’s updated report cards, said of the change.

Scores are based on a 100-point scale and weighted for certain situations, such as a larger focus on academic growth in schools with high poverty rates. Scoring within a certain point range determines what star rating a school receives.

Madison data

For the 2020-21 school year, Madison received an overall score of 70.2 points on a 100-point scale — just over the 70 points needed to attain a four-star rating. The score was down from the 72.3 points the district received in 2018-19.

Up to three years of data are used in assessment-based measures of report cards, according to DPI. Because assessments were not administered in the 2019-20 school year, the 2020-21 report card uses results from the 2020-21, 2018-19 and 2017-18 school years with more weight given to more recent years.

This year’s star rating is as follows:

  • A score of 83 to 100 is a rating of five stars or significantly exceeds expectations.
  • A score of 70 to 82.9 is a rating of four stars or exceeds expectations.
  • A score of 58 to 69.9 is a rating of three stars or meets expectations.
  • A score of 48 to 57.9 is a rating of two stars or meets few expectations.
  • A score of 0 to 47.9 is a rating of one star or fails to meet expectations.

Spokesperson Tim LeMonds said the district received the data from DPI Tuesday and had not had an opportunity to thoroughly review the information as of Tuesday afternoon.

Of the 44 Madison schools evaluated under the report card system, six were categorized as having significantly exceeded expectations in 2020-21, receiving a five-star rating. That number was down from nine in the 2019-20 school year.

The Department of Public Instruction has changed tests a number of times over the years.

Scott Girard:

Officials urged caution in interpreting the results given the continuing pandemic. Effects included a sharp increase in the number of students who opted out of state testing, including 50.3% of eligible students on the math and English language arts (ELA) tests in MMSD.

Because no state tests were given in 2019-20, the report cards use 2017-18, 2018-19 and 2020-21.




‘It takes a village’: East High parents organize to support students daily over lunch hour, dismissal

— Parents of students attending Madison East High School have organized over the past week to provide a visible support system for students in the wake of massive fights Monday and higher-than-normal behavioral incidents throughout the school year.

It started with a Facebook post from Antoinette Kendricks following multiple fights Monday that resulted in two students being cited and five in the hospital to be treated for pepper spray, after more than a dozen Madison police officers used pepper spray to break up the fights.

She called on parents to step up and help organize for the students: enough was enough.

“My motto is it takes a village,” she told News 3 Now on Friday. “But also, the truth of the matter is: can’t no one control our kids the way we control our kids.”

Every day since Monday, parents have responded. With the help of her friend Noelle Brusky, who’d been talking with school officials about ways parents could help, they’ve used a private Facebook group of East High parents to help organize.

Now, they’re coordinating daily to ensure a dozen or so parents can be visible and present on school grounds over the lunch hour and when classes dismiss for the day. MMSD’s spokesperson Tim LeMonds estimates about 90% of behavioral incidents this year have been happening over the open lunch hour when students are able to leave the campus.

One-third of students stay home following Monday fights at Madison East High School

More than 600 students did not show up for classes on Tuesday, the district said, more than one-third of the total 1,717 students enrolled at East. As of noon, 277 were excused and 325 had not shown up and were not excused, though secretaries were still updating records at that time.

During Monday’s lunch hour, more than 15 police responded to break up a set of fights that broke out near school grounds. Eight students were pepper-sprayed as police tried to break up the fights.

District spokesperson Tim LeMonds told News 3 Now that an estimated 90% of behavioral issues at the high school have happened during the school’s open lunch period when students can leave campus. Just over two weeks ago, fights involving more than 100 students and parents broke out in a crowd around lunchtime.

The Madison School Board’s decision to remove school resource officers, or SROs, from the high schools came amid the racial reckoning following the murder by Minneapolis police of George Floyd, sometimes-destructive social justice protests in Downtown Madison, and a years-long campaign to get rid of SROs that included shouting down School Board meetings and demonstrating outside the School Board president’s home by the local group Freedom Inc. and its allies.

Madison School discipline plan omits police, rewards analysis paralysis

The influential Ann of Althouse, retired UW Law school professor and bloggueresse, asks “Why don’t schools call the police when crimes are committed in school?”

The short answer is that Madison WI schools a year ago enlisted in the War on Police.With the connivance of Madison’s woke city government, the school board evicted school resource police officers. Let Ann tell it:

There’s an interview with Tim LeMonds, MMSD Director of Communications. If I understand him correctly …  the school’s policy is not to call the police unless a weapon is involved or police are needed to stop the fight. The message I hear is that there’s a plan never to call the police if attacks are quick and done with bare hands. The video shows a defenseless child getting pummeled at his desk. As LeMonds put it:

“When the attack took place, the teacher reached out for assistance and by the time staff were able to respond the incident was over.” 

Althouse asks: “How is that a reason not to call the police?!” 

The Werkes answers: Student discipline has been sucked into a bureaucratic black hole. Woe to the educator who does call police! We reproduce the critical response incident flowchart. It is contained within the school district’s 111-page MMSD safety plan. One Hundred and Eleven pages! At the very least, one hopes that each and every one of 4,985 school district employees (including the hot lunch ladies) are given a laminated copy like the kind the football coaches carry on the sidelines. Sort of a Chinese restaurant menu.

UPDATE: A reader points out, correctly, that MMSD policies & actions are in clear violation of Wisconsin State Statute 48.981, which mandates the reporting of any assault on a child under the age of 18 to a law enforcement agency or county social services.

With no cops, student fighting roils Madison’s high schools

Now WMTV-15 is showing student-captured smart phone video of fights, including a one-sided assault at Madison East high school.

The latter shows a Madison East sophomore attacked by two other students who ran into his classroom as he sat in the front row. It appears they were not fellow classmates but entered the classroom to pummel him.

The mother told TV-15: “The teachers are hands off and I’m pretty sure they are told to be hands off.” The mother has pulled her son out of school. She filed a police report, not the school district.

The incidents are not isolated, as East high Principal Sean Leavy admits in a message to parents:

Since the start of in-person learning this school year, our administrative team and deans of students have responded to multiple alterations during lunch hour that have taken place on and off school grounds, with some of these altercations becoming physical.

In a second WMTV-15 report, spokesman Tim LeMonds (he has a tough job) did his best to defend the school district’s police-free safety plan: “The big difference is SROs … Our buildings are safe … will things happen? We hope not but yes, there will be incidents.”




Madison Mom worried for son’s safety after school fight at East High School

The mother says she doesn’t understand how a fight can happen in a classroom. Video of that fight and others showing highlights of several recent fights at Madison schools are circulating among students.

The videos also raise questions about district policy, and student safety, now that school resource officers are no longer in Madison schools. The mom says to her knowledge, the students responsible have not been punished at this time. Since the fight, the mother has pulled her son out of school indefinitely in fear of his safety. She says she filed a police report and is disappointed the district did not take the matter more seriously.

NBC15 reached out to district officials who say they stand by how the incident was handled. A spokesperson for the district said the attack is unacceptable and says it wasn’t stopped because it happened so quickly.

“When the attack took place, the teacher reached out for assistance and by the time staff were able to respond the incident was over,” said Tim LeMonds, MMSD Director of Communications.

The Madison school district has repeatedly refused to release a report detailing its own investigation into whether district policies were followed during a field trip to Minneapolis in December 2019, when hidden cameras were found in the hotel bathrooms of students. Those events would lead a month later to the arrest of East High educator and trip chaperone David Kruchten. But the district, without explanation, recently released the full report of its internal investigation to Isthmus as part of an open records request related to another hidden camera incident at East

In spring 2020, the district paid private attorney Malina Piontek roughly $8,000 to conduct the independent administrative review of how the district responded to events during the field trip to Minnesota. Isthmus reported in March 2021 that the district cited “attorney-client privilege” in keeping the full report secret — a move that angered parents and open government advocates. Even school board members weren’t allowed to read it. Only a two-page summary was released publicly, finding “no failure on the part of district staff” to follow district policy. It also determined that statutory requirements for mandatory reporting of child abuse were met. 

Unlike the summary of the internal investigation, the full report states that mandatory reporting requirements on child abuse didn’t need to be met: “Based on the present facts, there was no sexual abuse or exploitation warranting” district employees to follow mandatory reporting laws, it says. The full report also notes that “due to the trauma experienced by the EHS students, a determination was made not to interview students for this review.” 

Isthmus asked the district why it released the full report now after months of refusing requests from parents, the media, and school board members. We also asked who made the decision not to interview affected students or their parents and whether district officials agreed with Piontek’s claim that mandatory reporting laws didn’t need to be followed because hidden cameras found in the hotel bathrooms of students doesn’t fit the legal definition of child abuse. 

District spokesperson Tim LeMonds has refused to answer these questions and has uncharacteristically not responded to several requests for comment.

East was largely shut down to in-person learning during Kearney’s tenure as principal. Madison high schools were the last in Dane County to welcome back students amid the COVID-19 pandemic when they began reopening to two half-days per student in late April.

Kearney dealt with most of the fallout from two high-profile incidents involving school staff. Business teacher David Kruchten resigned in February 2020 after he was indicted for placing hidden cameras in students’ hotel rooms during class trips. He is expected to plead guilty to a federal charge of attempting to produce child pornography.

Upon further investigation, it was discovered there was evidence a camera may have been installed in the smoke detector with the approval of district staff in September 2019 in an effort to document “an employee discipline issue related to work rule violations,” according to a statement released by the district.

The district hired a third-party investigator, MWH Law Group LLP, upon conclusion of the Madison Police Department investigation into the incident in February. Madison Police determined no crime had been committed. LeMonds said the district will not be releasing the full third-party investigative report, citing attorney-client privilege.

Madison School district violates own policy with hidden surveillance cameras

In September 2019, top brass at the Madison school district violated district policy by installing hidden cameras — concealed in hollowed-out smoke detectors — in a coach’s office in the boys’ locker room and a room where special needs students undress and have their diapers changed. The concealed surveillance operation at East High School was done without informing school staff in the hopes of catching a custodian, who worked nights, sleeping on the job. 

Isthmus has also learned, through multiple anonymous sources, that “large amounts of money” were planted in the room with the hidden cameras as part of the investigation. District spokesperson Tim LeMonds wouldn’t say if the custodian under investigation was ever disciplined, writing in an email to Isthmus, “we can not comment on personnel issues.” 

“I have not seen any mention of ‘large amounts of money’ being left around as a part of the investigation in any of the information I have seen,” LeMonds wrote in a follow-up email to Isthmus. “That said, the internal investigation is still underway and if anything surfaces related to money being left, it will be included in the final report.” 

According to a Feb. 23 email sent to parents by Superintendent Carlton Jenkins, these areas were selected because they “contained furniture conducive to sleeping.” Jenkins added the cameras are a “direct violation of district policy.” Even so, the district’s building services staff and Director of Labor Relations Heidi Tepp, an attorney, approved and executed a covert plan to install the cameras without the knowledge of East staff or then-superintendent Jane Belmore.

The hidden cameras found at Madison East High School were in a room where students with disabilities changed and in a coaches’ office in the boy’s locker room, a police report shows. 

Madison School District Superintendent Carlton Jenkins told parents in an email Tuesday night that the cameras, which were hidden inside smoke detectors, were installed in violation of district policy in an attempt to catch a custodian suspected of sleeping on the job.

An “equity-based decision” was made Wednesday night to cancel online learning and the limited in-person activities at school, such as child care programs in elementary schools, for the next day, said district spokesperson Tim LeMonds.

“(The district) is working hard to strike a balance between ensuring continuity of learning for our students while making sure our student participants in MSCR Cares or in-person special education programming do not fall further behind via not being able to transition to virtual platforms on short notice,” he said.

Staff have not verified the approximately 17,000 tests, which includes steps such as matching test results to patients to avoid duplicating numbers and verifying the person who was tested resides in Dane County.

Evidence of hidden recording device found in East High School coach’s office, Madison district officials say

A member of the high school security staff discovered what appeared to be a smoke detector cover that was altered to house a recording device located in the coach’s office on Jan. 8. The staff member contacted the school principal, who then contacted district officials and law enforcement.

Upon further investigation, it was discovered there was evidence a camera may have been installed in the smoke detector with the approval of district staff in September 2019 in an effort to document “an employee discipline issue related to work rule violations,” according to the statement.

This use of surveillance equipment is a direct violation of district policy, Jenkins said in the statement.

“I am outraged a policy of this nature would be violated,” he said. The district has launched an investigation into the matter through a local law firm.

The request for the camera installation took place under interim Superintendent Jane Belmore, but she did not approve or know of the request, district spokesperson Tim LeMonds said.

It does not appear at this point in the investigation to be related to cases involving former East High School business and marketing teacher David M. Kruchten, who is charged with transporting seven minors to Minnesota with the intention of creating child pornography and attempting to create child pornography by using hidden cameras in 2019. Members of East High’s DECA business club found the hidden cameras in their hotel rooms.




MTI head says district ‘interfered with the union’ in wage negotiation, files complaint

Madison Teachers Inc. filed its second grievance against the Madison Metropolitan School District this year on Wednesday.

The complaint filed with the Wisconsin Employment Relations Commission (WERC) comes after the district sent out a Nov. 30 communication stating “the MMSD Board of Education, MTI and the trades have ratified the agreement to increase base wages by 0.50%.” MTI executive director Ed Sadlowski said MTI and the trades group did not ratify the base wage increase at that level and called the communication “union-busting.”

“They falsely stated and interfered with the union that MTI had ratified the agreement,” Sadlowski said in an interview.

District spokesperson Tim LeMonds did not respond to requests for comment on Wednesday or Thursday.

Despite the complaint, the union’s leadership is still hopeful district officials and School Board members will reconsider a budget decision from earlier this fall and give staff a full cost-of-living base wage increase of 1.81%. As approved, the budget authorizes district staff to negotiate up to just 0.5%, less than the state-mandated maximum of a 1.81% base wage increase.

The board fully funded longevity increases — known as “steps and lanes” — but MTI said that wouldn’t apply to every staff member, while base wage would increase everyone’s pay.

Commentary on Taxpayer supported Madison Schools’ compensation practices (and budget)

The budget vote this summer took place in a June 29 public meeting, and district spokesman Tim LeMonds pointed to a mention in the June 26 staff newsletter, which he called “the primary mechanism used for communicating to all staff.” In that newsletter, a “Budget Update” section on page two includes a mention of the pay freeze in its fourth paragraph among other details of the preliminary budget timeline.

“This effectively pauses our previously planned compensation increases and a few Strategic Equity Projects, not previously approved,” the newsletter states. “Although it is our hope that our budgetary landscape improves by late fall, we also need to be prepared for State budget reductions that may be coming in the upcoming months.”

Another teacher wrote in an email she did not know “anyone who was aware of the pay freeze until we got an email with a preview of our checks and we all realized our salaries were not updated.”

At the time of the preliminary budget approval, district chief financial officer Kelly Ruppel was projecting a loss of $7.6 million in state aid from what had been anticipated in earlier projections. Removing the salary increases saved $7.8 million.

Sadlowski wrote in an email the union is seeking “clarification on whose authority the unilateral change” was implemented. He added that they hope for “a swift resolution that adheres to the agreed upon terms” and that resolving it now would “help to avoid further acrimony than this adverse action has already created.”

MMSD tells some staff to accept in-person child care reassignment or resign

He added that MTI “recognizes the need” for supporting families through child care, but believes safety remains the top priority. MTI has also asked the district to seek volunteers, including within the teaching workforce, to staff in-person services and is encouraging all staff to get a COVID-19 test prior to working with students and families.

LeMonds wrote that the district had put together a “thoughtful health and safety plan” and said the summer child care model was “very successful.” Safety guidelines include masks, social distancing when possible, a symptom check before starting the program, staying home with a positive test or symptoms and working with public health to determine who should quarantine if there is a positive case within a building.

The classes are expected to be limited to 15 students per room and located at many elementary schools around the district.

When the district announced it was going virtual, Dean was initially relieved, he wrote, as he remains concerned about COVID-19. But if he had to work in-person he would “be extremely hurt if I caused harm to a kid or adult by spreading something I can’t tell is in my system.”

“We know best”: Madison School Board approves superintendent contract before it becomes public

The Madison School Board approved a contract Monday to hire a Minnesota school administrator as the next superintendent before releasing details of the agreement to the public.

That’s a change from how the board handled the hiring process for its first choice for superintendent — who later backed out of the job — in February. This time, the contract with Carlton Jenkins, superintendent of Robbinsdale Area Schools in suburban Minneapolis, was not made public before the board unanimously approved the agreement during a special board meeting.

Jenkins, who is in his fifth year leading the Robbinsdale schools, will make $272,000 annually. The two-year contract will automatically renew for a third year unless the board chooses otherwise. Jenkins, 54, will be Madison’s first Black superintendent. He first day on the job will be Aug. 4.

District spokesman Tim LeMonds said in an email Jenkins is “not an official employee of the district until the contract is voted on,” adding Madison is “one of very few districts that publicly posts contracts.”

LeMonds also said the district is “not required to make a contract public until it is ratified by the board.” The contract was emailed to reporters soon after the vote.

A contract with Seguin, Texas, superintendent Matthew Gutierrez was publicly available before the board voted on Feb. 3 to approve that agreement.

The pay is more than what was agreed upon with Matthew Gutierrez, who was hired in an earlier search this year but rescinded his acceptance amid the COVID-19 pandemic. Gutierrez would have been paid $250,000.

Madison School Board Drops attempt at Changing Teacher Seniority Requirement for Layoffs

The Madison School Board will not discuss controversial changes proposed to the Employee Handbook Monday night as planned.

Board president Gloria Reyes announced in a press release sent by Madison Metropolitan School District spokesperson Tim LeMonds Monday afternoon that the item had been removed from the agenda and would be discussed at a special meeting at a later date.

“This change in the agenda is to provide additional direction and allow for more discussion and collaboration with stakeholders prior to any board discussion and subsequent action on employee handbook changes,” the statement reads.

The changes included a few items that Madison Teachers Inc. opposed. The union had been organizing its membership to speak Monday night before the meeting or send emails to board members opposing changes to layoff rules, specifically.

District administration had recommended the changes, which would shift the criteria for layoffs or shifting surplus staff among schools from seniority to a series of performance measurements like Educator Effectiveness evaluations, cultural competence and experience, among other things.

Kelley Meyerhofer:

The Madison School Board president hit pause on proposed employee handbook changes scheduled for a Monday evening vote that would have handed Madison School District more control in laying off staff and expediting the termination process.

The district’s teachers union had pushed back against the proposal and the way in which it came about, saying administrators were engaging in a “divide and conquer” strategy during a time of crisis that would destroy a decades-long working relationship with Madison Teachers Inc. and the thousands of employees it represents.

District administrators had proposed eliminating seniority as the sole criteria to lay off employees or move individuals to different schools. Instead, the chief of schools would have selected employees for layoffs in consultation with principals.

Officials also requested allowing for 30-day layoff notices instead of the annual May 15 layoff notices.

Interim Superintendent Jane Belmore said in materials made public last week that the changes would help the district diversify its workforce and provide more financial flexibility at a time when it is bracing for coronavirus-related budget cuts.




“The (taxpayer supported Madison School) district paid for $11,607.45 in legal fees as part of the settlement, but did not admit any wrongdoing.

An open records lawsuit filed anonymously against the Madison Metropolitan School District last fall was settled in May after the district released the records sought.

A “John Doe” filed the lawsuit against the district last November represented by attorney Tom Kamenick, the president and founder of the Wisconsin Transparency Project.

“My client and I are glad the District finally turned them over, but hope the District abides by its legal responsibilities promptly in the future,” Kamenick wrote in an email Friday.

The district paid for $11,607.45 in legal fees as part of the settlement, but did not admit any wrongdoing.

District spokesman Tim LeMonds wrote in an email last week the district would have no comment on the outcome.

The records sought mostly related to “weekly updates” from the superintendent to School Board members, with the anonymous requester seeking any and all records presented in such meetings. Doe had also filed requests for curriculum plans, school improvement plans and the annual seclusion and restraint report, among other topics.




Law review article highlights MMSD’s racial disparities in literacy

A recently published law review article has some strong words for the Madison Metropolitan School District’s literacy achievement gap and how that connects with Dane County’s disparate incarceration rates for black people.

“Where Dane County’s largest public school district has largely failed to produce literate Black fourth graders for more than a decade, it follows that the same racial disparity exists in the county’s correctional institutions,” University of Wisconsin Law School student Mckenna Kohlenberg wrote. “In 2011, a Black minor from Dane County was 25 times more likely than a White minor to be incarcerated.”

Statistics like that one aren’t news to those paying attention to racial disparities in recent years. But the “Booked but Can’t Read” article published in the NYU Review of Law & Social Change coins the term “illiteracy-to-incarceration,” a more nuanced version of the “school-to-prison pipeline” phrasing that has been discussed for decades.

Kohlenberg said in an interview she purposely wanted to create a direct connection to illiteracy, instead of the discipline focus that the “school-to-prison pipeline” often connotes.

“I wanted to call attention to how this process of funneling kids into the criminal system doesn’t always start with school discipline,” Kohlenberg said. “I wanted to make very clear that early on, as early as the fourth grade, lacking literacy plays a huge role in this pipeline.”

MMSD spokesman Tim LeMonds wrote in an email that the district had not had time to review the article thoroughly enough to comment.

Madison school crossing guards, who work under Madison police, are on paid leave per a directive from the mayor’s office, police spokesman Joel DeSpain said.

In Sun Prairie, district human resources director Chris Sadler said custodians are “on call” for building-related needs, but also help distribute deliveries still coming into the district.

He said about 200 of the district’s 1,300 employees “are really, really connected to schools,” meaning if the schools are empty, there’s less for them to do.

On March 31, Gutierrez sent a letter to Reyes letting her know he was rescinding his acceptance of the job and explaining what led to his decision.

Most board members didn’t find out until a week later during a closed session Monday night, LeMonds said. Gutierrez’s decision was publicly announced after the closed session.

Castro said it was “definitely jarring” to hear Gutierrez choose to remain superintendent in Seguin, Texas. But Castro added he understood where the lifelong Texan was coming from.

“I can’t imagine the conflicting emotions he was feeling when the community that he’s in now was in a crisis and really needed important, stable leadership,” Castro said.

In the letter, Gutierrez said his choice to back out of becoming superintendent of Wisconsin’s second-largest school district, which was “to be the pinnacle of my career,” was not without “interminable personal conflict and grief.”

But the experience leading the 7,500-student Seguin Independent School District through the pandemic has changed how he perceives his job, Gutierrez said in the letter.

“The sudden necessity of coordinating in a manner that not only educates but saves and sustains lives has changed my role as superintendent of a small school district from a title and a job to something far more personal; we have become an interdependent family,” Gutierrez wrote.

‘An honor and privilege to step up’: Community, school staff aid MMSD food distribution efforts

In the first nine days since schools closed for the COVID-19 pandemic, the Madison Metropolitan School District has given out 15,500 meals to students.

The Monday through Friday distribution of breakfast and lunch at 12 sites has been “running without a hitch,” MMSD spokesperson Tim LeMonds wrote in an email Thursday.

And it’s being helped by community efforts that are delivering some of the meals to families and others offering additional food to cover snacks, dinner and weekends.

A partnership between Thoreau Elementary School and Cherokee Middle School has delivered meals to 275 families — all of them from food collected through the Second Harvest and River food pantries. It will soon expand to serve between 400 and 500 families, all in the elementary schools that feed Cherokee plus West High School.

Cherokee social worker Abby Ray said the effort has “come a long way” from the first day of the closures, March 16, when they were just delivering to families they knew were in need. Schools are closed until at least April 24 by order of Gov. Tony Evers.

“A lot of it shows the relationships that families have with schools already,” Ray said. “The school is so much more than a place for kids to get learning and so many other needs are met through education in schools.”




Commentary on Virtual Learning & The Madison School District

In an email Friday, district spokesman Tim LeMonds said the district is now aiming to roll out virtual learning the first week of April, but it “takes time and thoughtful planning to prepare an all inclusive virtual learning program.” 

“The complexities being addressed include there being a large number of our families who do not have internet access or devices,” he said in an email. “Additionally, how to best meet our students with special needs concerns.”

The district also needs to make sure its approximately 2,700 teachers are trained, LeMonds said, and a “reliable infrastructure” needs to be in place to deliver online instruction.

There’s also a large number of students in the district who don’t speak English as their first language, speaking more than 110 other languages as their primary language, LeMonds said.

I recall discussions many years ago about creating a fast, wireless network at every school for neighborhood internet connectivity.

In addition, we discussed changing the District’s technology policy from top down to BYOD, that is bring your own device. I suggested to several Superintendents that teachers and staff receive a stipend to purchase and maintain an internet connected device (cellular iPad would be my choice) and begin to interact with everyone using this device. Further, Apple’s assistive efforts are substantial.

This occurred during Infinite Campus evaluation and implementation meetings. I wonder what the teacher/staff utilization data looks like today?

Infinite Campus – or similar – was for many years an expensive, missed opportunity.

As of now, the Madison School District isn’t moving to online schooling, but spokesman Tim LeMonds said the district is preparing for “distance learning alternatives as a requirement, if schools remain closed longer than what was initially expected.”

In the meantime, Madison is providing “enrichment” activities for students and directing parents to online resources to keep children academically engaged.

LeMonds said district staff are in daily communication with DPI and other large districts to address the “unique complexities” for a bigger school system to move online.

I recall discussions many years ago about creating a fast, wireless network at every school for neighborhood internet connectivity.

I received an email on February 18, 2020 from Barbara Osborn that my “request has been shared with our legal department”.

I received this response from Sherrice M Perry on March 13, 2020:

Dear Mr. James Zellmer,

Please accept this email as the Madison Metropolitan School District’s (the “District”) response to your public records request for “a list of invitees and participants in last week’s ‘community leader and stakeholder’ meetings with the candidates.” Attached below are the records that are most responsive to your request.

With regard to the requested records, the District redacted portions of the attached records consistent with the provisions of the Family Educational Rights and Privacy Act (FERPA; 34 CFR 99.3 et seq.) and Wis. Stat. § 118.125(1)(d). The requested records contain “personally identifiable information.” Pursuant to FERPA, “personally identifiable information” is defined as “information requested by a person who the educational agency or institution reasonably believes knows the identity of the student to whom the record relates” or “information that, alone or in combination, is linked or linkable to a specific student that would allow a reasonable person in the school community, who does not have personal knowledge of the relevant circumstances, to identify the student with reasonable certainty.” (34 CFR 99 3). According to these definitions, the District determined that the redacted documents contain information regarding very small populations (e.g. one or two students) from a distinct group or affiliation and thus, a “reasonable person in the school community” could identify the students who were referenced in the record. Nonetheless, by providing you the record with only limited redactions, the District is in full compliance with Wis. Stat. 19.36(6).

Please note: The denials, in the form of the redacted material referenced above, are subject to review in an action for mandamus under Wis. Stat. 19.37(1), or by application to the local district attorney or Attorney General. See Wis. Stat. 19.35(4)(b).

2005: When all third graders read at grade level or beyond by the end of the year, the achievement gap will be closed…and not before:

On November 7, Superintendent Art Rainwater made his annual report to the Board of Education on progress toward meeting the district’s student achievement goal in reading. As he did last fall, the superintendent made some interesting claims about the district’s success in closing the academic achievement gap “based on race”. 

According to Mr. Rainwater, the place to look for evidence of a closing achievement gap is the comparison of the percentage of African American third graders who score at the lowest level of performance on statewide tests and the percentage of other racial groups scoring at that level. He says that, after accounting for income differences, there is no gap associated with race at the lowest level of achievement in reading. He made the same claim last year, telling the Wisconsin State Journal on September 24, 2004, “for those kids for whom an ability to read would prevent them from being successful, we’ve reduced that percentage very substantially, and basically, for all practical purposes, closed the gap”. Last Monday, he stated that the gap between percentages scoring at the lowest level “is the original gap” that the board set out to close.

Unfortunately, that is not the achievement gap that the board aimed to close.

Madison Superintendent Jennifer Cheatham, 2015:

Shortly after the office was proposed, Cheatham said non-district-authorized charter schools have “no consistent record of improving education for children, but they do drain resources from public schools, without any control in our local community or school board.”

Rather than invest in what we know works in education, this proposal puts resources in strategies with mixed results at the expense of our public school students,” she said in May 2015

The Wisconsin Department of Public Instruction, lead by Governor Elect, Tony Evers, has waived Massachusetts’ style elementary teacher content knowledge requirements for thousands of teachers.

Madison School Officials Consider Controversial Student Newspaper Policies

Madison school officials will consider hiring an Ohio-based company known for policies that some say hinder the free speech rights of student journalists.

Two school board members and Interim Superintendent Jane Belmore met last month with representatives of Ohio-based NEOLA. NEOLA is a policy-writing firm often hired by school districts to write and implement policies for local boards and local administrators. 

NEOLA policies were scrutinized recently in Wisconsin during a controversial case in Oshkosh. In that case a student reporter was prevented from publishing a story about abrupt staff changes at Oshkosh North High School.

The Milwaukee Journal-Sentinel reported that Brock Doemel, a senior at Oshkosh North, eventually filed open records requests to learn more about an absent school staff member and to learn more about why the student-written story was removed from the school’s newspaper.

But policies written by NEOLA refer to student newspapers as “nonpublic forums” and therefore controlled by school district administrators. In the Oshkosh case, policies written by NEOLA were cited as reasons for denying open records requests, requiring student journalists to pay for public records, and asking student journalists to share their reporter’s notes, according the Milwaukee Journal Sentinel. 

“The rule is that in what should be an open forum, the students have the right to publish unfettered and then they deal with the backlash that comes or the kudos that come,” said Vince Filak, a journalism professor at the University of Wisconsin—Oshkosh who criticized NEOLA media policies.

Oshkosh students contacted the Student Press Law Center seeking advice in the case. Mike Hiestand, senior legal counsel at the center, called NEOLA a “policy mill.” He said NEOLA’s “student media policies, in particular, has been something we’ve been battling here at the Student Press Law Center for 15-20 years.”

MMSD spokesperson Tim LeMonds spoke to The Capital Times and confirmed the district is “strongly considering” a partnership with NEOLA. The company’s website shows NEOLA offers services on bylaws and policies, administrative guidelines and procedures, and a district policy website.




Outsourcing Madison’s taxpayer supported K-12 School District Governance (while spending more, for less)

An outside agency could soon be reviewing and updating the Madison Metropolitan School District’s policies.

Neola, based in Ohio with consultants based in Wisconsin, has more than 1,000 client districts around the country, including 269 in Wisconsin, where it has worked since 1989. In Dane County, those districts include DeForest, Stoughton, McFarland and Monona Grove.

MMSD spokesperson Tim LeMonds said the district’s legal services department needs the help, and confirmed it’s a partnership the district is “strongly considering.”

The department has four staff members, according to the district’s website: a secretary, Title IX investigator/Affirmative Action officer, general legal counsel and associate general legal counsel.

“We have such a small legal counsel that we need support on the policy piece,” LeMonds said. “Primarily the service that they’ll be providing is not writing the policy but working with us to update policy. There’s a lot of them, some are several years old and just need to be updated.”

But School Board member Nicki Vander Meulen, who is one of two board members on the board’s policy work team, is concerned that working with Neola will leave the district with boilerplate policies that aren’t applicable to local concerns.

“This is one of the most important things the board does,” Vander Meulen said.

Neola has more than 400 policy templates that “cover the vast array of issues facing K-12 school districts,” according to its website, though it “does not recommend the use or incorporation of district-specific materials.” While the company will provide legal assistance for claims that the policies do not “accurately reflect what is required by state and federal law,” the district is liable for risks related to included district-specific materials.

Vander Meulen is also concerned about the timing of the discussions, given new superintendent Matthew Gutierrez starts on June 1. She said any negotiations now make it seem like the administration “wants to limit his power.”

“Do we want him to be able to effect change in the district or do we want to force policy on him?” she said.

No matter the cost, Vander Meulen said it would be “incredibly problematic” to give up policy writing duties, one of the board’s “core functions.”

Madison school board members object to East High principal hire

After learning from Madison school board president Gloria Reyes that district officials had decided to make Brendan Kearney the permanent principal of East High, school board member Ananda Mirilli quickly sent an email asking district administrators to hold off on the hire.

The email, obtained by Isthmus, was sent with support from board members Ali Muldrow and Nicki Vander Muelen. Mirilli lists board colleagues Savion Castro and Cris Carusi as sharing her concerns. But Castro tells Isthmus the email was sent without his consent. Carusi, in a statement sent by Tim LeMonds, the district’s public information officer, says that she also did not give permission to include her name on the email. 

“I believe these families, the East community and the entire MMSD community deserve to know what happened, who was all involved, what really happened with communication to the families and law enforcement and clarity on our crisis response,” wrote Mirilli at 11:30 a.m. on Feb. 20. “Our community deserves to know what we have done to support our families immediately after the first call was made by the students and subsequent events thereafter.”

About an hour later, interim Superintendent Jane Belmore informed parents via email that Kearney would be the new principal at East High, effective immediately. Two sources confirm to Isthmus that Belmore knew board members had previously raised concerns about moving forward with the hire.

David Kruchten, a business teacher at East and the advisor for the DECA club, was one of two chaperones on the school trip to Minneapolis where hidden cameras were found in the rooms of students. On Jan. 30 he was arrested on seven federal charges of “attempting to produce child pornography” for two separate incidents in 2019. On Feb. 6, he was also indicted on three counts of “interfer[ing] with privacy against a minor” in Hennepin County, Minnesota. The criminal complaint alleges Kruchten placed hidden cameras in three rooms “that were positioned in bathrooms in places where the likely intent was to capture sexual imagery.”

The cameras were concealed in a smoke detector and in two air fresheners.

Madison teacher accused of secretly filming students on trip allowed to travel home with victims

A Madison teacher charged with trying to create child pornography was allowed to travel home from an out-of-state trip with students who found hidden cameras in their hotel bathrooms and the victims’ parents haven’t been told why.

Madison School District officials won’t say whether they knew about the discovery of the cameras before David Kruchten, the accused teacher, and the students boarded a bus to travel back to Madison from Minneapolis for a Dec. 6-8 business club trip.

And police aren’t saying whether they suspected Kruchten before he and the students left Minneapolis in one vehicle to travel together for hours.

“Due to this being an active investigation, the district is not able to comment on the particulars of the case,” district spokesman Tim LeMonds told the Milwaukee Journal Sentinel.

Minneapolis Police Department spokesman John Elder said he couldn’t release details of whether officers contacted the district about the potential of Kruchten’s involvement before the group departed the city, but said the department ensured the students weren’t in danger. 

“We knew that by releasing him we weren’t jeopardizing anybody,” Elder said. “The safety of the children is absolutely the number one thing and each decision, as we moved through this case, we made sure in fact the children were safe.”

Kruchten is accused of secretly filming teenage students on three school-related trips during 2019. He was indicted in federal court in January over incidents in January and October of 2019 and charged Wednesday in Hennepin County, Minnesota, with hiding cameras in students’ hotel rooms during the Minneapolis trip. 

LeMonds said district officials haven’t interviewed Kruchten or anyone else about the incident because the Wisconsin Department of Justice asked them to hold off on investigating the incident until the criminal prosecution is complete. 

DOJ spokeswoman Gillian Drummond said the department did not order the district to stop its own investigation, but typically recommends that to make sure internal reviews do not affect a criminal prosecution. 




Madison West High School student found with loaded handgun in school, police say

West High School student was arrested Tuesday after he brought a loaded handgun to the Near West Side school, Madison police said.

Tyrese T. Williams, 18, was arrested on a tentative felony charge of possession of a firearm in a school zone, Madison police spokesman Joel DeSpain said.

West High’s school resource officer received information Tuesday morning about a student possibly having a gun in the building, DeSpain said. The handgun was found in Williams’ backpack when it was searched, DeSpain said.

Principal Karen Boran said in an email to parents that “response protocols” were put in place when school staff learned about the potential of a firearm.

Of the 65 students plus or minus it kind of changes this year 24 of them are regular ed students. 

Another way to say they don’t have an IEP so there is no excuse for that reading intervention in (that group). 

12 of those 24 have been enrolled in Madison School since Pre-K kindergarten or kindergarden. 12 students have been in Madison Schools.”

Police department spokesman Joel DeSpain said a school resource officer was notified Tuesday morning that a student may have a gun in the building.

DeSpain said the gun was found in Tyrese T. Williams’ backpack. The 18-year-old was arrested for possessing a firearm in a school zone.

According to Tim Lemonds, the school district spokesperson, in an interview with NBC15 News: “The way the principal and her team and especially our educational resource officer – the way they were able to respond quickly and isolate this student and make that area safe for other students, to address the issue, was exactly the way we train.”

A letter was sent to parents by Madison West High School principal Karen Boran.




Madison’s long term, disastrous reading results: middle school governance edition

In at least two cases, principals left under a cloud.

In 2017, district officials decided not to pursue legal action against former Black Hawk Middle School Principal Kenya Walker, who abandoned her position and oversaw more than $10,000 in spending on the school’s credit card that could not be accounted for. In 2018, Sherman Middle School Principal Kristin Foreman decided to leave after a teacher alleged in a blog post that the school was “in crisis” due to deteriorating student behavior and disrespect for staff.

Tense hallways

Former Jefferson math teacher Mauricio Escobedo said Kurth had “lost control of the school” and described an environment there in which he felt threatened and had “all kinds of racial epithets and insults hurled at me” by students.

According to confidential student records obtained by WISC-TV (Ch. 3), the student in the Dec. 3 incident had been involved in 25 disciplinary incidents this school year prior to his suspension in the BB gun case.

Escobedo was fired on Dec. 20, he said, after pointing out to school leaders that the student who fired the BB gun had previously threatened to “shoot up the school.” Officially, he was let go for failing to earn a state teaching license, he said.

Kurth did not respond to email and Facebook messages seeking comment. Escobedo is one of five teachers who have left Jefferson during the current school year.

While declining to comment on specific employees, district spokesman Tim LeMonds said one of the teachers left for personal family reasons, two for another job in the district, one for “dissatisfaction” with her job and one for not meeting state licensing requirements.

Escobedo, who said he has more than 20 years of teaching experience, said he was properly licensed. But Department of Public Instruction spokesman Benson Gardner said that unless Escobedo “has used another name, he has never held a license to work in a school in Wisconsin.”

David Blaska:

Just Wednesday afternoon (01-15-2020) a Jefferson middle school student hospitalized with a concussion after being punched by a classmate. The victim told police he had been bullied for some time by the boy who hit him.

A school staff member said the victim fell to the floor after the initial blow, and was then punched a couple of more times. The employee said the suspect was screaming and knocking over chairs.

Mauricio Escobedo told Blaska’s Policy Werkes:

“I was fired and ushered out the back door because I would not allow Tequila Kurth to cover up her dangerous lack of sound disciplinary policies. On Wednesday, yet another child was nearly killed at Jefferson. YOU helped to divulge the fact [earlier this week] that the Jefferson Administration was no longer in control of the school to a wider audience than I could ever reach.  For that, I thank you.

And now that Tequila Kurth is gone, the job is remains unfinished. …

The idea that race should be considered before meting out disciplinary consequences (or disciplinary data) is inimical to the foundational principle that Justice is blind.  This aberration of America’s justice System must be changed inside of the MMSD from which it was removed by verbal artifice and deception.”

Because of the leadership change, the parent/citizen meeting is rescheduled for 6 p.m. February 6 at the school.

No safe space for reformers at Madison’s Jefferson middle school? “One can create the greatest safe space on earth here in Madison but when they go out in the world you are killing these children, they won’t be able to function out in the world which lacks such safe spaces.”

“Teachers are very very afraid.” — former teacher*

Parents are mobilizing for a showdown at Madison’s Jefferson middle school, which they describe as ruled by virtue-signaling administrators and out-of-control students.

The flash point was on December 3 when a 13-year-old boy shot a girl with a BB gun outside from a bus window. The student had remained in school despite a history of transgressions, include threatening to shoot up the school “and kill everyone” three months earlier.

* Former teacher Mauricio Escobedo told Blaska Policy Werkes that students at Jefferson, located on the same campus as James Madison Memorial high school on Madison’s far west side, must be bribed with candy and potato chips to follow instructions because there are no penalties for disobedience.

School district spokesman Tim LeMonds seemed to acknowledge problems at Jefferson. He told the Werkes: “We’ve been reviewing the culture and climate of that school for a few months now and we are working with the leadership at that school.”

I raised my hand and said, ‘Well, I don’t agree. I don’t have skin in the game. I’m not white.’ The educational philosophy of the school district is focused on feelings of safety not on discipline.”

Mr. Escobedo told this blog: “One can create the greatest safe space on earth here in Madison but when they go out in the world you are killing these children, they won’t be able to function out in the world which lacks such safe spaces.”

Escobedo feels that school administration blamed him for leaking the disciplinary file of the December 3 shooter to Channel 3000, which he denies. “Instead of focusing on safety policies, school principal Tequila Kurth wrote memos that threatened the school employee/s who divulged this public information.” Kurth is in her second school year as principal at Jefferson.

LeMonds, public information officer for the school district, told Blaska Policy Works no one has been accused of leaking the information. “That was federally protected information, so the district has been actively investigating the release of that record. We haven’t even narrowed it down to a point where we can interview folks.”

Escobedo said: “I come from business and if you’re black or white, I don’t care what race, if you’re hired at McDonald’s and you burn the food, they’re going to fire you because you are not getting the job done. But here in this school, here in Madison WI and in the United States, schools are saying ‘alright students you are failing but we’re going to protect you from failure. We’re not going give you an F but draw you a happy face for effort.’”

Commentary on the Madison School Board’s Superintendent Search Finalists



Scott Girard:

The finalists are:

Matthew Gutierrez, the superintendent of the Seguin Independent School District in Seguin, Texas. He is a former interim and deputy superintendent in the Little Elm Independent School District and received his Ph.D. in educational leadership from Texas Tech, according to the district’s announcement.

Marguerite Vanden Wyngaard, an assistant professor of educational leadership at the College of St. Rose in Albany, New York. She previously was the superintendent in the City School District of Albany and earned a Ph.D. in curriculum and instruction from Kent State University.

George Eric Thomas, deputy superintendent and chief turnaround officer for the Georgia State Board of Education. He previously was an administrator with the University of Virginia and in Cincinnati Public Schools, earning his Ph.D. in educational leadership from Concordia University.

“During this process, the Board was very fortunate to have an incredibly diverse and impressive pool of candidates participate, making this a very difficult decision,” School Board president Gloria Reyes said in a news release. “With a focus on how candidates aligned with the Leadership Profile, the Board was able to select three phenomenal finalists, all with deep roots in education and instruction, and today we are excited to introduce them to our community.”

The candidates will each visit Madison next month for a tour of the district and finish their day here with a public meeting from 6-7:30 p.m. The board is expected to make a hire in February, with the new leader starting on or before July 1.

A survey designed by consultant BWP and Associates this fall helped develop a “leadership profile” desired in the next superintendent based on community responses.

Top qualities reflected in the survey included someone who has experience with diverse populations, understands MMSD’s commitment to high levels of academic achievement for all students and is a visionary team builder. Respondents also indicated personal qualities like confidence, dedication, sincerity, honesty, organization and a background as an educator were important.

The district had hoped to announce the finalists on Monday of this week, but delayed the announcement at the last minute. MMSD spokesman Tim LeMonds wrote in an email Monday it was to give more time for reviewing candidates, though he clarified there would not be a board meeting.

“Due to MMSD being fortunate enough to have an extremely strong pool of highly qualified candidates, the MMSD board faces a very difficult decision on what candidates to move forward to the next stage in the process,” LeMonds wrote. “As a result, the board decided it was in their best interest to add additional time for candidate review, and has set a new decision deadline for this Thursday, after the holiday break.”

Logan Wroge:

To help in the search process, the School Board hired an Illinois-based consultant. BWP and Associates conducted a community engagement and feedback process this fall, advertised the position, screened candidates and recommended semifinalists for the job.

The semifinalists were interviewed by the School Board last week during closed session meetings.

In the fall, BWP held 35 meetings with different groups and organizations, politicians, and community leaders to solicit feedback on the search. An online survey also received more than 1,400 responses.

Among the attributes sought in the next superintendent were being an excellent communicator, having a strong commitment to racial equity, and having experience as a classroom teacher, according to a report from BWP based on the feedback.

In all, 31 people applied for the superintendent position. During the last hiring process, 65 candidates were screened before the board chose Cheatham in 2013.
