Five candidates are competing for three seats on the Madison school board, with the general election on April 2, 2013.
The political context for the races is explosive, given Gov. Scott Walker’s revolutionary proposals for education in Wisconsin: cuts to public school funding, an expansion of the voucher program, and a revamping of teachers’ evaluations and bargaining rights.
In Madison, the issues are particularly complex, with the intense disagreements over the district’s achievement gap between white and minority students.
TJ Mertz, an Edgewood College history instructor and education blogger, is running unopposed after Sarah Manski dropped out of the race for Seat 5 following the February primary. Her name will appear on the ballot, but she is moving to California. Mertz will replace retiring school board member Maya Cole.

Secrecy in school superintendent search was bad public policy

The secrecy that attended the Madison School District’s pick of a new superintendent was bad form and bad public policy.
Prior to making its selection, the district announced just two finalists, one of whom was found to have a closet full of skeletons that prompted his withdrawal. The remaining finalist, Jennifer Cheatham, got the job.
State law requires that at least the top five contenders for such a position be named, but does not specify when. The Madison School District decided to do so after it was too late to matter.
And then, to add insult to injury, the district’s lawyer, Dylan Pauly, dissed the disclosure law that the district complied with only belatedly.
“We believe that by releasing these names, pursuant to our legal obligation, we are negatively contributing to the chilling effect that is occurring across the state with respect to school boards’ abilities to recruit and hire highly qualified individuals as superintendents,” she wrote.

The Madison School Board Elections; setting the record straight

Dear Madison Leaders.
As the 2013 Madison school board race continues, we (the Urban League) are deeply concerned about the negative politics, dishonesty and inaccurate discussions that have shaped the campaign. While I will not, as a nonprofit leader, speak about the merits of individual candidates, we are concerned about how Madison Prep has become a red herring during the debates. The question of all the candidates has been largely narrowed to, “Did you support Madison Prep or did you not?”…as if something was horribly wrong with our charter school proposal, and as though that is the most important issue facing our school children and schools.
While the Urban League has no interest in partaking in the squabbles and confusion that has unfortunately come to define public conversation about our public schools, we do want to set the record straight about deliberations on Madison Prep that have been falsely expressed by many during this campaign, and used to dog individuals who supported the school proposal more than one year ago.
Here is how things transpired.
On May 9, 2011, Steve Goldberg of the CUNA Mutual Foundation facilitated a meeting about Madison Prep, at my request, between Madison Teacher’s Incorporated President, John Matthews and me. The meeting was held in CUNA’s cafeteria. We had lunch and met for about an hour. It was a cordial meeting and we each discussed the Madison Prep proposal and what it would take for the Urban League and MTI to work together. We didn’t get into many details, however I was sure to inform John that our proposal of a non-instrumentality charter school (non-MTI) was not because we didn’t support the union but because the collective bargaining agreement was too restrictive for the school model and design we were proposing to be fully implemented, and because we desired to recruit teachers outside the restrictions of the collective bargaining agreement. We wanted to have flexibility to aggressively recruit on an earlier timeline and have the final say on who worked in our school.
The three of us met again at the Coliseum Bar on August 23, 2011, this time involving other members of our teams. We got into the specifics of negotiations regarding the Urban League’s focus on establishing a non-instrumentality school and John’s desire to have Madison Prep’s employees be a part of MTI’s collective bargaining unit. At the close of that meeting, we (Urban League) offered to have Madison Prep’s teachers and guidance counselors be members of the collective bargaining unit. John said he felt we were making progress but he needed to think about not having MTI represent all of the staff that are a part of their bargaining unit. John and I also agreed that I would email him a memo outlining our desire to work with MTI, and provide the details of what we discussed. John agreed to respond after reviewing the proposal with his team. That memo, which we have not released previously, is attached [336K PDF]. You will see clearly that the Urban League initiated dialogue with MTI about having the teacher’s union represent our educators.
John, Steve and I met for a third time at Perkins restaurant for breakfast on the West Beltline on September 30, 2013. This time, I brought representatives of the Madison Prep and Urban League Boards with me: Dr. Gloria Ladson Billings, John Roach and Derrick Smith. It was at the close of this meeting that John Matthews told all of us that we “had a deal”, that MTI and the Urban League would now work together on Madison Prep. We all shook hands and exchanged pleasantries. Our team was relieved.
Later that evening, I received calls from Matt DeFour, a reporter with the Wisconsin State Journal and Susan Troller of The Capital Times. They both asked me to confirm what John had told them; that we had a deal. I replied by confirming the deal. The next day, The Capital Times ran a story, Madison Prep and MTI will work together on new charter school. The State Journal ran an article too, Prep School agrees to employ union staff. All was good, or so we thought.
Unfortunately, our agreement was short-lived. The very next day after the story hit the newspapers, my team and I began receiving angry letters from social workers and psychologists in MMSD who were upset that we did not want to have those positions represented by MTI. We replied by explaining to them that our reasoning was purely driven by the fact that 99% of the Districts psychologists were white and that there were few social workers of color, too. For obvious reasons, we did not believe MMSD would have success hiring diverse staff for these positions. We desired a diverse staff for two reasons: we anticipated the majority of our students to be students of color and our social work and psychological service model was different. Madison Prep had a family-serving model where the school would pay for such services for every person in a family, if necessary, who needed it, and would make available to families and students a diverse pool of contracted psychologists that families and students could choose from.
That Monday evening, October 3, 2011, John Matthews approached me with Steve Goldberg at the School Board hearing on Madison Prep and informed me that his bargaining unit was very upset and that he needed to have our Physical education teacher be represented by MTI, too. Our Phy Ed model was different; we had been working on a plan with the YMCA to implement a very innovative approach to ensuring our students were deeply engaged in health and wellness activities at school and beyond the school day. In our plan, we considered the extraordinarily high rates of obesity among young men and women of color. However, to make the deal with MTI work, that evening I gave MTI the Phy Ed teaching position.
But that one request ultimately became a request by MTI for every position in our school, and a request by John Matthews to re-open negotiations, this time with a mediator. At first, we rejected this request because we felt “a deal is a deal”. When you shake hands, you follow through.
We only gave in after current school board president, James Howard, called me at home to request that the Urban League come back to the negotiating table. James acknowledged not feeling great about asking us to do this after all we had been through – jumping through hoop after hoop. If you followed the media closely, you would recall how many times we worked to overcome hurdles that were placed in our way – $200K worth of hurdles (that’s how much we spent). After meeting with MMSD leadership and staff, we agreed to come back to the table to address issues with MTI and AFSCME, who wanted our custodial and food service workers to be represented by the union as well. When we met, the unions came to the negotiation with attorneys and so did we. If you care to find out what was said during these negotiations, you can request a transcript from Beth Lehman, the liaison to the MMSD Board of Education who was taking official notes (October 31 and November 1, 2011).
On our first day of negotiations, after all sides shared their requests and concerns, we (ULGM) decided to let AFSCME represent our custodial and food service staff. AFSCME was immediately satisfied, and left the room. That’s when the hardball towards us started. We then countered with a plausible proposal that MTI did not like. When we couldn’t get anywhere, we agreed to go into recess. Shortly after we came back from recess, former MMSD Superintendent Dan Nerad dropped the bomb on us. He shared that if we now agreed to have our staff be represented by MTI, we would have to budget paying our teachers an average of $80,000 per year per teacher and dedicating $25,000 per teacher to benefits. This would effectively increase our proposal from $15M over five years to $28M over five years.
Why the increased costs? For months, we projected in our budgets that our staff would likely average 7 years of teaching experience with a Master’s degree. We used the MTI-MMSD salary schedule to set the wages in our budget, and followed MMSD and MTI’s suggestions for how to budget for the extended school day and year parts of our charter school plan. Until that day, MMSD hadn’t once told us that the way we were budgeting was a problem. They actually submitted several versions of budgets to the School Board, and not once raising this issue.
Superintendent Nerad further informed us that MMSD was going to now submit a budget to the Board of Education that reflected costs for teachers with an average of 14 years’ experience and a master’s degree. When we shockingly asked Nerad if he thought the Board of Education would support such a proposal, he said they likely would not. We did not think the public would support such a unusual request either. As you can imagine, we left the negotiations very frustrated. In the 23rd hour, not only was the run we thought we had batted in taken away from us in the 9th inning, we felt like our entire season had been vacated by commissioners.
When we returned to our office that afternoon, we called an emergency meeting of the Urban League and Madison Prep boards. It was in those meetings that we had to make a choice. Do we completely abandon our proposal for Madison Prep after all we had done to see the project through, and after all of the community support and interests from parents that we had received, or do we go forward with our original proposal of a non-instrumentality charter school and let the chips fall where they may with a vote by the Board? At that point, our trust of MMSD and MTI was not very high. In fact, weeks before all of this happened, we were told by Nerad in a meeting with our team and attorneys, and his staff and attorneys, that the Board of Education had voted in closed session to unilaterally withdraw our charter school planning grant from the Wisconsin Department of Public Instruction. They reversed this decision after we informed them we would file a lawsuit against them. We were later told that a certain Board member was pushing for months to have this done. Then, after months of not being able to get certain board members to meet with us, Marj Passman, decided to meet with me alone in my office. During that meeting, she told me that we (ULGM) didn’t have the votes for Madison Prep and that we were never going to get the school approved. She the offered to donate her personal funds to Madison Prep, if we pulled our proposal and decided to do a private school instead. I told her that I appreciated her offer, but declined.
After finally meeting with all seven board of education members, both the Madison Prep and ULGM boards decided unanimously that we must in good conscience go forward, put the needs and future of our children first, and reintroduce the non-instrumentality proposal to the School Board. You know the rest of the story.
Over the next 45 days, we (ULGM) were categorically painted as an anti-union conservative outfit who proposed a flawed school model that divided Madison and threatened to join the Scott Walker effort to eliminate unions. We were made to be the great dividers (not the achievement gap itself) and me, “an Angry Black Man”. Lost in the debate were the reasons we proposed the school in the first place – because so many children of color were failing in our schools and there was no effective strategy in place to address it even though the school system has known about its racial achievement gap since it was first document by researcher Naomi Lede for the National Urban League in 1965. That gap has doubled since then.
Ironically, two of the people behind the attacks on ULGM were Ben Manski and TJ Mertz. They were uniquely aligned in their opposition to Madison Prep. John Matthews even weighed in on video with his comments against us, but at least he told a story that was 80% consistent with the events that actually transpired. Watch the video and listen to the reason he gave for why he didn’t support Madison Prep. He didn’t call us union haters or teacher bashers. He knew better. So why all the fuss now? Why have those who knew exactly what went on in these negotiations not told the true story about what really happened with Madison Prep? Why has a charter school proposal been made the scapegoat, or defining lever, in a school board race where there are so many other more important issues to address?
If all it takes to win a seat on the school board now is opposition to charter schools, rather than being someone who possesses unique experiences and qualifications to serve our now majority non-white and low-income student body and increasingly challenged schools, we should all worry about the future of our children and public schools.
So, for those who were unaware and those who’ve been misleading the public about Madison Prep and the Urban League, I hope you at least read this account all the way through and give all of the candidates in this school board election the opportunity to win or lose on their merits. Falsehoods and red herrings are not needed. They don’t make our city or our school district look good to the observing eye. Let’s be honest and accurate in our descriptions going forward.

Re: Discussion about potential MTl-Madison Prep Relationship
Greetings John.
I sincerely appreciate your openness to engaging in conversation about a possible relationship between MTI and Madison Preparatory Academy for Young Men. We, ULGM and Madison Prep, look forward to determining very soon what the possibilities could be.
Please accept his memo as a means to frame the issues.

  1. The Urban League of Greater Madison initially pursued a non-instrumentality public charter school
    focused on young men to, first and foremost, eliminate the academic and graduate gaps between young people of color and their white peers, to successfully prepare greater percentages of young men of color and those at-risk for higher education, to significantly reduce the incarceration rate among young adult males of color and to provide an example of success that could become a learning laboratory for
    educators, parents and the Greater Madison community with regard to successful ly educating young men, regardless of th eir race or socio-economic status.

  2. We are very interested in determining how we can work with MTI while maintaining independence with regard to work rules, operations, management and leadership so that we can hire and retain the best team possible for Madison Prep, and make organizational and program decisions and modifications as necessary to meet the needs of our students, faculty, staff and parents.
  3. MTl’s collective bargaining agreement with the Madison Metropolitan School District covers many positions within the school system. We are interested in having MTI represent our teachers and guidance counselors. All other staff would not be represented by MTI.
  4. The collective bargaining agreement between MTI and Madison Prep would be limited to employee wages and benefits. Madison Prep teachers would select a representative among them, independent of Madison Prep’s leadership, to serve as their union representative to MTI.

Lucy Mathiak, who was on the board in 2011, also didn’t dispute Caire’s account of the board action, but couldn’t recall exactly what happened in the board’s closed sessions.
“Did (the Urban League) jump through many hoops, provide multiple copies of revised proposals upon request, meet ongoing demands for new and more detailed information? Yes,” Mathiak said. “It speaks volumes that Madison Prep is being used to smear and discredit candidates for the School Board and used as a litmus test of political worthiness.”
Matthews said the problems with Madison Prep resulted from Caire’s proposal to hire nonunion staff.
“What Kaleem seems to have forgotten, conveniently or otherwise, is that MTI representatives engaged in several discussions with him and several of his Board members, in attempt to reach an amicable resolution,” Matthews said. “What that now has to do with the current campaign for Board of Education, I fail to see. I know of no animosity among the candidates or their campaign workers.”
Passman and other board members who served at the time did not return a call seeking comment.

Madison’s Strings Program….. All Quiet?

For my family, one of the unexpected assets of the Madison School District was the Strings Program. Perennially under attack during the Superintendent Rainwater reign, I’ve seen little mention of the District’s String’s program, now available from grades 5 to 12. I only found this snippet on the Madison School District’s website:

Music opportunities continue to expand in Grades 5 through 12. Strings instruction is available to students starting in 5th grade and the curriculum is based on the Wisconsin Model Academic Standards for Instrumental Music. Students in grades 6 and 7 choose to participate in Band, Chorus, General Music, or Orchestra, which also have curriculum based on the Wisconsin Model Academic Standards. In grades 8-12, students may elect to enroll in one of these classes or the additional elective courses at our high schools. These course in connection with the community musical offerings, provide a breadth of experiences to help build student skills and knowledge of music.

Barbara Thompson Did Not Make the Madison School Board’s Final Two Superintendent Candidate Beauty Contest

I applaud the Wisconsin State Journal’s efforts to dig deeper into the Madison Superintendent search process. A kind reader pointed out to me how “shocking” it is that Barbara Thompson was NOT one of the two finalists.
The Madison School Board named these two finalists:

Jennifer Cheatham – apparently selected.
Walter Milton, Jr. – withdrew under a cloud of controversy.
from a larger group that included:

  • Joe Gothard, Madison’s assistant superintendent for secondary education.
  • Barbara Thompson, a former Madison principal and New Glarus superintendent who is currently superintendent in Montgomery, Ala.
  • Tony Apostle, a retired superintendent from the Puyallup School District near Tacoma, Wash.
  • Curtis Cain, administrator of the Shawnee Mission School District near Kansas City, Mo.
  • Sandra Smyser, superintendent of Eagle County Schools in Eagle, Colo.

This information is provided in response to a request for more information made at the January 28th Regular Board of Education meeting regarding the implication of CogAT for the 2012-13 school year. Communication with DPI TAG consultant has occurred on numerous occasions. A Review Committee, with additional members, met twice since January 28 and a survey of options was developed and distributed to the Assessment Review Committee and elementary and middle school principals. Results from this survey, in addition to previous Review Committee information, were used to develop the recommendation.
The BOE requested a report on CogAT which is attached to this memo.

Madison School District Administrative Contracts

Employment Contracts for Administrative Personnel (350K) PDF:

IT HEREBY AGREED by and between the Madison Metropolitan School District (herein referred to as the “District”) and _________________ (hereinafter referred to as the “Administrator”) that the District does hereby employ the Administrator under the terms and conditions specified herein.
This contract shall cover a period of one year, beginning on July 1, _______ and ending on June 30, _______.
RESPONSIBILITIES
The Administrator agrees to perform his/her assigned services, duties, and responsibilities at a professional level of competence, and in compliance with the laws and regulations of the State of Wisconsin and the rules, regulations and policies of the District which are now existing or which may be hereinafter enacted by the District.
At all times, the Administrator shall maintain such licensure (i.e., active and in good standing) with the State of Wisconsin (1) as is required by the State for an individual performing the administrative duties assigned to the Administrator by the District, and (2) as may be separately and additionally required by the District as a discretionary qualification for the assigned position/duties. Failure to maintain such licensure is sufficient grounds for termination of this Contract and the Administrator’s employment with the District.
The Admin’1strator agrees to devote full time to the duties and responsibilities normally expected of the Administrator’s position during the term of this contract, and shall not engage in any pursuit which interferes with the proper discharge of such duties and responsibilities.
The Superintendent of Schools shall have the right to make such assignments or transfers of the Administrator’s services as the interests of the District may demand.
The Administrator shall have the responsibility to become familiar with the contents of the District’s Affirmative Action Plan and shall take an active role in implementing its policies and practices.
SALARY AND LENGTH OF CONTRACT
For the 2013-14 school year the Administrator will be placed on the Administrator’s salary schedule at Salary Grade in consideration for services rendered, the District will pay the Administrator a salary of ___________ for a minimum of _______ days worked (July 1, 2012 through June 30, 2013), as such days are defined by the District’s Human Resources Department for payroll purposes. Additional work at times such as weekends, after typical business hours, etc. may sometimes be necessary or required, but does not entitle the Administrator to additional compensation (except as provided herein in regard to additional assigned summer work).
The function of specifying a number of working days within this contract is to define the extent to which the Administrator’s annual salary is pro-rated off the annual amount that would be applicable to a “225 day” (i.e., 100% of specified salary) contract at the same salary Grade and Step. Administrative personnel employed on a Jess than 225 day basis shall be available for additional employment during the summer months when requested/required by the Superintendent of Schools. When such additional summer work is expressly requested or required by written direction from the Superintendent, the Administrator shall receive additional compensation at a daily salary rate of _________ for the number of full additional days requested or required.

The timing and content of Administrator contracts has been somewhat controversial over the years (more). It appears that contracts continue to be in place (based on the dates contained in this document) prior to the District’s annual budget cycle.

Madison School Board Against Open Records; “Government Entities Must Mail Records if Requested”

Wisconsin law requires boards to release the identities of at least five candidates to the public upon request when there are at least five applicants, according to a 2004 opinion by then-Attorney General Peg Lautenschlager.
The opinion doesn’t specify when the names must be disclosed.
School district officials said Friday they were still reviewing the newspaper’s request. On Tuesday district lawyer Dylan Pauly told the newspaper the district would respond to the request within 10 business days.
Bill Lueders, president of the Wisconsin Freedom of Information Council, said the School Board “is clearly violating the spirit of the law” by not making the names public before the board made a decision. The law calls for records to be provided as soon as possible.
“For the district to pick a superintendent candidate without first meeting its statutory obligation to identify (at least) five candidates considered most qualified delegitimizes the selection that is made,” Lueders said.

It’s also illegal. Government entities cannot require a requester to come into the office to get a copy of a record except in the rare circumstance where it is not possible to copy the record. Wisconsin law provides plainly that “any requester has a right to inspect a record and to make or receive a copyof a record that permits photocopying.” Wis. Stat. 19.35(1)(b) (emphasis added). Decades ago, the law actually permitted the government to choose whether to provide a copy or require the requester to come in and copy it. In 1991, however, the legislature amended the law to remove that choice when a request is not made in person. State ex rel. Borzych v. Paluszcyk, 201 Wis. 2d 523, 527, 549 N.W.2d 25 (Ct. App. 1996) (describing the legislative history and noting that “[b]y statute, [the custodian] was required to photocopy and send the material requested”).
Be aware, though, that the government entity can charge you the actual postage cost to mail the copies. Wis. Stat. 19.35(3)(d).
When the Education Action Group ran into this kind of excuse from a school district* in northern Wisconsin last week, they called us. We wrote a letter to the school district’s superintendent, and the very next day EAG got an email saying the records were in the mail.

Madison has many wonderful traits. This town’s obsession with process is not one of them.
All indications are that the one remaining choice for the Madison public schools’ new superintendent, Dr. Jennifer Cheatham, would be a great pick. I’m told by people close to the decision that the Chief Instruction Officer for the Chicago Public Schools has been the top candidate all along, and that she is a “rock star” in the education world.
There is no job harder or more important in our city than being its schools superintendent. This is a city full of education experts whose child is clearly a genius (just like them) and yet isn’t being challenged enough by their teachers. At the same time, we have a growing number of poor kids who come to school without the basics, even a good breakfast. So, the challenge is to meet the high expectations of highly educated parents, while trying to give underprivileged kids the best chance possible to succeed, all in the context of constricted budgets.
At the same time, the stakes for our whole city are enormous. Failing public schools have been the downfall of dozens of American cities.

Urban League Strongly Supports the Decision on Madison Superintendent

The Urban League of Greater Madison strongly supports the Madison School Board’s decision to hire Dr. Jennifer Cheatham to serve as the next Superintendent of Schools of the Madison Metropolitan School District. Dr. Cheatham’s strong background in teacher quality, teacher evaluation, instructional leadership and organizing school system functions and operations around the educational and developmental needs of young people will be great assets for Madison’s public schools.
Kaleem Caire, President and CEO of the Urban League shared that, “Dr. Cheatham’s experience as a leader of teachers and her strong focus on improving instruction, implementing a rigorous curriculum for all students, ensuring teachers build strong and motivating relationships with children, and using data to inform teaching represent the core of what our school system needs right now.” Caire further stated that, “The Urban League believes that children in Madison deserve world class leadership, world class teachers and world class schools. Dr. Cheatham’s history and track record show that she shares a common belief in these ideals and what it takes to get there. We look forward to supporting her transition and welcoming her and her family to Madison.”
The Urban League is presently partnering with the Madison Metropolitan School District on the recruitment of high quality teachers and professional staff, preparing high school juniors and seniors for the ACT college entrance exam, and engaging parents of color in the work and decision-making of the school system. The Urban League also launched the Urban League Scholars Academy in January 2013 at Sennett and Toki Middle Schools, a program that extends the instructional day for 6th graders by 80 minutes in reading/language arts and mathematics. The League also operates the Schools of Hope tutoring program at 17 middle and high schools in Madison, Middleton, Oregon and Sun Prairie in partnership with these school districts, the United Way of Dane County and Madison School Community Recreation.

Madison Superintendent Candidate Visit

In her first visit to a Madison school, superintendent candidate Jennifer Cheatham met two La Follette High School students whom principal Chad Wiese said represent the district’s diversity and also its greatest challenge.
Senior Tanner Trickle, a basketball player and honors student, and junior Khaleah Monger, a varsity cheerleader, president of the black student union and an AVID/TOPS participant, led Cheatham on a tour of the school, highlighting a remodeled study hall, the gym and Lussier Stadium.
When Trickle told Cheatham he had applied to University of Chicago, Cheatham replied, “That was my first choice too. It didn’t work out at all.”
Nonetheless, Cheatham, 41, chief of instruction for Chicago Public Schools, received her bachelor’s degree from DePaul University in Chicago and earned graduate degrees from the University of Michigan and Harvard University.

Madison School Board could shake things up, in a good way

Five years ago, people were praising newly named Madison schools superintendent Dan Nerad as a paragon of listening skills and inclusiveness — a trained social worker who seemingly never burned a bridge in his life.
By contrast, Milton, the current superintendent at the Springfield (Ill.) school district, and Chicago School District administrator Jennifer Cheatham seem willing to upset the apple cart if they think it will help students.
School Board president James Howard told me the board’s focus was not to find candidates who would shake things up because, overall, Madison remains a quality district that doesn’t need a whole lot of shaking.
Rather “the issue” — or, as he later clarified, one the most important issues — “is one thing: the achievement gap.”
And the board certainly wanted to know if candidates had “the kind of will to make the kind of changes” to tackle that problem, he said. “To demonstrate success, you have to be from a district that has some diversity.”

Consultant defends candidate vetting as a call is made for additional Madison superintendent finalists

School Board members and Ray and Associates, the consultant in the superintendent search process, have been under fire since Sunday when the district announced finalists Walter Milton Jr., superintendent of schools in Springfield, Ill., and Jennifer Cheatham, chief of instruction for the Chicago Public Schools.
Milton pulled his name from consideration late Tuesday, following days of online comment by Madison residents on incidents in his past. Those included a 2007 state audit finding of mismanagement at the New York school district he headed and his hiring of a former business partner who was a convicted sex offender while with the Flint, Mich., school district. according to news reports. Milton also had been questioned about inaccurate resumes in applying for previous jobs.
The question bandied about in comments to online stories is: If citizens could unearth these apparent red flags about Milton’s background on Google, why didn’t Ray and Associates?

With superintendent candidate set to visit, Madison School Board on hot seat

As a top Chicago Public Schools administrator visits Madison on Thursday to make her case to be the next Madison superintendent, questions linger about the School Board’s selection process.
The day after the other finalist for the job suddenly withdrew amid questions about his past, two Madison School Board members stood by the board’s decision to move forward with the visit by Jennifer Cheatham. The other five did not return calls seeking comment.
Board members Ed Hughes and Mary Burke also said they weren’t ready to pass judgment on the search consultant, Ray and Associates of Cedar Rapids, Iowa, after Walter Milton Jr., superintendent in Springfield, Ill., withdrew, and it was not clear how much board members knew about his background.
“We understand why people have questions about our process because it hasn’t gone as smoothly as we’d like,” Hughes said. “That said, I think we are excited about the possibility of Jennifer Cheatham. She sounds like she could be a terrific candidate.”

Madison School superintendent candidate Walter Milton Jr. withdraws

The superintendent of the Springfield, Ill., school district has withdrawn from the search for the same job in Madison.
Walter Milton Jr. pulled his name from consideration for the Madison School District’s superintendent job Tuesday evening, according to a statement the Madison School Board provided to the State Journal.
The decision comes amid questions about parts of Milton’s background and how much the board knew about them before naming him Sunday as one of two finalists for the job.
At previous jobs he hired without conducting a background check a former business partner who had been convicted of child molestation, according to news reports. Milton also faced questions about submitting inaccurate resumes when applying for jobs.
Also, a 2007 New York state comptroller’s audit found Milton had been overpaid while superintendent at a school district there from 2003 to 2005 and used a district credit card for personal expenses that he had not paid back.

Madison Superintendent Candidate Roundup: It Seems Unlikely that One Person will Drive Significant Change

After paying an Iowa-based headhunting firm $30,975 to develop a candidate profile and launch a three-month nationwide recruitment effort, and after screening 65 applications, the Madison school board has narrowed its superintendent search down to two finalists. Dr. Jenifer Cheatham is chief of instruction for Chicago Public Schools, and Dr. Walter Milton, Jr., is superintendent of Springfield Public Schools in Illinois.
Parents and community members will get a chance to meet both finalists at a forum at Monona Terrace starting at 5:45 p.m. Thursday night. But despite the exhaustive and expensive search, the finalists aren’t without flaws.
Cheatham was appointed to her current post as chief of instruction in June of 2011 by Chicago Public Schools CEO Jean-Claude Brizard, who has since resigned. According to her Chicago district bio, Cheatham’s focus is improving urban school districts by “developing instructional alignment and coherence at every level of a school system aimed at achieving breakthrough results in student learning.” Cheatham received a master’s and doctorate in education from Harvard and began her career as an 8th grade English teacher. But she found herself in a harsh spotlight as Chicago Mayor Rahm Emanuel and district officials pushed for a contentious 7.5 hour school day last year, which became one of many big issues that led to the Chicago teachers strike in September.
“It was handled horribly in terms of how it was rolled out,” says Chicago attorney Matt Farmer, who also blogs about Chicago school issues for The Huffington Post.
Farmer says pressure was mounting last spring for the district to explain how the longer day would work and how it would be paid for. Cheatham was sent to a community meeting he attended on the city’s south side to explain the district’s position.

Some of candidate Walter Milton Jr.’s history a surprise to School Board president

Madison School Board president James Howard said Monday he wasn’t aware of some of the controversial aspects of Walter Milton Jr.’s history until after the board named him a finalist to be Madison’s next superintendent.
Prior to becoming superintendent in Springfield, Ill., Milton was criticized for hiring without a background check a colleague who had been convicted of child molestation in Georgia. The colleague, Julius B. Anthony, was forced to resign from a $110,000 job in Flint, Mich., after a background check uncovered the case, according to the Springfield State Journal-Register.
Milton and Anthony were former business partners and worked together in Fallsburg, N.Y., where Milton was superintendent before moving to Flint, according to news reports.

Jennifer Cheatham will be the third person in the last two years from our administration who I’ve been a reference for who has taken over a fairly significant school district,” Vitale said. “Chicago is a pretty good breeding place for leaders.”

A Springfield School District spokesman said Milton is declining interviews until a community forum in Madison on Thursday.
Prior to Fallsburg, Milton was a teacher and principal in his hometown of Rochester, N.Y. He received a bachelor’s degree in African history and African-American studies from Albany State University, a master’s degree in education from the State University of New York College at Brockport and a Ph.D. in education from the University of Buffalo.
Milton’s contract in Springfield expires at the end of the 2013-14 school year. His current salary is $220,000 plus about $71,000 in benefits.

School Board members want a superintendent with vision, passion and a thick hide

Madison School Board member Marj Passman says she was looking for superintendent candidates who have had experience working in contentious communities. “That’s important, considering what we’ve gone through here,” she told me Monday.
And what Madison schools are going through now.
The Madison Metropolitan School District had scarcely released the names of the two finalist candidates — Jennifer Cheatham, a top administrator in the Chicago Public School System and Walter Milton Jr., superintendent of the schools in Springfield, Ill. — before the online background checks began and comments questioning the competency of the candidates were posted. So the new Madison superintendent has to be someone who can stand up to public scrutiny, Passman reasoned.
And the issues that provoked the combative debate of the last couple of years — a race-based achievement gap and charter school proposal meant to address it that proved so divisive that former Superintendent Dan Nerad left the district — remain unresolved.
So, Passman figured, any new superintendent would need experience working with diverse student populations. Both Cheatham and Milton fit that bill, Passman says.

Wisconsin State superintendent race is incumbent Tony Evers’ to lose

Last week, Senate Democrats lashed out at a Republican bill they said was intended to weaken the already enfeebled Office of the Secretary of State, currently held by Democrat Doug La Follette.
“It’s directed to take the one Democrat elected to statewide office and cut him out of the legislative process,” state Sen. Fred Risser, D-Madison, says of the legislation, which would remove the secretary of state’s ability to delay the publication of a bill for up to 10 days after passage, as La Follette did following the controversial passage of Gov. Scott Walker’s collective bargaining bill two years ago.
Technically, Risser is correct. The secretary of state, which Gov. Tommy Thompson long ago relegated to obscurity, is the only statewide office held by Democrats.
But while the superintendent of public instruction is technically a nonpartisan position, current Superintendent Tony Evers, like his predecessors for the past 30 years, is supported by Democratic-affiliated groups and has been an outspoken opponent of many of Walker’s policies.
And unlike La Follette, Evers has a meaningful platform to influence one of the most important issues facing the state.
It’s noteworthy, then, that Evers does not seem to be a significant target for conservatives, even though his lone challenger in the April 2 election for another four-year term is a GOP member of the Assembly: Don Pridemore.

Madison Names Two Superintendent Finalists, Public Forum on 2.7.2013

According to Cheatham’s biography on the Chicago Public Schools website, her focus is on “systemic improvement in urban school districts” and her expertise “lies in developing instructional alignment and coherence at every level of a school system aimed at achieving breakthrough results in student learning.”
She has worked as a Chief Area Officer for Chicago Public Schools and the executive director of Curriculum and Instruction for San Diego City Schools, the biography said. She has a bachelor’s degree in English from DePaul University, a master’s in education from the University of Michigan, and a master’s and doctorate in education from Harvard University.
According to a personal website promoting his book, “Me in the Making: One Man’s Journey to Becoming a School Superintendent,” Milton is a native of Rochester, N.Y., who earned a bachelor’s degree from the University of Albany and a master’s from SUNY College at Brockport. He took post-graduate courses at the University of Rochester to receive his administrative certifications, including his superintendent’s license. He holds a doctorate of education in leadership and policy from the University of Buffalo. He has also been a teacher and principal.

Update on the Building the Madison School District’s Future: Measuring Progress on Priorities report

The Building Our Future plan provides direction for improving student achievement and district accountability. The plan identifies specific strategies and corresponding measures to meet the four overarching priorities of the district. The measures provide data to monitor progress towards improvement.
The key reason to include district and program measures in this report is to make sure that the Building Our Future plan is contributing to closing achievement gaps. Each program and initiative in Building Our Future is based on extensive research and planning. However, it is important to connect these initiatives to tangible outcomes. Tracking these measures helps increase accountability, allocate resources effectively and efficiently, and continuously improve our efforts to educate all students.
District Priorities: MMSD Management Team identified overarching district priorities in the areas of Attendance, Behavior, Growth and Achievement. The rationale for these priorities is based on the following theory of action:
When our teachers apply strong, explicit teaching skills within an aligned multi-tiered system of instruction and support, and students attend school regularly with behavior that positively impacts their learning and the learning environment, then students will show academic achievement, and social and emotional growth and gaps in learning and achievement will close.
This report outlines 2011-12 progress indicators for each of these priorities and includes historical data when appropriate.
Strategies: Each initiative in Building Our Future is outlined in the report, including a narrative description, the alignment to district priorities, the primary contact(s), action steps, and objectives with annual progress measures. When available, data from 2011- 12 on key progress indicators is included, along with relevant history for comparison. The approved 2012-13 budget for each strategy will also be integrated into the report to help contextualize how MMSD will allocate resources for this initiative moving forward.

Madison School Board Policy 4221 Update: Use of Restraint and Seclusion

In response to the demands of MTI members seeking further clarification regarding the District’s enforcement of Board Policy 4221 – Use of Restraint and Seclusion – Interim Superintendent Jane Belmore provided a memo defining restraint and providing guidance about appropriate instances of incidental or brief physical contact with students while carrying out one’s duties. The Superintendent also clarified that, “Physical restraint is NOT briefly touching or holding a pupil’s hand, arm, shoulder or back to calm, comfort or redirect the pupil.”
While MTI continues to encourage staff to be cautious when redirecting students using any physical prompts, Belmore’s clarification is welcome. The District is in the process of providing training to staff relative to the appropriate use of physical restraint and seclusion, within the meaning of applicable Wisconsin Statutes.

State superintendent candidate calls for volunteer security in schools

The challenger in the spring election for state superintendent of public instruction is calling on school districts to post volunteer security guards in schools to protect student safety.
Rep. Don Pridemore, R-Erin, issued a statement Thursday saying school boards “should be given the freedom to hire a competent, well-trained school official or employee who is experienced with applying force whenever force is required.” He said retired or on-duty police officers would be preferred.
Many school districts already contract with local police departments to assign police officers to schools. Madison has a police officer assigned to each of its high schools.
Pridemore said the most cost-effective approach would be for districts to ask qualified, retired volunteers from their community to patrol.

2013 Madison Schools Wishlist

11. I wish for a successful introduction of the Mondo reading program in all our elementary schools. Superintendent Jane Belmore has particular interest and expertise in literacy and she has spearheaded the school district’s decision to adopt the Mondo Bookshop Program at the K-5 level across all elementary schools, with the purchase of new curriculum materials funded through some of the unexpected state aid that came our way this fall. The Mondo program, which is said to have clearly-focused lesson guides that are aligned to the Common Core state standards, should be a significant step forward in terms of a district-wide, aligned, early literacy scope and sequence. I also wish that now that we have made a commitment to the Mondo program, we stick with it and don’t lurch towards some other approach if the improved outcomes we’re seeking take a while to arrive.
12. I realize there is initiative fatigue among our teachers and staff, but I wish for a continued push for new student-based ideas and initiatives developed at the school level, like the drive toward converting Toki Middle School to an Expeditionary Learning school. This fall, there was discussion of Toki possibly switching to a charter school structure as a way of accessing state funds that could help accelerate the conversion. I am sorry that this charter proposal has run into complications and has been withdrawn before the Board really had a chance to consider it, but I hope that principals, teachers and staff at all our schools continue to search for innovative approaches toward enhancing the engagement and learning of our students.

2013 Wisconsin DPI Superintendent and Madison School Board Candidates

“I’ve been frustrated with the fact that our educational system continues to go downhill even with all the money the Legislature puts into it,” he said.
Pridemore said he will release more details about his educational agenda in forthcoming policy statements and has several education bills in the drafting phase. Asked if he believed schools should have armed teachers, he said that was a matter that should be left entirely to local school boards to decide.
Evers, who has been school superintendent since 2009, is seeking a second term. He has previously served as a teacher, principal, local school superintendent and deputy state schools superintendent.
Wisconsin’s education landscape has undergone some major changes during his tenure, including significant reductions in school spending and limits on collective bargaining for public workers that weakened teachers unions, which have supported Evers in the past.
Evers wants to redesign the funding formula that determines aid for each of Wisconsin’s 424 school districts and to provide more aid to schools. Also, he wants to reinvigorate technical education and to require all high schools to administer a new suite of tests that would offer a better way to track students’ academic progress and preparation for the ACT college admissions exam.

School Board president James Howard, the lone incumbent seeking re-election, faces a challenge from Greg Packnett, a legislative aide active with the local Democratic Party. The seats are officially nonpartisan.
Two candidates, low-income housing provider Dean Loumos and recently retired Madison police lieutenant Wayne Strong, are vying for Moss’ seat.
The race for Cole’s seat will include a primary on Feb. 19, the first one for a Madison School Board seat in six years. The candidates are Sarah Manski, a Green Party political activist who runs a website that encourages buying local; Ananda Mirilli, social justice coordinator for the YWCA who has a student at Nuestro Mundo Community School; and T.J. Mertz, an Edgewood College history instructor and local education blogger whose children attend West High and Randall Elementary schools.

Madison School District’s Elementary Literacy Program

For the past four years, MMSD has been aware that the current implementation of balanced literacy, our core instructional program for literacy at the elementary level, has not resulted in all students making the progress necessary to meet grade level standards. The research shows that three key things are necessary for students to gain proficiency in the common core standards:

  • a highly qualified teacher in the classroom

  • a strong instructional leader in the school and
  • access to an aligned, guaranteed and viable curriculum (Marzano, 2003).

It is clear that MMSD has two out of these three in place: highly qualified teachers and strong instructional leaders. To maintain and develop strong teachers and leaders need well planned, embedded, ongoing professional development. The
School Support Team and Instructional Research Teachers provide us the mechanism for delivering this necessary professional development.
What is needed is a decision about a guaranteed, viable core instructional curriculum that is cohesive across all 32 elementary schools. All student will benefit from consistency across grades levels and schools. Our students from mobile families must have the security and consistency that this core will provide.

When all third graders read at grade level or beyond by the end of the year, the achievement gap will be closed…and not before.

Madison School District Open Enrollment Leavers Report, 2012-13

For the 2012-13 school year, MMSD has 1041 leavers and 281 enterers for a net enrollment decrease of 760 students due to open enrollment.
Of the 1041 leavers for 2012-13, 663 were “continuing leavers” who open enrolled outside of the District in previous years. The other 378 leavers left MMSD for the first time this year.
The increasing number of total leavers in recent years results from many consecutive years of increases in first-time leavers who subsequently become continuing leavers.
First time leavers increased from 333 to 378 from 2011-12 to 2012-13.
About 40% of the MMSD residents who open enroll outside of the district for the first time never attended MMSD and could be considered “stayers” for other districts.
A 2009 survey of open enrollment leavers showed that personal preference led to about one third of the decisions to leave, including concerns about safety, drugs and negative peer pressure. Proximity to other districts’ schools accounts for about a quarter of the reasons for attending another district. About a quarter were related to curricular, after school or virtual programs.

An Update on Madison’s Use of the MAP (Measures of Academic Progress) Assessment

Unlike other assessments, MAP measures both student performance and growth through administering the test in both fall and spring. No matter where a student starts, MAP allows us to measure how effective that student’s school environment was in moving that student forward academically.
This fall’s administration serves as a baseline for that fall to spring growth measure. It also serves as an indicator for teachers. As we continue professional development around MAP, we will work to equip schools to use this data at the classroom and individual student level. In other words, at its fullest use, a teacher could look at MAP data and make adjustments for the classroom or individual students based on where that year’s class is in the fall, according to these results.
Meeting growth targets on the fall administration indicates that a student met or exceeded typical growth from Fall 2011 to Fall 2012. Typical growth is based on a student’s grade and prior score; students whose scores are lower relative to their grade level are expected to grow more than students whose scores are higher relative to their grade level.
In Reading, more than 50% of students in every grade met their growth targets from Fall 2011 to Fall 2012. In Mathematics, between 41% and 63% of students at each grade level met their growth targets. The highest growth in Mathematics occurred from fourth to fifth grade (63%) and the lowest growth occurred from fifth to sixth grade (41%).
It is important to note that across student groups, the percent of students making expected growth is relatively consistent. Each student’s growth target is based on his or her performance on previous administrations of MAP. The fact that percent of students making expected growth is consistent across student subgroups indicates that if that trend continues, gaps would close over time. In some cases, a higher percentage of minority students reached their growth targets relative to white students. For example, at the middle school level, 49% of white students met growth targets, but 50% of African American students and 53% of Hispanic students met their growth targets. In addition, English Language Learners, special education students, and students receiving free and reduced lunch grew at similar rates to their peers.
MAP also provides status benchmarks that reflect the new, more rigorous NAEP standards. Meeting status benchmarks indicates that a student would be expected to score “Proficient” or “Advanced” on the next administration of the Wisconsin Knowledge and Concepts Examination (WKCE).
That means that even though overall scores haven’t changed dramatically from last year, the percent of students identified as proficient or advanced will look different with these benchmarks. That is not unique for MMSD – schools around the state and nation are seeing this as they also work toward the common core.
While these scores are different than what we have been used to, it is important to remember that higher standards are a good thing for our students, our districts and our community. It means holding ourselves to the standards of an increasingly challenging, fast-paced world and economy. States all around the country, including Wisconsin, are adopting these standards and aligning their work to them.
As we align our work to the common core standards, student achievement will be measured using new, national standards. These are very high standards that will truly prepare our students to be competitive in a fast-paced global economy.
At each grade level, between 32% and 37% of students met status benchmarks in Reading and between 36% and 44% met status benchmarks in Mathematics. Scores were highest for white students, followed by Asian students, students identified as two or more races, Hispanic students, and African-American students. These patterns are consistent across grades and subjects.
Attachment #1 shows the percentage of students meeting status benchmarks and growth targets by grade, subgroup, and grade and subgroup. School- and student-level reports are produced by NWEA and used for internal planning purposes.

Infinite Campus & The Madison School District

As the District contemplates consequences for those teachers who are not using Infinite Campus, MTI has heard from several members about the difficulty in meeting this District expectation. District Assistant Superintendent Joe Gothard sent a letter to all middle and high school teaching staff in late August, mandating that they use the grade book within IC and enter grades at least once weekly. While this poses challenges across the board, it has been especially difficult for specials teachers as they see literally hundreds of students each week.
MTI Executive Director John Matthews and Assistant Director Sara Bringman have spoken with Gothard about how to alleviate this burden for specials teachers. Gothard reports that he has spoken with principals and shared this message: “If specials teachers have large classes, and/or an A/B day (schedule), they would not be held to the standard of weekly input. At a minimum they should be using it for progress and grade reports.” Gothard’s accommodation should help allay concerns among specials teachers for not following the District’s earlier mandate.

To complete the hat trick, late last month Pines, representing Madison Teachers Inc. and the Wisconsin Education Association Council, stuck it to Republicans again when Dane County Judge Amy Smith struck down part of a law that consolidated rule-making authority in the governor’s office. That law gave Gov. Scott Walker control over rules that govern agencies like the Attorney General’s Office, the Government Accountability Board, the Employment Relations Commission, the Public Service Commission and the Department of Public Instruction, all of which were previously independent. Pines argued, and Smith agreed, that State Superintendent Tony Evers had constitutional powers beyond the governor’s reach.
“They extended (the law) to the Department of Public Instruction despite the fact that they were told in the brief legislative hearings they held on that bill that it was likely unconstitutional,” says Pines. “But they didn’t care. They just did it.”
While Pines’ recent wins are likely to be appealed, one thing is clear: He’s on a roll. How did he get to be such a pain in the collective GOP butt?

Wisconsin DPI Superintendent Tony Evers (running for re-election in 2013) Proposes New State Tax $ Redistribution Scheme

State Superintendent Tony Evers on Monday reintroduced a proposal from two years ago to increase state funding for public education and change the way the state finances its public schools as part of his 2013-’15 budget request.
The proposal calls for a 2.4% increase in state aid in the first year of the budget and a 5.5% increase in 2014-’15, which Evers said would put the state back on track to return to two-thirds’ state support for public school costs by 2017.
The Department of Public Instruction’s 2013-’15 budget proposal guarantees state funding of $3,000 per pupil and would result in every school district either getting more state money or the same money as before, but Republican legislators on Monday did not express confidence in the total package.
Luther Olsen, chair of the Senate Education Committee and a Republican from Ripon, said Evers’ “Fair Funding for our Future” plan just shifts money around between districts and doesn’t really award more money to schools.
Olsen did say he would like to increase districts’ revenue limit authority per student – or the combined amount they can raise in state general aid and local property taxes – by at least $200 per pupil starting in the first year of the next biennial budget.
Evers announced his 2013-’15 state public education budget request Monday at Irving Elementary School in West Allis.

WisPolitics:

Walker spokesman Cullen Werwie said the proposal will be reviewed in the context of the overall budget, but said education is one of Walker’s top budget priorities.
“The governor will work to build off of the work done with Superintendent Evers on school district accountability and Read to Lead as he creates the first version of the state budget, which will be introduced early next year,” Werwie said.
Evers also said he’ll run for re-election next year, adding that despite the funding cuts, he’s excited to continue pushing reform and accountability.
“In order for us to create a new middle class and to move our state forward in a positive way, our public schools need to be strong, and the reforms we’re implementing now are going a long way toward accomplishing that,” Evers said. “We’re in a great place as a state and we’ll keep plugging away.”
Various conservative education sources said no candidate has come forward to challenge Evers yet, but talks were ongoing with potential challengers. Nomination papers can be circulated Dec. 1 and are due back to the GAB Jan. 2.

Groundhog Day: Madison Schools’ Infinite Campus Usage Memorandum

In the spring of 2012 data was collected indicating a wide array of teacher grade book usage on Infinite Campus. Following the distribution of the letter on August 27, 2012 a number of concerns were brought forth regarding the use of grade book. Music and Physical Education teachers at the middle school level have larger class sizes and teach on an alternate day rotation in many cases. Currently, members of Curriculum and Assessment are working with Music and Physical Education teachers to develop a set of guidelines that are practical due to their schedules.
Following the end of the first quarter, November 7, we will gather data and measure the use of teacher grade book. The Assistant Superintendent for Secondary Schools will share the data with building principals to address areas of concern.

Across our middle and high schools, a number of you have utilized the Infinite Campus grade book.
Parents,guardians and other youth service providers appreciate the information regarding student progress. This year, the MMSD opened an online student enrollment option for families. The feedback is clear, a high percentage of MMSD families utilize Infinite Campus. The Research and Evaluation Department has analyzed the number of Infinite Campus grade book entries in all of our schools and it is evident to me that we have yet to reach our full implementation by having all teachers using the Infinite Campus grade book and consistently updating student progress. Therefore, it is my expectation that all teachers follow the below guidelines as we enter the 12-13 school year.

Madison School District Teacher Handbook Plateau Bargaining

More than 40 members of Madison Teachers Inc. attended Tuesday’s board meeting, and executive director John Matthews delivered a letter reminding the board that changes in state law “did not take away the board’s ability to engage in conversation about” benefits and work rules.
Board vice president Marj Passman said she preferred a process where management and employees work out their differences.
“I don’t care what the governor wants,” Passman said. “I’d like to go back to the two equal body process.”
Board member Arlene Silveira said several districts included teachers on the committees that developed their handbooks and “having staff input right upfront prevents difficult ways of getting there.” She also suggested having a board member present at each meeting.
Prior to the meeting, School Board President James Howard said the work group is for administrators so it doesn’t need to include teachers. There will be other advisory groups that will include their input, he said.

“The kids are delighted to be back at school,” James Howard said as he addressed the Board and numerous spectators at tonight’s Board of Education Workshop. Everyone nodded their heads in agreement, while they anxiously awaited the real topic of conversation. This would be the Board’s first public conversation on the Madison Metropolitan School District (MMSD) Employee Handbook, a handbook that would replace more than sixty years of collective bargaining.
As Howard spoke, I surveyed the crowd that had gathered in the McDaniels Auditorium at the Doyle Administration Building. Madison Teachers Inc. (MTI) members stood out in their red, Union T-shirts. They made up more than half of the audience. The AFSCME members were dressed in green, representing custodial, maintenance and food service workers in the district. MMSD administrators, community members and a County Board member were also present.

There was some Pollyannaish talk that the “Guiding Principles” in the process document — especially the first two “1. Improve student learning. As in everything we do, the first question and the top priority is student learning. How does what we are considering impact students? 2. Empower staff to do their best work. How does this impact teachers and staff? Does it help or hinder them in doing their jobs effectively?” — would be sufficient (a little more below on this), but there seemed to be a consensus that at very least the committee should present some options to the Board. That’s another reason to have an inclusive committee; to get better options.
A quick aside on the “Guiding Principals” and related thoughts and then back to the Board’s role. It is all well and good to say that student learning is or should be primary in just about everything, but it is also false and serves to marginalize staff. I’ve long said that the interests of teachers align with the interests of students and the district by about 95% and yes “student learning” is the prime interest. But staff are adults, with mortgages, families to support, loans to pay, relationships to cultivate and maintain, …They are not and should not be people who put student learning above the their own well being. To even contemplate that they should be is disrespectful. That’s why we hear the “All about the students” meme from the anti-teacher/anti-union reform crowd. It sound good, but it is wrong. Think about it, did the people negotiating a contract on behalf of Interim Superintendent Belmore put “student learning at the top of their list? Of course not, and they shouldn’t have.

An Interview with UW-Madison School of Education Dean Julie Underwood

It’s an unprecedented amount of change, honestly,” says Julie Underwood, the dean of UW-Madison’s highly ranked School of Education.
Consider:

  • The state this year will start rating each school on a scale of 0 to 100 based on student test scores and other measurables. The idea, in part, is to give parents a way to evaluate how a school is performing while motivating those within it to improve.
  • Several schools across the state — including Madison’s Shorewood Elementary, Black Hawk Middle and Memorial High schools — are part of Wisconsin’s new teacher and principal evaluation system, which for the first time will grade a teacher’s success, in part, on student test scores. This system is to be implemented across Wisconsin in 2014-15.li>And instead of Wisconsin setting its own student benchmarks, the state is moving toward using Common Core State Standards, which have been adopted in 45 other states. State schools are starting new curricula this year in language arts and math so students will be prepared by the 2014-15 school year to take a new state exam tied to this common core and replacing the Wisconsin Knowledge and Concepts Examination.

Although Underwood says she generally backs most of these changes, she’s no fan of the decision announced last month that makes it easier for a person to become a public school teacher — even as those who are studying to become teachers must now meet stiffer credentialing requirements. Instead of having to complete education training at a place like UW-Madison en route to being licensed, those with experience in private schools or with other teaching backgrounds now can take steps to become eligible for a public teaching license.
“I think that’s really unfortunate,” says Underwood, who first worked at UW-Madison from 1986-95 before coming back to town as education dean in 2005.

  • Improve student learning. As in everything we do, the first question and the top priority is student learning. How does what we are considering impact students?
  • Empower staff to do their best work. How does this impact teachers and staff? Does it help or hinder them in doing their jobs effectively?
  • Strategically align use of resources. Does this align with our strategic plan and achievement gap plan? Will it allow us to implement, measure, and improve that work? Is it financially responsible?
  • Avoid redundancies and create consistencies. Are pieces of the handbook already outlined in state law or Board policy or other mandates?
  • Consider incremental change. Can we work toward a larger goal through incremental steps?
  • Respectful discussion.

I will be surprised if the school District’s handbook differs materially from the current 182 page union contract. Some Districts will think very differently, while most will, I suspect continue business as usual.

Interim Superintendent Jane Belmore:

The initial TAG Plan, created by a variety of stakeholders including teachers, administrators, parents, and community members was approved by the Board of Education on August 27, 2009, and revised and approved on December 13, 2010. The Department of Public Instruction determined that the MMSD TAG Department was out of compliance at the end of May 2011. In June 2011, the current coordinator assumed duties and a new TAG Plan was written to address issues of noncompliance; the plan was approved by the BOE on August 8, 2011. An extension of one year was granted to MMSD to become compliant. The TAG End-of-Year document uses the framework of the original plan and incorporates information that addresses compliance issues as outlined in the 2011 TAG Plan. DPI has indicated that the audit will take place in the last half of September, 2012.
In the letter to Mr. Howard (August 14, 2012), DPI requested additional documentation be submitted to the DPI no later than September 7. The TAG Plan is a major piece of this documentation.

Big changes in the works for Madison’s 2012-13 school year

Wisconsin students, parents, teachers and property owners will feel the impact of major changes rolling out in Wisconsin’s public schools this school year.
This fall for the first time:

  • The state will assign numerical ratings to schools based on various test score measures.
  • Most students will start to see a new, more specific curriculum — in math and language arts, and with literacy incorporated in all subjects — in anticipation of a new state test in two years.
  • And dozens of schools, including three in Madison, will take part in the state’s new teacher evaluation system, which takes into account student test scores.

“This is huge,” State Superintendent Tony Evers said. “I’ve been doing this for 37 years and I haven’t seen this level of reform efforts.”
The unifying reason for the changes is the end of the No Child Left Behind era and the national move toward a more rigorous set of standards for what students are expected to know at each grade level, said Adam Gamoran, director of the Wisconsin Center for Education Research at UW-Madison. In order to obtain a waiver from NCLB, Wisconsin had to adopt the accountability system, higher curriculum standards and a teacher evaluation system.
“This has nothing to do with the turmoil we experienced in Wisconsin last year,” Gamoran said. “This is happening in every state in the country.”

Literacy is also important to Belmore who has a background and training as a reading specialist. “I’m a person who has quite a bit of expertise in curriculum and literacy so I’m really interested in the literacy goals that go throughout,” she says.
One of the things that Belmore is going to be pulling together is a Literacy Summit that she will facilitate. “The Summit is bringing together all of the pieces of the literacy initiative — middle schools, high schools,” Belmore says. “We’re going to work with the people who have been guiding that work just to communicate better so that high school teachers have a better understanding of what elementary school teachers are doing. I think it helps people understand that they are not alone and that it really takes all of us to do this.”
Belmore has been reaching out to the community — going to functions and talking to parents and meeting with agencies and non-profits. “There is a fair amount of that that goes along with this role and I actually enjoy that part of it,” she says. “I like to get out with people and talk about the work we’re doing and seeing what kind of questions they have. I’ve met with a lot of major community partners already — many whom I already had relationships with at Edgewood.”

Madison Schools’ Measures of Academic Progress (MAP) Assessment Results Released

The Measures of Academic Progress (MAP) is a computer adaptive series of assessments from the North West Evaluation Association (NWEA). There are tests in reading, language usage and math.
When taking a MAP test, the difficulty of each question is based on how well a student answers all the previous questions. As the student answers correctly, questions become more difficult. If the student answers incorrectly, the questions become easier. In an optimal test, a student answers approximately half the items correctly and half incorrectly. The final score is an estimate of the student’s achievement level. Each test takes approximately 50 minutes to complete.
MMSD has chosen to administer MAP for the following reasons:

  • It helps ensure technical infrastructure to support implementation of Smarter Balanced Assessment.
  • Rapid turn-around of classroom, school and district level data.
  • Nationally normed results give a more accurate picture of MMSD’s standing.
  • MAP measures student achievement growth in content area and within strands in a content area.
  • Beginning 2012-13, MAP will be aligned with the Common Core State Standards
  • MAP is not high stakes. It is not reported to the state for accountability purposes, but rather for district and school improvement.

In 2011-12, MAP was administered for Grades 3 through 7. In 2012-13, it will be expanded to include Grade 8. The default is to provide the test to all students, but MMSD has the ability to use judgment for students with disabilities. So, not all special education students will take MAP. Also, MAP is not for ELL levels 1 or 2.

I’m glad the Madison Schools published this information, and that they are implementing a much more rigorous assessment than the oft-criticized WKCE. I look forward to seeing the District’s report on the EXPLORE assessment, as well.
Nearby Monona Grove has used the MAP assessment for a number of years. It would be interesting to see how the Districts compare.

Q&A with Madison schools’ Belmore: Interim post ‘kind of my style’

Q: What will the state’s new report cards and individual school ratings this fall mean for Madison schools?
A: We need to work together with our community members and organizations and make sure we understand what the information is going to mean to our different audiences. The conversation that took place in the school district and the community last year laid the foundation for that. People are absolutely focused on the fact that we have to do better with all of our children. It’s really a matter of making sure the strategies that we have are moving forward and are the right ones and we’re checking them along the way and making corrections, and hopefully every child will be better on every measure

Words: Madison’s Plan to Close the Achievement Gap: The Good, Bad, and Unknown

Admittedly I did not expect much. Upon review some parts pleasantly surprised me, but I am not holding my breath that it is the answer to MMSD’s achievement gaps. It is a classic example of what I call a butterflies and rainbows education plan. It includes a variety of non-controversial, ambitious, and often positive goals and strategies, but no compelling reason to expect it to close the achievement gap. Good things people will like, unlikely to address MMSD’s serious problems: butterflies and rainbows.
What follows is a review of the specific recommendations in the MSSD plan. And yes, there are good things in here that the district should pursue. However, any serious education plan must include timelines not just for implementation, but also for results. This plan does not do that. Nor does it say what happens if outcomes for struggling subgroups of students do not improve.
Recommendation #1: Ensure that All K-12 Students are Reading at Grade Level

The rejected Madison Preparatory IB charter school was proposed to address, in part Madison’s long standing achievement gap.

News that Madison’s new, interim Superintendent Jane Belmore seeks to add a “Chief of Staff” provides taxpayers, parents and students an opportunity to reflect on the District’s priorities within the planned $376,200,000 2012-2013 budget ($15,132/student).
The District’s job #1, in my view is to address its reading problems. A kind reader mentioned that Reading Recovery was discussed at this past Monday’s school board meeting (video).
Will the status quo continue?

Madison schools’ interim superintendent talks with WISC-TV

WISC-TV: Are you good at “minding the ship” or are you going to want to make some changes?
Belmore: I will be making a few changes and I already have a few things in the works. But those changes will be made in a very mindful way; I’m kind of looking at this as short-term changes for long-term good. So, I will not do anything that will drastically impede anyone else coming in. At the same time, I think there are a few changes that need to be made so we can have a year of growth and constantly moving ahead.
WISC-TV: What are some of those changes?
Belmore: One of them is that I’m kind of reorganizing a little bit so that some people are reporting directly to me who were not reporting directly to the superintendent in the current organizational scheme. Basically, that is just for the fact that (my tenure here) will be a year. I won’t have time to move through the steps of the organization; I’m going to need that communication directly with myself.

Madison should land top talent for school superintendent

Those remarks seemed unduly negative and failed to give full recognition to the myriad qualities this market offers any newcomer. Like many, we favor the “who wouldn’t want to work in Madison?” view.
Not to worry, said School Board member Ed Hughes, who asked the question that prompted Ray’s comments at last week’s meeting.
“It was reassuring to me,” Hughes said. “It showed they had done their homework about this market. I thought it was realistic and useful.”
Next, Ray and Co. will talk to board members about their desires for a superintendent, then add some community outreach to the fact-finding process. If all goes well, this nationwide search will yield a strong, successful leader for one of the most important jobs in town.

Madison certainly has the community, financial and nearby (University of Wisconsin, Madison College, Edgewood College) assets to offer a world class K-12 education. Getting there will require substantial change and… change is very hard.

More Outgoing Madison Superintendent Dan Nerad Reflections

Q: Given a chance to oversee the Madison Prep debate again, would you have done anything differently?
A: My approach was I was attempting to make that work as an instrumentality of the district, and costs were prohibiting that. In terms of it being a non-instrumentality proposal, there were two big problems there. One was the fact that contractually it wasn’t permissible. The other area was the need for accountability to the public body and the governing board.
Q: So what would you have done differently?
A: I’ve looked into myself quite a bit on that and I don’t know what that is.
Q: So you think you were decisive enough?
A: Let other people judge that. But if I didn’t have an interest in looking at a program like Badger Rock Middle School and other innovative program designs, we wouldn’t have spent the time we did on Madison Prep. We put considerable effort into trying to find alternative ways to work that out and the reality of it is that it didn’t work out.

Outgoing Madison Superintendent Dan Nerad Reflects on His Tenure

Dan Nerad, the departing Madison Metropolitan School District superintendent, talked with WISC-TV on Thursday about his four years leading the district, plus the greatest challenges going forward.
He cited the four-year-old kindergarten program, which he implemented, and tackling difficult budgets as his achievements. Nerad said on some issues, such as over the heightened debate over the district’s minority achievement gap, there were shortcomings.
Nerad is scheduled to leave July 27 for the top job at the school district in Birmingham, Mich., a smaller and more affluent suburb of Detroit.

Departing Madison schools Superintendent Dan Nerad looks back and forward

The last day for Madison schools superintendent Dan Nerad will be July 27. Nerad, who led the Madison Metropolitan School District for four years, will be replaced by newly appointed interim superintendent Jane Belmore. In March, Nerad submitted his resignation to the school board and was subsequently offered the job of schools superintendent in Birmingham, Michigan. He will start there in August.
Isthmus recently sat down with Nerad to discuss his tenure in Madison and his new post.
Isthmus: What were some of the factors that went into your decision to ask the school board to terminate your contract by August 1?
Nerad: We had been in a discussion for several months about my leaving the district, so that is not a brand new thing. But, I have an opportunity to continue this work in another school district in Michigan, and that’s really what drove the more immediate consideration about leaving at this point in time.

“Good Thing We Have Some Time”; on Madison’s Next Superintendent Hire….

As for superintendent candidates, someone with the pugnacious edge of our 67-year-old mayor might serve the city well.
In a recent interview, Paul Soglin told me he’s believed for 40 years that the quality of a school system is the “number one driver” for a city’s success.
Soglin said Madison’s schools are excellent, and, yes, the achievement gap needs attention. But Soglin said it’s unfair to expect schools here to shoulder blame for children who arrived only recently. The school district “has not done a good enough job explaining itself,” Soglin said.
It is hard to disagree.
So, in sum, our next school chief should have Soglin-like skills at the big vision and respond to sniping at public schools, be able to boost the morale of embattled teachers and staff, collaborate effectively with a disparate set of civic partners, and bring experience and keen judgment to tackling the achievement gap.
Good thing we have some time.

I’m glad that Paul has written on this topic. I disagree, however, regarding “time”. The District’s singular administrative focus must be on the basics: reading and math.
Those behind the rejected Madison Preparatory IB charter school may have a different view, as well.

Interview: Henry Tyson, Superintendent of Milwaukee’s St. Marcus Elementary School

Henry Tyson, Superintendent of Milwaukee’s St. Marcus school recently talked with me [Transcript | mp3 audio] about his fascinating personal and professional education experience. St. Marcus is one of, if not the most successful voucher school in Milwaukee.
Henry discussed student, parent and teacher expectations, including an interesting program to educate and involve parents known as “Thankful Thursdays”. He further described their growth plans, specifically, the methods they are following to replicate the organization. In addition, I learned that St. Marcus tracks their students for 8 years after 8th grade graduation.
Finally, Henry discussed special education and their financial model, roughly $7,800/student annually of which $6,400 arrives from State of Wisconsin taxpayers in the form of a voucher. The remainder via local fundraising and church support.
He is quite bullish on the future of education in Milwaukee. I agree that in 15 to 20 years, Milwaukee’s education environment will be much, much improved. High expectations are of course critical to these improvements.
I appreciate the time Henry took to visit.

Of the 50 largest school districts by enrollment in the United States, Milwaukee Public Schools spent more per pupil than all but three East Coast districts in the 2009-’10 school year, according to public-school finance figures released by the Census Bureau on Thursday.
MPS ranked near the top among large districts by spending $14,038 per pupil in the 2010 fiscal year. It was outspent by the New York City School District, with the highest per-pupil spending among large districts – $19,597 – followed by Montgomery County Public Schools near Washington, D.C., and Baltimore City Public Schools in Maryland, which spent $15,582 and $14,711, respectively, per pupil that year.
MPS officials on Thursday acknowledged Milwaukee’s high per-pupil costs in comparison with other large districts, but they also pointed to unique local factors that drive up the cost, particularly the city’s high rate of poverty, the district’s high rate of students with special needs and other long-term costs, such as aging buildings and historically high benefit rates for MPS employees that the district is working to lower.
“The cost of doing business for Milwaukee Public Schools and Wisconsin is relatively high,” Superintendent Gregory Thornton said. “But because of legacy and structural costs, we were not geared toward driving those dollars back into the classroom.”
“What we have to be is more effective and efficient,” he said.

Madison’s 2009-2010 budget was $370,287,471, according to the now defunct Citizen’s Budget, $15,241 per student (24,295 students).
Why Milwaukee Public Schools’ per student spending is high by Mike Ford:

To the point, why is MPS per-pupil spending so high? There are two simple explanations.
First, as articulated by Dale Knapp of the Wisconsin Taxpayer’s Alliance in today’s story, MPS per-pupil spending is high because it has always been high. Since Wisconsin instituted revenue limits in the early 90s the amount of state aid and local tax revenue a district can raise (and correspondingly spend) per-pupil has been indexed to what a district raised in the prior year. In every state budget legislators specify the statewide allowable per-pupil revenue limit increase amount. Because MPS had a high base to begin with, the amount of revenue the district raises and spends per-pupil is always on the high side. Further, because annual increases are indexed off of what a district raised in the prior year, there is a built-in incentive for districts to raise and spend as much as allowed under revenue limits.
Second, categorical funding to MPS has increased dramatically since 2001. Categorical funds are program specific funds that exist outside of the state aid formula and hence are not capped by revenue limits. In 2001 MPS received $1,468 in categorical funding per-pupil, in 2012 it received $2,318 per-pupil (A 58% increase).
State and local categorical funding to MPS has gone up since 2001, but the bulk of the increase in per-pupil categorical funding is federal. Federal categorical funds per-pupil increased 73% since 2001. Included in this pot of federal money is title funding for low-income pupils, and funding for special needs pupils. The focal year of the study that spurred the Journal Sentinel article, 2010, also is important because of the impact of federal stimulus funding.

Comparing Milwaukee Public and Voucher Schools’ Per Student Spending

Note I am not trying to calculate per-pupil education funding or suggest that this is the amount of money that actually reaches a school or classroom; it is a simple global picture of how much public revenue exists per-pupil in MPS. Below are the relevant numbers for 2012, from MPS documents:

Though not perfect, I think $13,063 (MPS) and $7,126 (MPCP) are reasonably comparative per-pupil public support numbers for MPS and the MPCP.

Spending more is easy if you can simply vote for tax increases, or spread spending growth across a large rate base, as a utility or healthcare provider might do. Over time, however, tax & spending growth becomes a substantial burden, one that changes economic decision making. I often point out per student spending differences in an effort to consider what drives these decisions. Austin, TX, a city often mentioned by Madison residents in a positive way spends 45% less per student.
Ripon Superintendent Richard Zimman’s 2009 speech to the Madison Rotary Club:

“Beware of legacy practices (most of what we do every day is the maintenance of the status quo), @12:40 minutes into the talk – the very public institutions intended for student learning has become focused instead on adult employment. I say that as an employee. Adult practices and attitudes have become embedded in organizational culture governed by strict regulations and union contracts that dictate most of what occurs inside schools today. Any impetus to change direction or structure is met with swift and stiff resistance. It’s as if we are stuck in a time warp keeping a 19th century school model on life support in an attempt to meet 21st century demands.” Zimman went on to discuss the Wisconsin DPI’s vigorous enforcement of teacher licensing practices and provided some unfortunate math & science teacher examples (including the “impossibility” of meeting the demand for such teachers (about 14 minutes)). He further cited exploding teacher salary, benefit and retiree costs eating instructional dollars (“Similar to GM”; “worry” about the children given this situation).

It’s official: the Birmingham Board of Education passed a resolution Tuesday night officially hiring Daniel Nerad at the district’s next superintendent.
School Board President Susan Hill said Nerad — the current superintendent of the Madison (WI) Metropolitan School District — signed a contract with the district earlier Tuesday, with an official start date of July 1.
The school board selected Nerad, 60, as the next superintendent on June 11 after a two-month search process. Nerad was one of two finalists after five semifinalists interviewed in late May and early June.

Madison Superintendent Dan Nerad’s impending departure raises questions about the future of this year’s biggest budget initiative: the School District’s $49 million achievement gap plan.
“It’s a big question mark” whether a new superintendent will want to adopt the plan or make changes, said Michael Johnson, CEO of the Boys & Girls Club of Dane County.
“I don’t think (the School Board) should adopt the whole plan and hand it over to the new superintendent,” Johnson said. “I wouldn’t take a job if a board of directors said, ‘Here’s the plan we came up with and want you to execute.'”
Nerad said Friday he plans to accept a superintendent job offer in Birmingham, Mich., and leave Madison by September.

Next Steps for Madison Schools’ 2012-2013 $374,700,000 Budget

But as the School Board prepares to sign off on a final, scaled back version of the district’s achievement gap plan on Monday night, it appears a little wind has been taken out of the sails of an initiative that had many in the community talking this past winter.
“This whole discussion has been a bit hard to follow in recent weeks,” says Kaleem Caire, the president of the Urban League of Greater Madison. “The plan started out as one thing and then became something else and then became something else. To be honest, though, I’m not sure this issue ever got the momentum in the community that I thought it would.”
The School Board is meeting Monday at 6 p.m. at the district’s Doyle Administration Building (545 W. Dayton St.) to give preliminary approval for a 2012-13 budget. Superintendent Dan Nerad’s $374.7 million budget proposal released late last month includes $4.4 million next year to fund the achievement gap plan, which is down significantly from the $12.4 million price tag that was originally attached to the project.
“When the original plan was presented it was based on a view that there isn’t just one thing that any school district can do, and there isn’t any one thing that the community can do, to solve this problem,” says Nerad. “Instead, we needed to look at the many things that need to be in place if we’re going to have the elimination of this disparate achievement. But in the end, we also had to make sure we took into account other budget needs and to present a sustainable plan, so reductions were made.”
Nerad’s budget proposal also includes a $3.5 million increase in funding for maintenance. The entire budget, as proposed by the superintendent, would increase the amount the district levies for taxes by 4.1 percent — to $11.78 per $1,000 of assessed value. For the average-priced home in Madison, it’s estimated that school property taxes would increase $68.12.

On Madison Superintendent Dan Nerad & the Birmingham (MI) Job

If you judge the process by the questions, it would appear Dr. Daniel Nerad has the edge in being offered the job as the next superintendent for Birmingham Schools.
Nerad is the Madison School District superintendent in Wisconsin and one of two finalists for the Birmingham job. The other person is Robert Shaner, executive director of instruction and technology at the Warren Consolidated district.
Nerad has been superintendent for Madison Schools since 2008. Before that, he spent seven years as the superintendent for the Green Bay Area Public Schools. Shaner has less than a year of administrative experience.

How does a school district know when it has an effective program?
This can be a struggle for school districts, Nerad said, but programs need to be evaluated over time, districts need effective ways to collect data, and there needs to be systems in place that allow teachers to collaborate around data and solve problems.
What is the role of principals, the school board and superintendent in terms of innovation and curriculum development?
According to Nerad, the school board ensures there are enough resources for curriculum development and innovation, the superintendent is responsible for outlining what that curriculum will look like, while schools have the responsibility to implement curriculum in the way that’s best for each building.
What is your budgeting process and how would you go about cutting money from Birmingham’s budget?
Budgeting has to be a year-round process, Nerad said, and should he be hired, he would go to district stakeholders — whether they be parents, teachers or community members — and ask: what are your priorities?
How would you engage the rest of the Birmingham community, including the local business community?
Nerad said he would work with the district public relations office to focus heavily on engagement and outreach. “I do believe in putting a face on the superintendency,” he said.
How did you build consensus on an important issue?
When trying to reach consensus on tough issues, Nerad said he uses voting procedures and works to ensure people are heard. “My whole life has been dedicated to those kinds of practices.”
How do you judge whether a school board is doing a good job?
According to Nerad, the school board should be a model for the entire district.
“I believe if the superintendent evaluates the board, the board should evaluate itself,” Nerad said. “If we want our staff to grow, we have to model that kind of commitment. It’s about the whole organization getting better, from the superintendent to the board to teachers to support staff.”

Nancy Sebring resigns from Omaha superintendent job

In a stunning reversal of fortune, former Des Moines Superintendent Nancy Sebring went from presiding over Iowa’s largest school district to losing a new job she had landed to lead the Omaha schools, after disclosure she had used Des Moines school equipment to send and receive sexually explicit emails.
The Omaha school board voted Saturday afternoon without discussion to accept her resignation from the job she was to start July 1.
The vote capped a rapid-fire series of developments that unfolded in less than 20 hours:
8:46 p.m. Friday: The Des Moines Register publishes an online story reporting that Sebring’s abrupt, earlier-than-scheduled departure from the Des Moines district May 10 came after she was confronted by school board members about the discovery of the explicit emails.

Madison School District Superintendent Dan Nerad made the cut Saturday to become one of two finalists for the top job at a school district in suburban Detroit, according to an online report.
Nerad was selected as a finalist for superintendent of the Birmingham Public Schools at a special Saturday session of the School Board, the Birmingham Patch reports.
He apparently made a big impression on school board members in Michigan, particularly with his handling of controversy over the race-based achievement gap in Madison schools.

Birmingham’s 2011-2012 budget is $107,251,333 for “more than 8000 students”, or roughly $13,406/student. That is about 10% less than Madison’s $14,858.40/student.
Birmingham’s per capita income is $69,151, more than double Madison’s $29,782. Birmingham’s median household income is $101,529 while Madison’s is nearly half: $52,550.
Birmingham had 6 national merit semi-finalists this past year while Madison featured 41. Michigan’s 209 cut score was identical to Wisconsin’s this past year.
Madison continues to spend more per student than most American school districts.

Madison Schools Administration has “introduced more than 18 programs and initiatives for elementary teachers since 2009”

MTI President Kerry Motoviloff addressed the Board of Education at its May 21 general meeting. At issue is the District’s plan to introduce more new programs into elementary teachers’ literacy curriculum, including Mondo and 3 new assessments. At the same time, elementary teachers are being told that they will be losing release days for the administration of K-2 testing.
Motoviloff listed more than 13 current K-5 assessments, explaining to Board members that each assessment comes with a set of non-comparable data or scores. She noted that the District has introduced more than 18 programs and initiatives for elementary teachers since 2009.
Motoviloff stressed that all teachers are concerned about the achievement gap, and that the District needs to walk its own talk relative to ensuring fidelity in the curriculum process. She challenged the District to prioritize essentials, instead of swamping teachers with initiatives while reducing teachers’ time to implement the curriculum with fidelity, and emphasized the need to include time not only for assessments, but also time for teachers to analyze and plan. She also urged the District to stop pitting professional development against planning/prep time.

I’ve long suggested that the District should get out of the curriculum/program creation business and focus on hiring the best teachers. Like it or not, Oconomowoc is changing the game by focusing efforts and increasing teacher pay. Madison, given our high per student spending and incredible community and academic resources, should be delivering world class results for all students.
I don’t see how more than 18 programs and initiatives can be implemented successfully in just a few years. I’m glad MTI President Kerry Motoviloff raised this important issue. Will the proposed “achievement gap plan” add, replace or eliminate programs and spending?
Meanwhile, Superintendent Dan Nerad’s Madison tenure, which began in 2008, appears to be quickly coming to an end.

Paul Vallas Madison Talk Notes

About 100 parents of Madison schoolchildren looked toward a longtime superintendent on Saturday for answers on how to fix the achievement gap plaguing the district.
Paul Vallas, the superintendent of the Bridgeport, Conn., school district, previously led New Orleans schools during the recovery after Hurricane Katrina. The Boys and Girls Club of Dane County brought him to La Follette High School to help answer questions about the shortcomings of Madison schools.
Parents asked questions on several topics, but mostly focused on the minority achievement gap.
“They want perfection, and the achievement gap is that one big hurdle that they’re struggling to get over,” Vallas said in an interview after the two-and-a-half hour town hall. “This is a community that cares and sometimes when people care strong enough and have different viewpoints they have a tendency to shout at each other.”

Wisconsin, Milwaukee & Madison High School Graduation Rates

The DPI released graduation rates last year using both the new and old calculation method for the state and individual school districts, and did the same again this year.
An example of the difference between the two calculations: The legacy rate for the most recent data shows Wisconsin’s students had a 90.5% graduation rate for 2011, instead of the 87% rate for that class under the new method the federal government considers more accurate.
Using the new, stricter method, the data shows Milwaukee Public Schools’ graduation rate increased for 2011 to 62.8%., up from 61.1% in 2010.
“We have much more work to do, but these numbers – along with ACT score growth and growth in 10th grade state test scores – show that we continue to move in the right direction,” MPS Superintendent Gregory Thornton said in a statement Thursday.
MPS officials on Thursday pointed out that the 1.7 percentage-point increase between the two years for the district was greater than the state four-year graduation rate increase in that time. The state’s four-year rate increased 1.3 percentage points, from 85.7% in 2009-’10.

The annual report from the Department of Public Instruction released Thursday also showed Madison’s four-year graduation rate dipped slightly last year to 73.7 percent.
According to the data, 50.1 percent of Madison’s black students graduated in four years, up from 48.3 percent in 2010. The white student graduation rate declined about 3.1 percentage points, to 84.1 percent.
District officials and education experts said it was unclear what accounted for the changes, and it’s difficult to draw any conclusions about Madison’s achievement gap from one or two years of data.
“You need to be looking over a period of several years that what you’re looking at is real change rather than a little blip from one to the other,” said Adam Gamoran, director of the Wisconsin Center for Education Research.
The graduation rates of black and white students in Madison have been a major topic of discussion in the city over the past year.

Standing Firm on Grad Rates

Even as the Obama administration is busy dismantling much of NCLB through waivers, it is standing firm on some Bush-era decisions.
One of them is to consider high school graduation to be exactly that — graduating with a regular diploma, even if it takes five or six years for kids with special barriers. For accountability decisions affecting high schools, the Bush administration would not allow states to give schools “graduation” credit for students who obtain a GED or certificate of completion — only a regular diploma would do.
In response to the Obama administration’s new “ESEA Flexibility” initiative, states have taken another run at that decision, which was enshrined in last-gasp Bush regulations issued in October 2008.

The preliminary plan to eliminate achievement gaps provided a framework around which to engage members of the community in a discussion about what we need to do to address the achievement gaps. To gather input, we held community input sessions, met with community organizations, and talked with our staff. Summaries and an analysis of session feedback are listed in the plan and at mmsd.org/thefuture.
That input served as our guide in developing these recommendations. Then, we also considered educational research, the new federal mandates of the Response to Intervention (RtI) program, cost, and logistics, as well as community input. We reviewed what has worked in our school district, in our community, and in other districts across the country.
I believe that if we are going to do better by our children, we must invest. But I also believe we have a responsibility to balance the needs of our community and leverage resources for the greatest impact on student achievement. The final recommended plan is reduced from a financial perspective. This was done to ensure greater sustainability from a fiscal perspective.
The revised plan maintains the six original areas of focus. These six chapters illustrate the landscape of education today – areas that are critical to closing achievement gaps. They also represent areas where leverage exists to eliminate our achievement gaps. Any successful plan to close student achievement gaps must employ a combination of strategies. If there were one simple answer, it would have been employed a long time ago and replicated in districts across the country. Our reality calls for many solutions at many levels of the organization. Our problem is a complex one. Our solutions must be equally complex in their approach.
The good news is that research on what works has been going on for years. Although there is no one right way to teach all students, the research is solid on increasing student performance through an aligned curriculum, effective instruction, frequent monitoring of progress, research-based decision making before a child experiences failure, having interventions in place to help learners, and involving the entire community in support of children.
To address this last point, this plan also asks for a commitment from the community to join MMSD using elements of the Strive Model (Kania, John and Kramer, Mark. (2011). “Collective impact.” Stanford Social Innovation Review, Winter 2011) to develop a network which links services to schools through a collaborative district approach as well a school-based grass roots “community school model” approach based on each school’s need. This concept is elaborated where appropriate in each chapter and in the conclusion of this document.
The recommendations within this plan focus on academic rigor, expectations, accountability, response to behaviors, professional development, cultural competence,3 parents as partners, hiring for diversity, and establishing a new relationship with our community. It also is a plan that supports the federal mandates of Response to Intervention (RtI), which is the practice of providing high-quality instruction, interventions, and progress monitoring which is matched to student needs to make decisions about changes in instruction, and analyzing student response data decisions through collaboration.
These final recommendations reflect some effective work already under way that needs additional focus in order to meet student needs and RtI requirements, some promising practices, and some new ideas. These recommendations are all based on research and are a call to action to our staff, our families, and our community.
Some recommendations from the preliminary plan have been made more cost effective, and others have been elaborated upon. The following items are either new, have been eliminated, or have been revised to allow further planning during the 2012-13 school year:

We also know we must work with you, members of this great community, to better address the needs of our children. Stephens Elementary (Madison) school parents concerned after high schooler found asleep with pot pipe

After a high school student was found unresponsive in a West Side elementary school bathroom with a marijuana pipe in his backpack, parents are questioning why an alternative school program for academically at-risk high school students is in the same building as the elementary school.
“It does raise concerns,” said Becky Ketarkus, who has six children enrolled at Stephens Elementary, 120 S. Rosa Road. “I’d love to know what the plan is for the future to make sure the school is safe.”
Superintendent Dan Nerad answered that the program is not unique — two other elementary schools house alternative programs for high schoolers — and the district has had relatively few problems similar to the incident on Monday. He stressed that, unlike some other alternative programs, those in elementary schools are targeted to academically at-risk students, not those with behavior issues.

Superintendents: Lightning Challenge for School Reformer

Paul Vallas made his mark in education-reform circles as school superintendent in the big cities of Chicago, Philadelphia and New Orleans, post-Katrina. Now the superstar superintendent is trying to turn around the schools in much smaller Bridgeport, Conn.–in 150 days or so.
This is more than a curiosity: America’s economic future depends on fixing its public schools. And, as Mr. Vallas observes, “There are a lot of Bridgeports”–small, de-industrialized, cash-short cities with failing schools.
If he succeeds here–within “existing financial constraints,” as he puts it, and with strong unions–Bridgeport can inspire others. “There are models for school improvement that don’t cost $1 million a school,” Mr. Vallas argues, a not-so-subtle swipe at the cost of experiments elsewhere.
The saga of schools in Bridgeport (pop. 144,229), a poor city amid the wealth of Fairfield County, is too long for this space. The short version: For nearly a decade, the state has flunked the 20,250-student, 37-school system. Only 10% of tenth graders meet state math and reading standards. At the best-performing of the city’s three high schools, the dropout rate is 23%; at the worst, 45%.
For years, members of the elected school board were at odds both with each other and with the city. The city hasn’t increased school funding for four years.In July, with quiet backing from the mayor, governor and wealthy education-reform enthusiasts, the school board took the extraordinary step of voting itself out of existence and asked the state to take over. A new state-appointed board fired the superintendent and, in December, signed Mr. Vallas to a one-year contract, raising money from private donors whose identities weren’t disclosed to pay his $229,000 salary and settle with his predecessor. But in February, the state Supreme Court declared the takeover illegal, and ordered a special election for a new school board. The date has yet to be set.

Bridgeport’s 2010-2011 budget spent $215,843,895 for “more than” 21,000 students = about $10,278/student. Madison spent $14,858.40/student during the 2011-2012 budget cycle.

Madison School Board Member Ed Hughes:

Finally, the troubling differences in levels of student learning that give rise to our achievement gap present an enormous challenge for our teachers. We as a District have long been committed to inclusive and heterogeneous elementary school classrooms. Consequently, given the gap, our teachers frequently lead classrooms with a number of high-achieving students and a number of struggling students. Imagine how much dedication and ingenuity it must take for our classroom teachers to provide a learning environment where all their students can thrive. It would be helpful to hear from teachers about how they think they can be most effective in teaching all students in classes with such a wide span of developed capabilities, given our resource limitations.
Even test results as generally uninformative as the WKCE make clear the extent of our achievement gap in Madison. From the perspective of the WKCE and based on statewide averages, our white students on the whole seem to be doing just fine while our African-American students on the whole are struggling. This shouldn’t come as news to anyone, but it does underscore what’s at stake when over the next several weeks the School Board starts to decide what components of the superintendent’s achievement gap plan we’re actually willing to raise taxes to support.

Madison schools prepare for life after Nerad

WANTED: A K-12 schools leader with experience uniting a divided community, managing tight budgets and closing achievement gaps in an urban school setting.
PROBLEM: A shrinking pool of such dynamic leaders and a growing number of urbanizing districts like Madison seeking top talent.
“It is a tight market,” said Dan Domenech, executive director of the American Association of School Administrators. “The number of experienced superintendents that have done well in their districts and have the reputation of having done well — those are relatively few and those are the ones that everyone is going after.”
Madison will soon be conducting a search for a new schools chief after superintendent Dan Nerad announced he plans to depart by June 2013, when his current contract expires. He recently was named a finalist for a superintendency in Omaha, Neb., and though he wasn’t selected, he hasn’t ruled out moving to another job before the next school year starts.
Though Nerad’s time in Madison will have been short-lived compared to his predecessor, Art Rainwater, who retired after 10 years, the average superintendent in a mid- to large-sized city holds the job for an average of 3.5 years, Domenech said.

Faces of the achievement gap in Madison: The stories behind the statistics

In 2010, just five black and 13 Hispanic graduating seniors in the Madison Metropolitan School District were ready for college, according to data from the district and Urban League of Greater Madison. These statistics should make your heart race. If they don’t, and you’re white, you may be suffering from what anti-racism educator Tim Wise calls “the pathology of white privilege.” If you do get it and don’t take action, that is almost worse.
The issue affects all of us and fell a little harder into my lap than it does in most white middle-class families when my daughter told me last summer that I was going to have a biracial grandson. My response? “Not in this school district.”
The dismal academic record of minorities has long been apparent to me, through my own experiences and the stories of others. But many people only hear about the statistics. To help humanize these numbers I asked students and parents who are most affected to share their stories so I could tell them along with mine. The experiences are anecdotal, but the facts speak for themselves.

The push to raise achievement for minority and low-income students in Madison Metropolitan School District remains “a work in progress,” said Superintendent Daniel Nerad.
Work has been done on Nerad’s watch, such as drafting a new strategic plan and a multifaceted, $106 million proposal for programs aimed at shrinking test score gaps between students of different races and income levels.
As for results, Nerad and Madison school board member Ed Hughes say there hasn’t been enough progress.
“We certainly haven’t seen, overall, the kind of improvement that we would like to see in reducing the achievement gap,” Hughes said. “But we need to look at whether the steps are being put in place that would give us some hope or confidence that we will see those gaps narrowing in the future.”
Hughes thinks Madison is on the right track.

A look at the numbers:
Omaha spends substantially less per student than Madison. The Omaha 2011-2012 adopted budget will spend 468,946,264 for 46,000 students: $10,194.48/student. Madison’s 2011-2012 budget spends $369,394,753 for 24,861 = $14,858.40/student, 31.4% more than Omaha…. Green Bay (Superintendent Nerad’s former position) spent about 10% less than Madison, per student.

What Madison can learn from Nerad’s exit

Those who approve of Nerad’s performance and those who disapprove could agree that he seemed to be exiting in a responsible manner.
And there was not much objection to the $37,500 retirement payout that it was announced he would receive. It sounded, after all, like he was retiring. Or so Madisonians thought.
On Tuesday, however, the news arrived that Nerad was a finalist for a job as superintendent of the public schools in Omaha, Neb.
Awkward.
Madison School Board members confirmed that Nerad had not informed them when he was preparing for his “retirement” announcement that he was in the late stages of pursuing another job.
School Board President James Howard even had to field questions about whether he and other board members were “duped” by the superintendent.

Madison School Board responsible, too

Superintendent Dan Nerad’s departure is probably for the best.
The Madison School Board was split on Nerad’s performance, rating him as barely proficient in an evaluation completed last month.
Among other challenges, Madison is struggling to improve its atrocious graduation rates for black and Latino students.
Yet board members can’t dodge their own responsibility for better results. More than half of the School Board — Arlene Silveira, Beth Moss, Maya Cole and Lucy Mathiak — hired Nerad for the district’s top job just four years ago. And, ultimately, the superintendent’s role is to carry out the board’s vision, which hasn’t always been clear.
Nerad has been a measured and thoughtful leader. What he lacked in charm he sometimes made up for in knowledge and diplomacy.

Omaha Superintendent Search: Wisconsin educator dealt with unions, protesting teachers

When Wisconsin labor unions swarmed their State Capitol last year in a dispute with the governor, Madison Superintendent Dan Nerad found himself in the thick of it.
The Madison Metropolitan School District offices were about a mile from the Capitol, where unions gathered to protest Gov. Scott Walker’s effort to curb collective bargaining.
A representative of the district’s teachers union called to inform him that they would be joining the protest the next day and that he had better prepare to close the schools.
“It was like hitting him between the eyes with a hammer,” said John Matthews, executive director of Madison Teachers Inc.
Nerad’s handling of the situation was praised Tuesday by Matthews and Madison’s school board vice president, Marj Passman, and board president, James Howard.

Assistant superintendent Art Rainwater was elevated (no one else applied) to Superintendent when Cheryl Wilhoyte was pushed out. Perhaps Madison will think different this time and look outside the traditional, credentialed Superintendent candidates. The District has much work to do – quickly – on the basics, reading/writing, math and science. A steady diet of reading recovery and connected math along with above average spending of nearly $15k/student per year has not changed student achievement.

Student test scores show Madison lags state in cutting achievement gap

Madison and Wisconsin are moving in opposite directions in raising achievement levels of black students, according to state test scores released Tuesday by the Department of Public Instruction.
The percentage of black Madison students scoring proficient or better on the state reading test dropped to the lowest level in six years, while statewide black student reading scores continued to improve.
“The results affirm the work that we need to be doing and are doing to close our unacceptable gaps in achievement,” Madison Superintendent Dan Nerad said.
Overall student performance improved in math and dipped slightly in reading across Wisconsin compared with last year, while in Madison scores declined in all tested subjects.
Madison’s strongest gains were among eighth grade math scores, with the percentage of black students scoring proficient gaining 8 percentage points, Hispanic students gaining 16 percentage points and low-income students gaining 6.5 percentage points over last year.
Overall 77 percent of eighth-graders scored advanced or proficient on math, up from 76 percent last year. In all other grade levels the math scores were down in Madison from last year, whereas statewide the scores were up or the same in each grade level.

During a March 1 candidate forum, four candidates vying for two seats on the Madison school board explained their positions to a large audience at the Warner Park Recreation Center.
It was the sixth forum since January, and, for 90 minutes, the audience listened intently, though a lot of them were supporters, campaign volunteers, district watchdogs and union reps who likely already knew whom they would be voting for on April 3.
For many, the battle lines were drawn near the end of last year’s debate over Madison Preparatory Academy, the charter school proposed by the Urban League of Greater Madison that the board rejected on Dec. 19, largely because the teachers union opposed it. Accordingly, two candidates who opposed Madison Prep shored up early union endorsements, including from Madison Teachers Inc.
One of them, two-term incumbent Arlene Silveira, 53, is fighting to retain her seat against Nichelle Nichols, 43, who entered the Seat 1 race in response to the board’s rejection of Madison Prep. Nichols says the race is a choice between new leadership and the status quo. Silveira, on the other hand, says the district needs a board member “who can hit the ground running.”
The Seat 2 race to replace outgoing board member Lucy Mathiak pits firefighter Michael Flores, 34, against philanthropist Mary Burke, 52, in a contest couched in the language of the Occupy movement. Flores, a member of Fire Fighters Local 311, has gained union support in part because of his opposition to Madison Prep, while Burke had donated $2.5 million to the effort. Flores’ most vocal supporters have tried to obscure Burke’s extensive experience by assailing her as an out-of-touch 1 percenter.
Madison Prep engaged the community more than any other educational issue in years, sparking an outsized interest in the schools that shows little sign of waning. Candidates this year will have taken part in an unprecedented 12 candidate forums, among dozens of smaller events and listening sessions. Madison School Board rates Superintendent Nerad barely ‘proficient’;

If Madison Superintendent Dan Nerad’s job performance were judged like a student taking the state achievement test, he would score barely proficient, according to the Madison School Board’s most recent evaluation.
The evaluation, completed last month and released to the State Journal under the state’s Open Records Law, reveals the School Board’s divided view of Nerad’s performance.
School Board President James Howard said he expects the board to vote later this month on whether to extend Nerad’s contract beyond June 2013. The decision has been delayed as Nerad’s achievement gap plan is reviewed by the public, Howard said.
Soon after that plan was proposed last month, Howard said he would support extending Nerad’s contract. Now, Howard says he is uncertain how he’ll vote.
“It’s probably a toss-up,” he said. “There’s a lot of issues on the table in Madison. It’s time to resolve them. All this kicking-the-can-down-the-road stuff has to stop.”
Nerad said he has always welcomed feedback on how he can improve as a leader.

Madison Superintendent Art Rainwater’s recent public announcement that he plans to retire in 2008 presents an opportunity to look back at previous searches as well as the K-12 climate during those events. Fortunately, thanks to Tim Berners-Lee’s World Wide Web, we can quickly lookup information from the recent past.
The Madison School District’s two most recent Superintendent hires were Cheryl Wilhoyte [Clusty] and Art Rainwater [Clusty]. Art came to Madison from Kansas City, a district which, under court order, dramatically increased spending by “throwing money at their schools”, according to Paul Ciotti:

The Madison Superintendent position’s success is subject to a number of factors, including: the 182 page Madison Teachers, Inc. contract, which may become the District’s handbook (Seniority notes and links)…, state and federal laws, hiring practices, teacher content knowledge, the School Board, lobbying and community economic conditions (tax increase environment) among others.
Superintendent Nerad’s reign has certainly been far more open about critical issues such as reading, math and open enrollment than his predecessor (some board members have certainly been active with respect to improvement and accountability). The strings program has also not been under an annual assault, lately. That said, changing anything in a large organization, not to mention a school district spending nearly $15,000 per student is difficult, as Ripon Superintendent Richard Zimman pointed out in 2009.
Would things improve if a new Superintendent enters the scene? Well, in this case, it is useful to take a look at the District’s recent history. In my view, diffused governance in the form of more independent charter schools and perhaps a series of smaller Districts, possibly organized around the high schools might make a difference. I also think the District must focus on just a few things, namely reading/writing, math and science. Change is coming to our agrarian era school model (or, perhaps the Frederick Taylor manufacturing model is more appropriate). Ideally, Madison, given its unparalleled tax and intellectual base should lead the way.
Perhaps we might even see the local Teachers union authorize charters as they are doing in Minneapolis.

Madison School District Open Enrollment Enterers & Leavers



Superintendent Dan Nerad:

Under Open Enrollment, students may transfer into an MMSD school from another district or transfer out to another district – “enterers” versus “leavers.” This report focuses primarily on Open Enrollment leavers. There is also some discussion of the net effect of Open Enrollment, which is the number of leavers minus the number of enterers. This report does not discuss students attending private/parochial schools or home schooled students.
For the 2011-12 school year, MMSD has 913 leavers and 213 enterers for a
net effect of 700 students choosing to attend a district other than MMSD.
Of the 913 leavers for 2011-12, 580 were “continuing leavers” meaning they open enrolled outside of the District in previous years. That leaves 333 first time leavers for the current school year.
The growing number of leavers in recent years is the result of a cumulative increase over several years – those who are continuing leavers are still included in our counts in the following years. Because of this, it will take time to reverse the net number of leavers and first time leavers are of particular interest.
First time leavers increased only slightly from 2010-11 to 2011-12. If we discount the one-time bump for the first class of 4K, the number of first time leavers went down for the first time since at least 2005-06.
It is also important to note that nearly half of the students that are leavers never attended MMSD and could be considered “stayers” for other districts.
In terms of why people leave the district, we rely on a 2009 survey of leavers.

The Wisconsin State Journal, as part of its coverage of the Madison School Board election, is posing questions to the four candidates on various topics. Here the candidates react to Superintendent Dan Nerad’s achievement gap plan.
What are three strengths of the plan?
Mary Burke: Emphasis on K-3 literacy, research proves this is most effective in closing the achievement gap; AVID (expansion), in four years, I’ve seen AVID be effective, accountable and generate school support; and parental liaisons, but should be from low-income communities and trained to help parents engage in children’s education.
Michael Flores: Those that have the direct impact on children and families, such as expanding AVID/TOPS, parent liaisons to bridge the cultural gap that can exist between home and school, and implementing the mentor academy to provide positive role models to struggling minority students.
Nichelle Nichols: The document presented to the community is a document of ideas. It is not yet a plan. When the community is presented with a comprehensive plan for addressing the achievement gap in schools, and I have had sufficient time to review it, I will be happy to share my view.
Arlene Silveira: Early literacy programming and intervention focus because being able to read is critical for success. Expansion of the school day/year options to provide more time for our students in a learning environment. Parent engagement models because caregivers are important partners in supporting the education of our youth.

Narrowing Madison’s Achievement gap will take more than money

Madison school chief Dan Nerad’s plan to close the district’s achievement gap is certainly bold about spending money.
It seeks an estimated $105 million over five years for a slew of ideas — many of them already in place or attempted, just not to the degree Nerad envisions.
The school superintendent argues a comprehensive approach is needed to boost the academic performance of struggling minority and low-income students. No one approach will magically lift the district’s terrible graduation rates of just 48 percent for black students and 57 percent for Latinos.

Lessons from the Kansas City Desegregation Experiment

For decades critics of the public schools have been saying, “You can’t solve educational problems by throwing money at them.” The education establishment and its supporters have replied, “No one’s ever tried.” In Kansas City they did try. To improve the education of black students and encourage desegregation, a federal judge invited the Kansas City, Missouri, School District to come up with a cost-is-no-object educational plan and ordered local and state taxpayers to find the money to pay for it.
Kansas City spent as much as $11,700 per pupil–more money per pupil, on a cost of living adjusted basis, than any other of the 280 largest districts in the country. The money bought higher teachers’ salaries, 15 new schools, and such amenities as an Olympic-sized swimming pool with an underwater viewing room, television and animation studios, a robotics lab, a 25-acre wildlife sanctuary, a zoo, a model United Nations with simultaneous translation capability, and field trips to Mexico and Senegal. The student-teacher ratio was 12 or 13 to 1, the lowest of any major school district in the country.
The results were dismal. Test scores did not rise; the black-white gap did not diminish; and there was less, not greater, integration.

Tepid response to Nerad’s plan to close achievement gap in Madison school district; $105,600,000 over 5 Years

Madison school superintendent Dan Nerad unveiled his long awaited, and much anticipated plan (mp3 audio) to close the district’s more than 40-year-old racial achievement gap Monday night before the full school board and around 75 citizens who packed into a room inside the Fitchburg library.
The 109-page plan, titled “Building Our Future: The Preliminary Plan for Eliminating Gaps in MMSD Student Achievement,” makes about 40 recommendations at a cost of $60.3 million over the next five years.
Several recommendations called for building on existing programs, like AVID/TOPS, an acclaimed program that focuses on students in the academic middle.
Others, like a “parent university,” a model school for culturally relevant teaching, career academies within the high schools and a student-run youth court, would be new to the district.

Ideally, substantive program review in necessities such as reading and math would occur prior to the addition of new spending.
Matthew DeFour helpfully puts dollars ($105,600,000 over 5 years, about 5.6% of the roughly $1,860,000,000 that the District will spend over the same period) to the proposal. How does that compare with current programs and the proposed the proposed Madison Preparatory IB charter school?

Madison Schools Superintendent Nerad unveils $12.4 million plan to close school achievement gap

Altogether, Nerad makes about 40 recommendations in six categories — instruction, college and career readiness, culturally relevant practices, school environment, family engagement and staff diversity.
“The plan is based on the view that there isn’t one thing alone the school district can do to eliminate achievement gaps,” Nerad said. “We’re attempting to be comprehensive with the proposal.”
The plan’s projected cost for next year is $12.4 million, which Nerad is recommending come from the district’s untapped property taxing authority under state-imposed limits. The amount includes adding about 67.5 positions, including behavioral support staff, reading specialists and parent liaisons.
Some recommendations wouldn’t take effect until future years. The district estimates they will cost $20.9 million in 2013-14 and $26.6 million by 2016-17. The district doesn’t have the authority to raise property taxes by that amount, though Nerad said part of the discussion in coming months will involve whether the private and nonprofit sectors can help fund the strategies.
“We’re going to have to struggle through the conversation of how to get it done,” Nerad said.

Evaluating the Madison Metropolitan School District’s 2012 Plan to Eliminate the Racial Achievement Gap

Greetings Community Member.
This evening, at 6pm at the Fitchburg Library, Madison Metropolitan School District Superintendent Daniel Nerad will present his plan for eliminating the racial achievement gap in our public schools to the Board of Education. We anticipate there will be many citizens in the audience listening in.
While we are pleased that our advocacy over the last 19 months has resulted in the District developing a plan to address the gap, we are also mindful of history. Our organization has pushed hard for our public school system to embrace change, address the gap and expand educational opportunity many times before.
In the 1960s, Madison learned that a wide gap existed between black and white students in reading, math and high school completion in Madison’s public schools. In the 1970s, the Urban League of Greater Madison reported that just 60% of black students were graduating from the city’s public high schools. In the 1980s, ULGM released a widely reported study that found the average GPA for a black high school student attending the city’s public high schools was 1.58 on a 4.00 scale, with 61% scoring below a 2.0 GPA. It also found that a disproportionate number of black students were enrolled in remedial math and science classes, and that black students were significantly over-represented in special education and school suspensions. Then, in the 1990s, the Wisconsin Policy Research Institute issued a report that stated there were two school districts in MMSD, one that poorly served black children and one that served everyone else.
Today, just 48% of black and 56% of Latino students are graduating from high school. Just 1% of black and 7% of Latino high school seniors are academically ready for college. Nearly 40% of all black boys in middle school are enrolled in special education, and more than 60% of black and 50% of Latino high school students earn below a 2.0 GPA.
Over the years, several district-wide efforts have been tried. Unfortunately, many of these efforts have either been discontinued, unevenly implemented, ineffective, lacked the support of parents/community/teachers, or failed to go far enough to address the myriad needs of students, families, teachers and schools. Madison also has a well-documented history of not heeding the advice of leaders and educators of color or educational experts, and not investing in efforts to codify and replicate successful strategies employed by its most effective educators. MMSD also has not acted fast enough to address its challenges and rarely looks beyond its borders for strategies that have proven effective elsewhere in the country.
The stakes are higher now; too high to continue on our present course of incrementalism rooted in our fear of the unknown, fear of significant change, and fear of admitting that our view of Madison being the utopic experience of the Midwest and #1 city in the U.S. doesn’t apply to everyone who lives here. We no longer have the luxury of time to figure out how to address the gap. We cannot afford to lose nearly 300 black, 200 Latino and an untold number of Southeast Asian and underprivileged white students each year from our public schools. And we cannot afford to see hundreds of students leave our school system each year for public and private schools outside of the Madison Metropolitan School District.
We must embrace strategies that work. We must also behave differently than we have in the past, and can no longer afford to be afraid of addressing intersection or race and poverty, and how they are playing out in our schools, social relationships and community, and impacting the educational success of our kids.
Furthermore, we need all hands on deck. Everyone in our community must play a role in shaping the self-image, expectations and outcomes of our children – in school, in the community and at home. Some children have parents who spend more quality time with their career and coworkers than with their family. Some children have a parent or relative who struggles to raise them alone. Some have parents who are out of work, under stress and struggling to find a job to provide for their family. And unfortunately, some children have parents who make bad decisions and/or don’t care about their well-being. Regardless of the situation, we cannot allow the lack of quality parenting to be the excuse why we don’t reach, teach, or hold children accountable and prepare them for the future.
As we prepare to review the Superintendent’s plan, we have developed a rubric that will allow for an objective review of his proposal(s). The attached rubric, which you can access by clicking here, was developed and informed by members of the staff and Board of Director of ULGM, business and community leaders, and teachers and leading experts in the field of K-12 and higher education. The tool will be used by an independent Community Review Panel, organized by the Urban League. pver the next several weeks to vet the plan. The intent of this review is to ensure MMSD has an optimal plan for ensuring that all of the children it serves succeed academically and graduate from high school prepared for college and work.
Specifically, our reasons for establishing this rubric and a Community Review Panel are four-fold:

  • Develop an objective and comprehensive understanding of the plan and its many elements;
  • Objectively review the efficacy of the plan, its goals and objectives, and desired outcomes;
  • Formally communicate thoughts, concerns and ideas for supporting and/or improving the plan; and
  • Effectively engage the Madison community in supporting and strengthening its public schools.

We have high expectations of the Superintendent’s plan. We hope for a bold, transformational, aggressive and concise plan, and stand ready to assist the Superintendent and his team in any way we can. We hope you will be standing their with us, with your arms outstretched and ready to uplift or babies – the next generation.

How to solve the achievement gap in Madison?

Just when all signs indicated that supporters of Madison Preparatory Academy were abandoning hope of joining forces with the Madison school district, they’ve decided to give it one more shot. They’re seeking another vote on the controversial charter-school proposal in late February.
Urban League of Greater Madison CEO and president Kaleem Caire says Madison Prep will open this fall as a private entity, but hopes it will transition into the district in 2013, once the district’s union contract expires.
Board members who voted against the charter school in December expressed concerns that it would put the district in breach of its contract with Madison Teachers Inc., due to a provision requiring district schools to hire union staff.
School board president James Howard, who voted for Madison Prep, says the board may not have time to address the proposal in February.
Whether the Urban League — which proposed Madison Prep as an ambitious step toward closing the district’s decades-old achievement gap — can recapture its earlier momentum is uncertain, considering that Superintendent Dan Nerad and school board members seem particularly excited about their own plans to address the issue.
“We’re going at it from so many different angles right now,” says board member Beth Moss. “I can’t see how we can’t make some improvement.”

School superintendents’ bonuses may be ‘an issue from the public’s point of view’

Next year, Verona superintendent Dean Gorrell is in line to collect a $50,000 longevity bonus on top of his $140,000 salary.
In 2014, Madison superintendent Dan Nerad qualifies for a $37,500 payment for six years of service, which like Gorrell’s would be paid into a retirement account. Nerad already receives an annual $10,000 payment into his retirement account, which is separate from his state pension and in addition to a $201,000 yearly salary.
And in 2017, Monona Grove superintendent Craig Gerlach can leave the job with an extra year’s salary, currently $150,000, paid into a retirement account over the following five years.
Over the past decade, such perks have been added to some Dane County superintendent contracts, even as, on average, their salary increases outpaced teacher pay hikes, according to data provided by the Department of Public Instruction.
“Any type of payout at that level is clearly going to be an issue from the public’s point of view,” Dale Knapp, research director at the Wisconsin Taxpayers Alliance, said of the longevity payouts. “The problem becomes once these start getting into contracts, it becomes competition and then they become more prevalent.”
Adding bonus language to superintendent contracts became increasingly popular in recent years as school districts faced state-imposed rules on increasing employee compensation.

Perhaps, one day soon, teachers will have similar compensation freedom, or maybe, superintendents should operate under a one size fits all approach…
I’d rather see teacher freedom of movement, and compensation.

Madison Prep backers seek school board re-vote

When asked why he didn’t second Ed Hughes’ motion at the Dec. 19 meeting to delay the schools’ opening until 2013, Howard replied, “We had not discussed the implications of what that means. I think we have time if we’re talking about 2013, to make sure we do it correctly, because we don’t know what the rules of the game will be in 2013.”
Superintendent Dan Nerad said, “Whether it will move forward I don’t know. That depends on whether the motion gets on the floor. I don’t have a read on it at this point.”
Others aren’t as diplomatic. “This is a waste of time and money for all involved,” said TJ Mertz, an Edgewood College professor and district watchdog who is among Madison Prep’s most ardent critics.
“The votes are not there and will not be there,” he continued. “It distracts from the essential work of addressing the real issues of the district, including issues of achievement for students in poverty.”

Down Goes Madison Prep

s expected, the Madison Metropolitan School Board voted 5 -2 last night against authorizing the Madison Prep charter school. Only two board members overseeing a school district with an African-American graduation rate below 50% saw fit to support a new approach
Those voting against the school did offer reasons. Board member Beth Moss told the Wisconsin State Journal she voted no because of concerns about the school’s ability to serve students needing more than one year of remedial education. Board member Ed Hughes said he could not support the school until after the Madison teachers union contract expires in 2013.
But no worries, Superintendent Dan Nerad told the Wisconsin State Journal he has a plan:

The Madison School Board voted early Tuesday morning against a charter school geared toward low-income minority students.
Moments later, Urban League of Greater Madison President Kaleem Caire announced to a crowd of emotional supporters that he planned to file a racial discrimination lawsuit with the U.S. Justice Department. He also urged the supporters to run for School Board.
“We are going to challenge this school district like they’ve never been challenged before, I swear to God,” Caire said.
The School Board voted against the plan 5-2, as expected, just after midnight. In the hours leading up to the vote, however, hundreds of Madison Preparatory Academy supporters urged them to change their minds.
More than 450 people gathered at Memorial High School for public comments, which lasted more than four hours.
It was the first School Board meeting moved to Memorial since a 2001 debate over the Pledge of Allegiance in schools.

But the night’s harshest criticism was leveled not at the proposal but at the board itself, over a perceived lack of leadership “from the superintendent on down.”
“You meet every need of the unions, but keep minority student achievement a low priority,” said one parent.
Others suggested the same.
“This vote is not about Madison Prep,” said Jan O’Neill, a citizen who came out to speak. “It’s about this community, who we are and what we stand for — and who we stand up for.”
Among the issues raised by opponents, the one that seemed to weigh heaviest on the minds of board members was the non-instrumentality issue, which would’ve allowed Madison Prep to hire non-union staff.
A work preservation clause in the district’s collective bargaining agreement with the teacher’s union requires the district to hire union staff. Board member Ed Hughes said he wanted to approve Madison Prep, but feared that approving a non-instrumentality school would put the district in breach of its contract with Madison Teachers, Inc.
“It’s undeniable that Madison school district hasn’t done very well by its African American students,” he said. “But I think it’s incumbent upon us to honor the contract.”

Madison School District, Urban League Need To Come Together On Madison Prep

The Madison Metropolitan School District’s Board of Education vote on the proposed charter school, Madison Preparatory Academy, is just around the corner.
We have heard from school board members, business leaders, teachers and other members of the community. It’s safe to say that this is one of the most important issues in this city’s history. While I am happy that Madison is finally having the long overdue conversation about how we educate our students who are falling through the cracks, I am not happy that the Urban League of Greater Madison and the school district couldn’t come together to agree on a solution. In fact, it bothers me greatly.
It is a huge mistake to have this yearlong discussion come down to a contentious school board vote on Dec. 19. Both sides needed to come together to figure out a way to make Madison Prep a reality before that meeting.
Madison Metropolitan School District Superintendent Dan Nerad and various members of the school board say approving Madison Prep would violate the current contract with Madison Teachers, Inc. So, if 2012 isn’t feasible, committing to a date to open Madison Prep’s doors in 2013, and using the next three to six months to figure out the terms of that agreement should have been an option. But, unfortunately, that’s not going to happen. Instead we have a school district and a civil rights organization arguing over ways to address the achievement gap and graduation rates. Not a good look. And the future relationship between the MMSD and the African American community could hang in the balance.

Madison Superintendent Nerad to unveil plan to help low-income minority students

Madison Superintendent Dan Nerad said Wednesday he will unveil next month a new plan for improving the achievement of low-income minority students.
The plan will summarize the district’s current efforts as well as put forth new approaches, such as a longer school year and opening magnet schools, Nerad said.
Nerad discussed the plan in a meeting with the State Journal editorial board less than a week before the School Board is to vote on Madison Preparatory Academy, a proposed charter school geared toward low-income, minority students.
Nerad said he opposes the current proposal for Madison Prep primarily because it would violate the district’s contract with its teachers union, but that he agrees with the charter school’s supporters in that a new approach to close the achievement gap is necessary.
“I made a purposeful decision to not bring (a plan) forward over the past several months to not cloud the discussion about Madison Prep,” Nerad said. “It’s caused us to take a step back and say, ‘We’re doing a lot of things, but what else do we need to be doing?'”

Why I Am Voting Yes on Madison Prep

The Urban League’s proposal to create a Madison Preparatory charter school is, at its heart, a proposal about public education in our community. Although the discussions often boil down to overly simplistic assertions about whether one position or the other is supportive of or hostile toward public education, it is not that simple. What we are facing is a larger and more fundamental question about our values when it comes to the purpose of public education and who it is supposed to serve.
I am voting “yes” because I believe that strong public education for all is the foundation for a strong society. While our schools do a very good job with many students who are white and/or living above the poverty line, the same cannot be said for students of color and/or students living in poverty. The record is most dismal for African American students.
The Madison Prep proposal is born of over 40 years of advocacy for schools that engage and hold high academic expectations for African American and other students of color. That advocacy has produced minor changes in rhetoric without changes in culture, practice, or outcome. Yes, some African American students are succeeding. But for the overwhelming majority, there are two Madison public school systems. The one where the students have a great experience and go on to top colleges, and the one that graduates only 48% of African American males.
The individual stories are heartbreaking, but the numbers underscore that individual cases add up to data that is not in keeping with our self-image as a cutting edge modern community. We ALL play a role in the problem, and we ALL must be part creating a sound, systemic, solution to our failure to educate ALL of our public school students. In the meantime, the African American community cannot wait, and the Madison Prep proposal came from that urgent, dire, need.
Our track record with students and families of color is not improving and, in some cases, is going backward rather than forward as we create more plans and PR campaigns designed to dismiss concerns about academic equality as misunderstandings. To be sure, there are excellent principals, teachers, and staff who do make a difference every day; some African American students excel each year. But overall, when presented with opportunities to change and to find the academic potential in each student, the district has failed to act and has been allowed to do so by the complicit silence of board members and the community at large.
A few turning points from the past year alone:

  • The Urban League – not MMSD administration or the board – pointed out the dismal graduation rates for African American students (48% for males)
  • Less than 5% of African American students are college ready.
  • AVID/TOPs does a terrific job with underrepresented students IF they can get in. AVID/TOPs serves 134 (2.6%) of MMSD’s 4,977 African American secondary students.
  • The number of African American students entering AVID/TOPs is lower this year after MMSD administration changed the criteria for participation away from the original focus on students of color, low income, and first generation college students.
  • Of almost 300 teachers hired in 2011-12, less than 10 are African American. There are fewer African American teachers in MMSD today than there were five years ago.
  • Over 50 African Americans applied for custodian positions since January 1, 2011. 1 was hired; close to 30 custodians were hired in that time.
  • 4K – which is presented as a means to address the achievement gap – is predominantly attended by students who are not African American or low-income.
  • In June, the board approved a Parent Engagement Coordinator to help the district improve its relations with African American families. That position remains unfilled. The district has engagement coordinators working with Hmong and Latino families.

The single most serious issue this year, however, came in May when MMSD administration was informed that we are a District Identified for Improvement (DIFI) due to test scores for African American students along with students from low income families and those with learning disabilities. This puts Madison on an elite list with Madison (Milwaukee?) and Racine. The superintendent mentioned DIFI status in passing to the board, and the WI State Journal reported on the possible sanctions without using the term DIFI.
Whether one agrees or disagrees with NCLB, DIFI status is a serious matter because of the ladder of increasing sanctions that come with poor performance. In an ideal world, the district would have articulated the improvement plan required by DPI over the summer for implementation on the first day of school. Such a plan would include clear action steps, goals, and timelines to improve African American achievement. Such a plan does not exist as of mid-December 2011, and in the most recent discussion it was asserted that the improvement plan is “just paper that doesn’t mean much.” I would argue that, to the African American community, such a plan would mean a great deal if it was sincerely formulated and implemented.
At the same time, we have been able to come up with task forces and reports – with goals and timelines – that are devoted to Talented and Gifted Programing, Direct Language Instruction, Fine Arts Programing, and Mathematics Education to name a few.
Under the circumstances, it is hard to see why the African American community would believe that the outcomes will improve if they are ‘just patient’ and ‘work within the existing public school structures to make things better.’ Perhaps more accurately, I cannot look people in the face and ask them to hope that we will do a better job if they just give up on the vision of a school structure that does what the MMSD has failed to do for the African American community since the advocacy began some 40 years ago.

This letter is intended to respond to your December 4, 2011 blog post regarding the Madison Preparatory Academy initiative. Specifically, this letter is intended to address what you referred as “a fairly half-hearted argument [advanced by the Urban League] that the state statute authorizing school districts to enter into contracts for non-instrumentality charter schools trumps or pre-empts any language in collective bargaining agreements that restricts school districts along these lines.” Continuing on, you wrote the following:

I say the argument is half-hearted because no authority is cited in support and itjust isn’t much ofan argument. School districts aren’t required to authorize non-instrumentality charter schools, and so there is no conflict with state statutesfor a school district to, in effect, agree that it would not do so. Without that kind of a direct conflict, there is no basis for arguing that the CBA language is somehow pre-empted.

We respectfully disagree with your assessment. The intent of this letter is to provide you with the authority for this position and to more fully explain the nature of our concern regarding a contract provision that appears to be illegal in this situation and in direct conflict with public policy.
Background
As you are aware, the collective bargaining agreement (the “CBA”) between MMSD and MTI Iprovides “that instructional duties where the Wisconsin Department of Public Instruction requires that such be performed by a certificated teacher, shall be performed only by ‘teachers.”‘ See Article I, Section B.3.a. In addition, “the term ‘teacher’ refers to anyone in the collective bargaining unit.” See Article I, Section B.2. You have previously suggested that “all teachers in MMSD schools– including non-instrumentality charter schools- must be members of the MTI bargaining unit.” As we indicated in our December 3, 2011 correspondence to you, under a non-instrumentality charter, the school board may not be the employer of the charter school’s staff. See§ 118.40(7)(a).
Under Wisconsin’s charter school law, the MMSD School Board (the “Board”) has the exclusive authority to determine whether a school is an instrumentality or not an instrumentality of the school district. See§ 118.40(7)(a). That decisio n is an important decision reserved to the Board alone. The effect of that decision drives whether teachers and staff must be, or cannot be, employees of the Board. The language of the CBA deprives the Board ofthe decision reserved to it under the statute and that language cannot be harmonized to give effect to both the statute and the CBA. Alternatively, the CBA language creates a situation whereby the Board may exercise its statutory authority to approve a non- instrumentality charter, but it must staff the school with school district employees, a result clearly prohibited under the statute. For reasons that will be explained below, in our view, the law trumps the CBA in either of these situations.
Analysis
Under Wisconsin law, “[a]labor contract may not violate the law.” Glendale Professional Policeman’s Ass’n v. City ofGlendale, 83 Wis. 2d 90, 102 (Wis. 1978). City ofGlendale addressed the tension that can arise between bargained for provisions in a collective bargaining agreement and statutory language. In City of Glendale, the City argued that a provision dealing with job promotions was unenforceable because it could not be harmonized with statutory language. Specifically, the agreement in question set forth parameters for promoting employees and stated in part that openings “shall be filled by the applicant with the greatest department seniority…” City of Glendale, 83 Wis. 2d at 94. Wisconsin law provided the following:

The chiefs shall appoint subordinates subject to approval by the board. Such appointments shall be made by promotion when this can be done with advantage, otherwise from an eligible list provided by examination and approval by the board and kept on file with the clerk.

Wis. Stat.§ 62.13(4)(a).
The City contended that “the contract term governing promotions is void and unenforceable because it is contrary to sec. 62.13(4)(a), Stats.” City ofGlendale, 83 Wis. 2d at 98. Ultimately, the court ruled against the City based on the following rationale:

Although sec. 62.13(4)(a), Stats., requires all subordinates to be appointed by the chief with the approval of the board, it does not, at least expressly, prohibit the chief or the board from exercising the power of promotion of a qualified person according to a set of rules for selecting one among several qualified applicants.

The factual scenario in City ofGlendale differs significantly from the present situation. In City of Glendale, the terms of the agreement did not remove the ability of the chief, with the approval of the board, to make promotions. They could still carry out their statutory duties. The agreement language simply set forth parameters that had to be followed when making promotions. Accordingly, the discretion of the chief was limited, but not eliminated. In the present scenario, the discretion of the Board to decide whether a charter school should be an instrumentality or a non-instrumentality has been effectively eliminated by the CBA language.
There is nothing in the CBA that explicitly prohibits the Board from voting for a non-instrumentality charter school. This discretion clearly lies with the Board. Pursuant to state law, instrumentality charter schools are staffed by District teachers. However, non-instrumentality charter schools cannot be staffed by District teachers. See Wis. Stat.§ 118.40. Based on your recent comments, you have taken the position that the Board cannot vote for a non-instrumentality charter school because this would conflict with the work preservation clause of the CBA. Specifically, you wrote that “given the CBA complications, I don’t see how the school board can authorize a non-instrumentality Madison Prep to open its doors next fall, and I say that as one who has come to be sympathetic to the proposal.” While we appreciate your sympathy, what we would like is your support. Additionally, this position creates at least two direct conflicts with the law.
First, under Wisconsin law, “the school board of the school district in which a charter school is located shall determine whether or not the charter school is an instrumentality of the school district.” Wis. Stat. § 118.40(7)(a) (emphasis added.) The Board is required to make this determination. If the Board is precluded from making this decision on December 19″‘ based on an agreement previously reached with MTI, the Board will be unable to comply with the law. Effectively, the instrumentality/non- instrumentality decision will have been made by the Board and MTI pursuant to the terms and conditions of the CBA. However, MTI has no authority to make this determination, which creates a direct conflict with the law. Furthermore, the Board will be unable to comply with its statutory obligation due to the CBA. Based on your stated concerns regarding the alleged inability to vote for a non-instrumentality charter school, it appears highly unlikely that the Board ever intentionally ceded this level ofauthority to MTI.
Second, if the Board chose to exercise its statutorily granted authority on December 19th and voted for a non-instrumentality charter school, this would not be a violation of the CBA. Nothing in the CBA explicitly prohibits the Board from voting for a non-instrumentality charter school. At that point, to the extent that MTI chose to challenge that decision, and remember that MTI would have to choose to grieve or litigate this issue, MTI would have to try to attack the law, not the decision made by the Board. Pursuant to the law, “[i] f the school board determines that the charter school is not an instrumentality of the school district, the school board may not employ any personnel for the charter school.” Wis. Stat.§ 118.40(7)(a) (emphasis added). While it has been suggested that the Board could choose to avoid the legal impasse by voting down the non-instrumentality proposal, doing so would not cure this conflict. This is particularly true if some Board members were to vote against a non-instrumentality option solely based on the CBA. In such a case, the particular Board Member’s obligation to make this decision is essentially blocked. Making a decision consistent with an illegal contract provision for the purposes of minimizing the conflict does not make the provision any less illegal. “A labor contract term whereby parties agree to violate the law is void.” WERC v. Teamsters Local No. 563, 75 Wis. 2d 602, 612 (Wis. 1977) (citation omitted).
Conclusion
In Wisconsin, “a labor contract term that violates public policy or a statute is void as a matter of law.” Board of Education v. WERC, 52 Wis. 2d 625, 635 (Wis. 1971). Wisconsin law demonstrates that there is a public policy that promotes the creation of charter schools. Within that public policy, there is an additional public policy that promotes case-by-case decision making by a school board regarding whether a charter school will be an instrumentality or a non-instrumentality. The work preservation clause in the CBA cannot be harmonized with these underlying public policies and should not stop the creation of Madison Preparatory Academy.
The Madison Prep initiative has put between a rock and a hard place. Instrumentality status lost support because of the costs associated with employing members of MTI. Yet, we are being told that non-instrumentality status will be in conflict with the CBA and therefore cannot be approved. As discussed above, the work preservation clause is irreconcilable with Wisconsin law, and would likely be found void by acourt of law.
Accordingly, I call on you, and the rest of the Board to vote for non- instrumentality status on December 19th. In the words of Langston Hughes, “a dream deferred is a dream denied.” Too many children in this district have been denied for far too long. On behalf of Madison children, families and the Boards of the Urban League and Madison Prep, I respectfully request your support.

Howard Blume: New teacher contract could shut down school choice program

As schools across California bemoan increasing class sizes, the Alliance Technology and Math Science High School has boosted class size — on purpose — to an astonishing 48. The students work at computers most of the school day.
Next door in an identical building containing a different school, digital imaging — in the form of animation, short films and graphics — is used for class projects in English, math and science.
At a third school on the same Glassell Park campus, long known as Taylor Yards, high-schoolers get hands-on experience with a working solar panel.
These schools and two others coexist at the Sotomayor Learning Academies, which opened this fall under a Los Angeles school district policy called Public School Choice. The 2009 initiative, the first of its kind in the nation, has allowed groups from inside and outside the Los Angeles Unified School District to compete for the right to run dozens of new or low-performing schools.

Madison Teachers, Inc. on The Proposed Madison Preparatory Academy IB Charter School

The Urban League proposes that Madison Prep be operated as a non-instrumentality of the Madison Metropolitan School District. The Urban League’s proposal is unacceptable to Madison Teachers, because it would effectively eliminate supervision and accountability of the school to the Madison School Board regarding the expenditure of millions of dollars in taxpayer money, and because it would also violate long-standing terms and conditions of the Collective Bargaining Agreement between the Madison Metropolitan School District and MTI.
The Urban League proposes to use District funds to hire non-District teaching staff at lower salaries and benefits than called for in the Collective Bargaining Agreement. It was recently stated in a meeting between representatives of Madison Prep, the School District and MTI that the Urban League plans to hire young African-American males and asks that MTI and the District enable them to pay the teachers they hire less than their counterparts, who are employed by the District. MTI cannot agree to enable that. We believe that such is discriminatory, based both on race and gender. The MTI/MMSD Contract calls for teachers to be compensated based upon their educational achievement and their years of service. MTI and MMSD agreed in the early 1970’s that the District would not enable such undermining of employment standards. The costing of the Contract salary placement was explained by both Superintendent Nerad and John Matthews. Those explanations were ignored by the Urban League in their budgeting, causing a shortfall in the proposed operational budget, according to Superintendent Nerad.
It is also distasteful to MTI that the Urban League proposes to NOT ADDITIONALLY pay their proposed new hires for working a longer day and a longer school year. Most employees in the United States receive overtime pay when working longer hours. The Urban League proposes NO additional compensation for employees working longer hours, or for the 10 additional school days in their plan.
Finally, the Urban League is incorrect in asserting that MTI and the District could modify the MMSD/MTI Contract without triggering Act 10, Governor Walker’s draconian attack on teachers and other public employees. The Contract would be destroyed if MTI and the District agreed to amend it. Such is caused by Walker’s Law, Act 10. MTI is not willing to inflict the devastating effects of Act 10 on its members. The Urban League states that Walker’s Act 65 would enable the Contract to be amended without the horrible impact cause by Act 10. That claim is unfounded and in error.
The Madison Prep proposal could easily be implemented if it followed the Charter Plan of Wright School, Nuestro Mundo, and Badger Rock School, all of which operate as instrumentalities of the District, under its supervision and the MMSD/MTI Collective Bargaining Agreement.

MTI responds on Madison Prep

Madison Preparatory Academy could easily open if it followed the same model as the district’s other charter schools, Madison Teachers Inc. Executive Director John Matthews said in response to yesterday’s Urban League press conference.
But the current proposal is “unacceptable” to Madison teachers because it would “effectively eliminate School Board oversight of the expenditure of millions of dollars in taxpayer money” and violate the district’s contract with its union, Matthews said.
Matthews initially declined to comment on Madison Prep when I contacted him yesterday, but later responded in an e-mail.
In his response, Matthews criticized Madison Prep’s plan to pay its teachers lower salaries and benefits than other district teachers, and not offer overtime for working longer days.
He also said the Urban League is incorrect in asserting that the current union contract can be modified without nullifying it under the state’s new collective bargaining law.

Madison Schools’ Administration Opposes the Proposed Madison Preparatory IB Charter School

We are in agreement that the achievement gaps for low-income students, students of color, students with disabilities, and English Language Learners must be eliminated. The Administration agrees that bolder steps must be taken to address these gaps. We also know that closing these gaps is not a simple task and change will not come overnight, but, the District’s commitment to doing so will not waiver. We also know that to be successful in the long run, we must employ multiple strategies both within our schools and within our community. This is why the District has held interest in many of the educational strategies included in the Madison Prep’s proposal like longer school days and a longer school year at an appropriately compensated level for staff, mentoring support, the proposed culture of the school and the International Baccalaureate Program.
While enthusiastic about these educational strategies, the Administration has also been clear throughout this conversation about its concern with a non-instrumentality model.
Autonomy is a notion inherent in all charter school proposals. Freedom and flexibility to do things differently are the very reasons charter schools exist. However, the non-instrumentality charter school model goes beyond freedom and flexibility to a level of separateness that the Administration cannot support.
In essence, Madison Prep’s current proposal calls for the exclusion of the elected Board of Education and the District’s Administration from the day-to-day operations of the school. It prevents the Board, and therefore the public, from having direct oversight of student learning conditions and teacher working conditions in a publicly-funded charter school. From our perspective, the use of public funds calls for a higher level of oversight than found in the Madison Prep proposal and for that matter in any non-instrumentality proposal.
In addition, based on the District’s analysis, there is significant legal risk in entering into a non- instrumentality charter contract under our collective bargaining agreement with our teachers.
In our analysis of Madison Prep’s initial instrumentality proposal, the Administration expressed concerns over the cost of the program to the District and ultimately could not recommend funding at the level proposed. Rather, the Administration proposed a funding formula tied to the District’s per pupil revenues. We also offered to continue to work with Madison Prep to find ways to lower these costs. Without having those conversations, the current proposal reduces Madison Prep’s costs by changing from an instrumentality to a non-instrumentality model. This means that the savings are realized directly through reductions in staff compensation and benefits to levels lower than MMSD employees. The Administration has been willing to have conversations to determine how to make an instrumentality proposal work.
In summary, this administrative analysis finds concerns with Madison Prep’s non-instrumentality proposal due to the level of governance autonomy called for in the plan and due to our collective bargaining agreement with our teachers. Based on these issues, we cannot recommend to the Board that Madison Prep be approved as a non-instrumentality charter school.
We know more needs to be done as a district and a community to eliminate our achievement gaps. We must continue to identify strategies both within our schools and our larger community to eliminate achievement gaps. These discussions, with the Urban League and with our entire community, need to continue on behalf of all of our students.

In anticipation of the recommendation, Caire sent out an email Friday night to School Board members with a letter responding to concerns about the union contract issue.
The problem concerns a “work preservation” clause in the Madison Teachers Inc. contract that requires all teaching duties in the district be performed by union teachers.
Exceptions to the clause have been made in the past, such as having private day-care centers offer 4-year-old kindergarten, but those resulted from agreements with the union. Such an agreement would nullify the current union contract under the state’s new collective bargaining law, according to the district.
Caire said a recent law signed by Gov. Scott Walker could allow the district to amend its union contract. However, School Board member Ed Hughes, who is a lawyer, disagreed with Caire’s interpretation.
Nerad said even if the union issue can be resolved, he still objects to the school seeking autonomy from all district policies except those related to health and safety of students.

Caire said Madison Prep’s specific policies could be ironed out as part of the charter contract after the School Board approves the proposal. He plans to hold a press conference Tuesday to respond to the district’s review.
“The purpose of a charter school is to free you from red tape — not to adopt the same red tape that they have,” Caire said. “We hope the board will stop looking at all of those details and start looking at why we are doing this in the first place.”

How Madison Prep Can Be a Non-Instrumentality (Non-Union)?

Tomorrow afternoon, we are expecting to learn that MMSD’s Administration will inform the Madison Metropolitan School District Board of Education that Madison Prep should not be approved. A possible reason we expect will be MMSD’s concern that the current collective bargaining agreement between the District and Madison Teachers Inc. (MTI) has a “work preservation clause” which the teacher’s union advocated for long ago to ensure that it was the only game in town to represent public school teachers in Madison.
Below, is the cover note that I forwarded to Ed Hughes of the Board of Education and copied to a number of others, who had asked a thoughtful question about our proposal to establish Madison Prep as a non-instrumentality charter school, we hope, in fall 2012. This letter is intended to respond to your November 78,207I email and to suggest that there is a viable option for moving forward with Urban League’s proposal for the Madison Preparatory Academy (“Madison Prep”) that: [i) will reduce cost; and (ii) will not sacrifice the union security provisions of the Collective Bargaining Agreement “Agreement” or “Contract”) between the Madison Metropolitan School District (“MMSD” or “District”) and Madison Teachers, Inc. (“MTI”).
Your email asks for a response to a question concerning how the school district could authorize Madison Prep as a non-instrumentality charter without thereby violating the terms of the District’s Agreement with MTI. Your email references a provision in the MTI Agreement that provides “that instructional duties where the Wisconsin Department of Public Instruction requires that such be performed by a certifìcated teacher, shall be performed only by’teachers.”‘ .See Article I, Section 8.3.a. In addition you note that “the term ‘teacher’ refers to anyone in the collective bargaining unit.” See Article I, Section 8.2. You conclude your email by stating that “it appears that all teachers in MMSD schools — including non-instrumentality charter schools – must be members of the MTI bargaining unit.”
The Urban League is aware of the Agreement’s language and concedes that the language, if enforceable, poses an obstacle as we look for School Board approval of the plan to open and operate a “non-instrumentality” school. Under an instrumentality charter, the employees of the charter school must be employed by the school board. Under a non-instrumentality charter, the school board may not be the employer of the charter school’s staff. See S 118.40(7)(a). Thus, the statement in your email that all teachers, including those in a non-instrumentality charter school – “must be members of the MTI bargaining unit” and, presumably, employed by the school board is not permitted under Wisconsin law.
Under Wisconsin’s charter school law the School Board has the exclusive authority to determine whether a school is an instrumentality or not an instrumentality of the school district. .See S 118.40(7)(a). That decision is an important decision reserved to the School Board alone. The effect of that decision drives whether teachers and staff must be, or cannot be, employees of the School Board. The language of the Contract deprives the School Board of the decision reserved to it under the statute and that language cannot be harmonized to give effect to both the statute and the Agreement. Alternatively the Contract language creates a situation whereby the School Board may exercise its statutory authority to approve a non-instrumentality charter but it must staff the school with school district employees, a result clearly prohibited under the statute. In our view the law trumps the Contract in either of these situations.
The situation described above could likely only be resolved in a court of law. The Contract includes a “savings clause” that contemplates that where a court invalidates a provision in the Agreement, the invalid provision is deleted and the remainder of the contract remains intact. See Article VIII, Section E.
The Urban League is, however, mindful that litigation is both expensive and time consuming. Moreover it is clear that the Contract language will become a prohibited subject of bargaining in the near future when the current Agreement expires. Unfortunately, the children we seek to serve, do not have the time to wait for that day.
Our second purpose in writing is to make you aware of a possible solution to a major obstacle here. One of the major obstacles in moving forward has been the cost associated with an instrumentality school coupled with MTI’s reluctance to work with the District in modifying the Contract to reduce costs associated with staffing and certain essential features of Madison Prep, like an extended school day, As we understand it MTI does not want to modify the Contract because such a modification would result in an earlier application of 2077 Wisconsin Act L0 to the District, members of the bargaining unit and to MTI itself.
We understand MTI’s reluctance to do anything that would hasten the application of Act 10 in the school district, With the passage of 2011. Wisconsin Act 65, that concern is no longer an obstacle.
Act 65 allows the parties to a collective bargaining agreement to enter into a memorandum of understanding that would run for the remaining term of the collective bargaining agreement, for the purpose of reducing the cost of compensation or fringe benefits in the collective bargaining agreement,
The Act also provides that entering into such a memorandum would not be considered a “modification” of the collective bargaining agreement for the purposes of Act 10. Act 65 was published on November 23,2077 and took effect the following day. The law allows the parties to a collective bargaining agreement to enter into such a memorandum no later than 90 days after the effective date of the law.
The Urban League believes that Act 65 gives the Board and MTI the opportunity to make changes that will facilitate cost reductions, based in compensation and fringe benefits, to help Madison Prep move forward. And, the law allows the parties to do so in a way that does not adversely impact the teachers represented by MTI or the union security provisions of the Collective Bargaining Agreement.
For example, the parties could agree to reduce the staffing costs for Madison Prep, The parties could also agree that a longer school day would not have to cost more. And, the parties could agree that the work preservation clause referenced in the first part of this letter does not apply where the School Board has determined a charter school willbe a non-instrumentality of the District, a move that would also most certainly reduce costs. These changes would not be forced upon any existing MTI represented teacher as teachers would apply for vacancies in the school.
We hope that the School Board will give serious consideration to the opportunity presented by Act 65. 0n behalf of the Urban League of Greater Madison and Madison Preparatory Academy, we thank you for your support of Madison Prep.
